The 3rd Respondent (APC) begins her defense today.

Following

The 3rd respondent (APC) commenced their
defence today after the usual ritual of
introducing counsel to all parties present in
court.

The 1st witness was ushered into the
witness box by counsel to the 3rd
respondent S.L Akintola, Mr Charles
Otasowie Adenomo (3RWO01), ward 6
collation agent, a businessman who resides
at 72 Uwa street_Benin City, ikpoba Okha
LGA.
During cross examination by counsel to both
the 1st and 2nd respondents, the witness
told the court that there was proper
accreditation and the voting process went

But when it as the turn of the Counsel to
the petitioner Kemi Penheiro (SAN) to cross
examine the witness the story changed,
When asked to confirm to the tribunal that all
APC agents were not trained with the INEC
manual 2016. he answered, we weren't
trained at all,

Asked if it will be correct to say that both you
and all others trained by your party do not
know anything about voting process and accreditation. His reply was that i dont know.

Kemi - You agree accreditation is a must
before voting?

Witness- Yes sir.

Kemi - Do you also agree that if accreditation
isn't done, the election in that polling unit will
be invalidated and deeclared void?


Witness - Yes sir.

When he was asked by P Penheiro .(SAN) to confirm that his name was ticked during accreditation by the INEC official, he
answered yes he did tick.

Penheiro (SAN) asked the
witness to be showed exhibit PO 318(13).
item 23, page 3, that is your name, please
confirm how many tickings are besides it, his
replied was, I don't know.

Adenomo (3RWO2) , ward 6 collation agent, a farmer from Ikpoba Okha LGA.

When Counsel to the petitioner Kemi
Penheiro (SAN) asked whether he was
trained by his Party with INEC manual 2016
he answered, ,No.

So because you weren't trained with the INEC
manual 2016, its clear that you don't know
what Over voting means? The witness said I
don't know.

Asked if it will be correct to say that because
you didn't visit other polling units in your
ward, can you tell if you saw proper
accreditation.

his reply was that l don't know
because l didn't visit other units other than
my own unit, so l can't tell.

When the Srd witness (3RWW02) was asked
what was his name he said Nigeria Edo state
,when asked again he said he was Sunday
Eguasa , a clergyman from ward 10, Ikpoba
Okha LGA.
Kemi Penheiro (SAN) - Which polling unit did
you vote?
Witness - Ward 10. Unit 10

You know accreditation is very important?

Witness- Yes sir.

When asked when he signed his written
deposition, he said he signed on the 6th of
November 2016, which was a Sunday.

Kemi - Did you visit units 16-307

Witness - No l didn't

Kemi - So because you didnt visit those units,
you don't know what transpired there?

Witness - I don't know.

The 5th witness (2RWO5), Mr. Osadolor
Odumamwen, resides at 7 Uwa street off
Mission road, Iguobazuwwa, Ovia South-west
LGA, he is a businessman and farmer.

Kemi Penheiro- Were you present in all units,
he said No.

So you didn't observe any tickings in the
Voters register in unit 18 and 19?
Witness - I didn't observe them because I
didn't go to those units.

Kemi -But in your paragraph 17 of your
deposition you said there was nothing like
Over voting, do you still stand by that
statement?

Witness - Yes.

Kemi - Did you observe the voters register?

Witness - No sir, am not an INEC official.
Kemi Penheiro - Did you witness the INEC
polling unit officer ticking the voters register?

Witness - Yes.

Kemi - Show him exhibit PO 269(1), please
confirm that on the left of your paragraph,
item 736, page 47, if there are tickings to the
Jeft?

Witness - No ticking

The 6th witness (3RWO6), Mr. Omoruyi
Eboehi Samuel from Ovia South-west LGA.
Did your party train you with any INEC
document?

Witness - No.

Your party trained you that accreditation is
important?
Witness- Yes Sir,
Are you a staff of INEC?
Witness - No sir,
Kemi - So can you tell if there was any
complain to the INEC official present at your
poling unit?
Witness -I was there and lI saw everything
that happened.
Please answer my question Kemi Penheiro
(SAN) went further to ask, he said I don't
know my Lord.

Kemi - Did your party train you on ticking on
the voters register, in accordance with INEC
manual 2016?

Witness - No I wasn't.

Kemi - Did you observe any tickings in your unit

Witness - I observed.
Kemi - Please show the witness exhibit PO
271 (1) item 794, page 51, Confirm that there
IS ticking on your left side of the voters
register of your p paragraph?
Witness - No Sir.

The 8th witness, Mr.Enogheghase Johnson, a farmer from Agbonmwonba Village, he is to be cross examined with exhibit PO 4(78).

During cross examination, the witness was asked if he isn't surprised that his party didn't train him with any INEC document for example, the INEC 2016 manual his response was that he isn't surprised at all.

Asked if he used the INEC voters register to produce his deposition, he answered Kemi Penheiro (SAN) added, so your statements in paragraphs 13,16 & 17 of your deposition wasn't based on any INEC manual or Voters register?

But before he could answer, his counsel raised an objection that the witness be shown his deposition so as to identify those paragraphs, Kemi Penheiro (SAN) did by asking the witness to read out those paragraphs to the hearing of the court, after he executed that task, he was referred back to that same last question and he said "It was based on INEC documents" this answer threw the court into great laughter.

The 9th witness, Mr.Charles E.Osagiator, a businessman and politician, Oredo LGA, he is to be cross examined with exhibit PO 4(78).

In the course of quizzing the witness, he said he isn't surprised that his party didn't train him with any INEC document and that he isn't bothered.

S.L Akintola (SAN), informed the court that they have exhausted their witnesses list for today,so he prays the court adjourns sitting till tomorrow.

The judge just adjourned sitting till tomorrow 10th March 2017.
