He never corrected the said assets which he first declared.

If he did, there would be no need for all this brouhaha.

I couldn't bother responding to id911 misunderstanding of the constitution quoted. Thank you for responding as I would have loved to.

The Judiciary

They are all independent of themselves...

But there are rules to sack them.

The President could be Impeached for this as he has gone against the Nigerian Constitution.. which is a Treasonable act..

The law is on the side of the CCT.

His suspension just became an indefinite one.

His case keys have been thrown into the sea.

Court of Appeal cannot counter the CCTs punishment recommendation as supported by the powers vested on them by our constitution.

The outcome of the Court appeal's decision would render such stance posited by you invalid. The CCT committed an ultra vires act in excess of its statutory responsibility. The actions of the so called acting CJN and the CCT are serious misconducts that cannot be allowed to stand and would be punished appropriately by the relevant regulatory bodies.

Further to the above the affected officials are liable to compulsory retirement from respective position and possible disbarment for CCT & CCB officers

You guys don't know anything I swear... The CCB law says when you admit there was a mistake and corrected it as Mr Onnoghen has done since 2016, the case can not be referred to the CCT because he has been exonerated. Do you guys really understand your laws at all?

(i) the code of conduct act allows anyone to make an additional written statement on the assets that were not declared in the forms. Once that is done, the act says the person SHALL NOT be referred to the tribunal. And that's exactly what onnoghen did by declaring those accounts in WRITING. Why was he referred to the tribunal? 

(ii) the amounts quoted in those accounts are actually the TOTAL TURN OVER on the accounts not that the physical cash is there. They are releasing information in a wrong way to tarnish the man

(iil) the man has explained in his code of conduct forms the businesses he is into to get that money. He noted he was in private practice before coming into to the bench. He mentioned forex trading etc. It is instructive to note that the government has not accused him of fraud or stealing. Note our vice president was a university lecturer then a commissioner but he has close to a million dollars, close to 100 million Naira, houses in banana island and shares in mtn. Onnoghen has been in private practice before the VP and no one yet has said he stole money. So why resign? 

There for if the issue is that of declaration, code of conduct act ( look at section 3 below) has covered the man well

The only arm of government that sometimes is Independent is the executive and that is due to the fact that it has been empowered to issue executive orders which is also law and does not require the input of the legislature or judiciary.

Juxtaposing Salami's (President of the Appeal court) case to that of the CJN is a fallacy of interpolation.

...Unrelated cases, different class of people, different constitutional protection, different powers, and different procedures for removal.

We should know the position of law at every stage of the issue. ....How one leads to the other.

Try to Read the CCB act.

If you don't declare all your assets while filling the forms, CCB is mandated to write you about the omission/s which you are to respond to, giving reasons for the omitted assets. If you accept that the omitted assets are yours and include them in the form, you are free from any prosecutions by CCT.

But if those assets are denied and are proven to be yours, and have been corruptly acquired then you have a case to answer at the CCT.

In this case Onnoghen received letter from CCB and did the needful by writing CCB back that he owned the stipulated assets and joined them on his declaration form.

Buhari took that up for prosecution at CCT but knowing fully well that it's a case in futility

Buhari chose to propagandize with media prosecution to campaign that the CJN should resign. Buhari wants the country to see CJN as corrupt while he executed the coup against the judiciary.

CCT is under the control of the executive arm of government, while its chairman is facing corrupt charges, but the president didn't suspend him.

CCT heard the case, but the jurisdiction of CCT was challenged. Umar danladi, the Judge, adjourned the hearing from 21st January to the 28th January and later *"gifted" an order on a motion that wasn't presented before him or heard from any counsel* .

That's injury to justice!

The order wasn't served on the CJN yet, nor was he allowed to respond to it.... either to step down or challenge it in court.

But Buhari hastily pronounced the suspension of the CJN and swore in an acting CJN.

This is alien to the law.

The CJN is the Head of the Judiciary and can't be suspended or removed by the President under any guise without due process.

If a criminal allegation is made against the President will he just resign? ...Without defence?

The CJN has not admitted he did anything wrong as being claimed by Buhari, regarding his response to CCB.

Can the Senate President be unilaterally suspended by the President?

The Principle of Separation of Powers is very clear and unambiguous on the Powers of the 3 arms of Government, viz, Executive, Judiciary & Legislature.

It seems *"Buhari is dancing naked at the market square, and instead of his handlers to call the Psychiatrist, they are intensifying the music"

The way this letter has been hand-written in this computer age and with the intentionally deceptive scribble it has so been, it MUST EITHER be the handiwork of a smart fella or an experienced criminal! Or both! Warts and all, I doff my hat for Onneghen and wonder if the 'o' in Ole belongs to em.
