Calling someone "my bae" does not mean that a relationship exist as proscribed by the act. The Fed have to prove that he committed 'sexual amorous' act with someone of the 'same' sex.

Anyone can be arrested. I think what Festus was trying to say is that, he cannot be convicted.

As for arrest, the Police can arrest anyone and even charge anyone, but they have to prove their case before a judge.
