An Osun State High Court presided over by Justice David Oladimeji yesterday dismissed a suit challenging the eligibility of Senator Ademola Adeleke as the candidate of the Peoples Democratic Party (PDP) in the September 22, 2018 governorship election in the state, saying that the constitution does not state that a candidate for the office of the governor must possess a certificate.


The plaintiffs, Rasheed Olabayo and Oluwaseun Idowu who are members of PDP in Osun had dragged Adeleke to court claiming that he did not possess the required certificate that qualifies him to contest governorship election in the state and urged the court to restrain the party from presenting him to the Independent National Electoral Commission (INEC) as candidate of the party.


They also urged the court to restrain INEC from accepting Adeleke from PDP as its candidate on the basis that the Senator was not qualified, quoting Section 177 (d) of the 1999 Constitution.
In his judgement, Justice Oladimeji said the claims of the plaintiffs that Adeleke does not possess school certificate cannot disqualify him from contesting the election because the constitution does not state that a candidate for the office of the governor must possess a certificate.


Justice Oladimeji said the constitution only stipulated that the candidate must be educated up to secondary school level and that the plaintiff also admitted that the Senator attended Ede Grammar School.
The judge struck out the case saying that whether Adeleke obtained a certificate or not cannot be used to disqualify him and that the fact that he attended the school is enough for him to contest.

If Buhari cannot present any certificate,and became a president and oshiomole could not even present a primary school certificate then why complaining about adeleke. At least he has a dancing certificate that is more acknowledged than a bread label.

You can become the president of Nigeria with NEPA certificate and a governor without one....tell me, just tell me why a child should bother going to school or making good grades?? When those in power can't even boast of a genuine university degree?? This country is the poster boy for the words HYPOCRISY and IRONY..situations like this tend to justify the acts of the many youths committing Internet fraud..

You didn't read it well. The judge said the person must be educated up to secondary school. So any evidence of secondary school attendance suffice. That's how the law operates but again the question to ask is whether JSS 3 certificate is not a secondary school certificate.

The judge was right, our constitution is clear on the requirements for one to hold elective posts in Nigeria. So, why bar the man when he has at least the minimum requirement - O level.

The man does not have O level. He failed his WAEC exams F9 parallel. That someone attended secondary school does not mean he is educated to secondary school level. This is a miscarriage of justice.

Legacy of foolish army miscreants who only have O level. We need to come together and build a constitution that makes sense for an educated civilian populace. This is disgraceful. I hope Osun people have more sense than electing a man who only dances with his round body, and did not seem it fit to take his life and education seriously.

So because plaintiff admitted, the judge accepted without proof of attendance(certificate).

Educated up to secondary level does not mean attended up to secondary school. The Judge was compromised.

See youths displaying their ignorance up there. The judge was bribed because he followed what what laid down in the constitution? See reasoning sha!

And well done to the people celebrating the legislators instead of holding them accountable to hammering out the outdated part of the constitution like the loop hole that Adeleke is exploiting.

The Nigerian constitution needs a mega overhauling else we will keep on going in circles.

Certificate is not proof of attendance. Even a continuous assessment result can be used as proof of attendance.
