Y'all didn't think about checking the road worthiness of tankers until 9 died and over 30 cars/valuables got reduced to nothing in an inferno.

Medicine after death

They will soon even drop all this "passionate" conditions requested to be met. Three months is too long down the line...

Hmmmmmmmm. Na the owner drive the truck. The commercial driver that was carrying passengers was not mentioned. Clowns

Nope but many of these trucks are in bad shape yet they use them to convey petroleum products. If the truck is in a bad shape then the owner can be held liable. The truck couldn't climb up the slope and had no brakes to stop it from rolling back. That is a truck in a pretty bad shape yet the owner put it on the highway.

Useless Govt

I don't know how u people reason. Yes it can't bring the dead back to life but it can sure prevent suck from happening again if implemented well.

It won't bring back the dead but it will go a long way in preventing the same thing from happening again by serving as deterrent to others.

But there is no way the govt can win against the owner of the truck unless they can prove the truck was defective and he knowingly used it to transport fuel. It's more like media propaganda to appease the populace.

He will be tried because he allowed and owns a vehicle which is dangerous to human lives to ply the road without carrying out necessary tests to check it's road worthiness. The trial is also needed to compel the owner to pay compensation to all the victims.

So the owners of any vehicle that people died as a result of accident should be charged with manslaughter. So should this also be applied to other vehicles as well, for example okada, commercial buses and even airplanes?

Yes, this is the norm. Except it can be proven that the owners carried out the needed requirements to ensure the safety of the vehicle at the occurrence of the accident.

What is the worst that can happen in an okada accident? Death, disability of two, minor property damage

Scale this from to car, jeep, pickup, truck, truck with container

Now we are at fuel tanker, a moving bomb. The potential to kill and main a hundred, and cause massive property damage.

If this was a major marketer , it would be grounds to sack the ceo, head of safety, fleet manager just for starters.

There was an investigative report. They found out that the truck head was purchased in Texas and was manufactured to carry 14000tons or sthn, but they attached it to s tanker in Nigeria, carrying 34,000tons. These are not the accurate weights, but they wrote the right weights in their report. It was almost double.

So yeah, the owner is culpable. He should prove his innocence in court.

i am shocked that one has to explain basic vicarious liability, criminal negligence and involuntary manslaughter to some adults here

a lot of the people posting are lazy nigerian youths, but it is flat out amazing that Nigerians do not understand the concept of personal responsibility

everything is always in someone else's hands, be it the government, the daddy go, or the deity of choice
ZERO responsibility for anything rests on us.

LASG is making the right move. this will send out a message to all the truck owners out there - run your dangerous vehicles somewhere else.

owner is almost definitely aboki, so as soon as his identity is revealed, expect these same 'defenders of the indefensible to flip and support dealing with the 'murderous muslim killer'

Must you always exhibit your stupidity. Why the use of murderous muslim killer. Silly bigot.

It stands in the court of law, This is where the directors or BOSs are responsible for anything that happened btw his/their company and MOP. if the court finds out that they bridge safety regulations and me n u know they did then they are in for it. However its the state V them, so nah heavy case. This is how society adjust everywhere, something happens and they get dealt with others learn from it, heard this line ** Lesson would be learnt***
PS as for all the IFs,all they need do is check and audit the vehicle inspection and safety check.

Im happy you know there's a lot of "IFs" there. So you can't say FOR A FACT ,you know they breached safety regulations

Which vehicle are they going to do audit on ? The one that has been burnt to ashes

I've been expecting a law suit against MOT, as they are presumed to have certified the road worthiness of that truck. They failed in their responsibilities and this is the result. The victims suffered as a result of the failure of MOT and the vehicle owner. Although, it would be difficult to establish a liability against the vehicle owner, under certain principles.

The MOT will find a way, even if it means bending the judicial process to make someone suffer for that incident. and no authority will come out to accept irresponsibility on their part, rather they'll blame and probably jail the driver. that's the sad situation of almost every system in Nigeria, it's been flawed

Quite true, but it wld be a lame effort. They are only put up a good fight if they hire out the suit to a private legal practitioner but even at that, a good claimant who knows the rigours of negligence wld weave his way tru. Court room is a beautiful arena if the laws are at ur finger tips.
