Scenario: A defendant is charged with an Assault under the Law. The section A of the Law says a defendant is guilty for punching someone. Section B of the Law says a defendant is guilty for slapping someone in the face. The prosecution case is the defendant slapped the victim but the charge was constructed under section A of the Law. The defendant knew he had assaulted his victim and he changed his plea to guilty because his Lawyers advised him to do so on the basis of the prosecution strong evidence that he slapped the victim, and he would be found guilty of assault by the Jury. Fresh evidence later show that the defendant slapped the victim in the shoulder. What is his chance of success in the Appeal against the conviction? |
