You just keep your own part of the deal in court and wait for him not to do his part but visitation still comes with some responsibilities like child support

I have a friend who is in the same situation. She went as far as excluding the Father's name from her baby's birth certificate. I don't think such a man should be given the right to see his child cos he might end up breaking the rules that governs his visitation

tell that to a family where there's no male child. My friend had a guy we always felt was cheating but never caught. Imagine our shock when a girl walked up to us and told us she was pregnant for him. Long story short; she was an only child and her parents were very happy. Even though my friend's boyfriend and his family wanted to marry her her family refused. Why? Because they wanted her to have the child in their name. They said after she's had the baby he can come and marry and any child afterwards will be his. Capiche?
that's a rare case and still doesn't mean the children will be a son of the soil.

does it mean that those women who had no children and married other women are not going to claim the children by those women? The children of the land belong to the family they adopt their names from.

ok, I can see we clearly don't share the same tradition. Same sex marriage does not mean those two women sleep together, it is not a sexual marriage. But I don't think you understand this so I won't explain any further.

Let me help you.
The principle is that a child can never be owned by a woman unless the the father of the child denies the child.
The only benefit you have is for you to go to court,and ask for the custody of the child for the time being, since she is young, she is a female child and the father is an irresponsive man. you still have to prove to the court that her father is a useless person. The court will grant access for the man to see his child and to provide for her welfare. Note ,after she might have gotten to twelve years of age, the custody of the child will move to her father. You must be very careful because your life is at risk.

The law doesn't care whether bride price was paid or not, so long as the man is the father of the child he has a right to the child.

op you have a very good chance of getting custody.

for a man or woman to have a full custody
it does come down to evidence that the other person is incompetent of being a good parent

Pls what if the child in question is a male child I am asking this because of my friend in her case the guy deceived her and promised marriage she trusted him and was with the guys parents till she gave birth and went back to her parents together with d child but when the child stopped sucking the guys parent took charge of d child so she could go back to school and since then each time she comes back to school she has always been denied of taking her child with her to spend time with her at least till she go back to school she wanted d custody of her child not because she has another man but because the guy in question has been cheating on her and maltreating her despite the fact that she has been loyal to him and they have also denied her access to spend time with her son because he knows she will never marry another man except for him because of the love she has for her son the child is 2 year pls what can such woman do to gain d custody of her child

i get what you are saying two countries having different laws but in africa people most follow culture and tradition they rarely go to court

so most people think culture and tradition is law eg when hubby dies late hubby relatives grab everything, its tradition but by law everything belongs to wife

by law in most countries which has laws that were formed from english common law, custody of a child is given to the mother unless proved in court that, she cant look after the child in other forms

remember custody doesnt mean the child shouldnt visit or spend time with the other parent

custody means the child is register as living with named parent, so you can have custody but it doesnt the child is cut off from
the other parent

according to law, a child must have contact with both parents, irregardless of how they broke up or how they feel, only cases whereby abuse as been seen and recorded thats when a parent can be barred from having contact with a child

remember the above is law, not custom ot tradition per tribe etc most people in africa use tradition than going to court

so the lady cant claim maintainence of the child simply because their are not married ?
or the guy cant look after the child because their are not married

by law whether you are married or not its your responsibility

Here in Europe and Nigeria, the laws don't need all that. As long as the man is proven to be the child's father or his names appear on the birth certificate of the baby, that is all the father need to take away the child from the mother. In Europe, with a father name on the birth certificate, he could take the child away without any problem. If the mother of the child run to the police to complain, there is nothing they can do except what is called "WELFARE CHECK" at the father place.

The only option left for the mother of that child at that point is going to Court to file for custody and fight like men do in Court. She has 80% chances of winning the case if the child is still a baby.

In Nigeria, a child ll reside with his/her mum until age 8. The story changes after that....

Marriage certificate or dowry is useless when it comes to child case.

thats not true in Europe kids are always left in custody of the mother unless otherwise if the mother is proved by court via different government services like social services

look at most single parents in UK they have custody of the kids

If the girl is igbo from Anambra state then she has no problem. It is her father's child because the man (impregnator) did not pay bride price. He just a sperm donor. In my clan we say "ejiro nwa eme ogo" you don't give up a child as favour.

Ive handled many cases like this in the past decade or so.
Traditionally, in most customs, the child of an unmarried woman belongs to her father.
Nonetheless, in any matter relating to the guardianship and custody o children the interest and welfare of the child shall be the first and paramount consideration.
Go to Court. (Customary Court, or Family Division of the High Court) Prove that u can take better care of the child and that the respondent is irresponsible and wayward. The younger the child, the easier for you. Msg me if you have further problems. Good luck
