You see why even Buhari, says some Judges are Corrupt?
The Applicant is only asking the Court to compel the EFCC to INVESTIGATE the accused person but here is a Judge saying, to grant that prayer, EFFC must be in possession of the Evidence (that was already in the public domain, in form of Video and Audio) before she can grant that prayer.

So, to protect Ganduje, the EFCC is simply claiming IGNORANCE of the Video evidence!

This is why some Lawyers and Citizens say that Buhari's war on corruption is SELECTIVE, VINDICTIVE and NEPOTISTIC, in favor of his Northerners or favored Party members

As a sitting governor, he cannot be prosecuted. Some jobless people went to court to compel efcc to investigate and prosecute. The court dismiss the suit, upholding the constitution. after his tenure Ganduje will answer for his crimes.

...noting that the report ought to be given to the Kano state House of Assembly ad-hoc committee set up to investigate the matter.

Only the house of assembly can investigate a sitting governor and impeach him if possible.

You are a complete illiterate and Zombified dunce!...since you dont know the difference between being INVESTIGATED (as asked for), and being PROSECUTED, which a Governor is immune from, while in Office.

Investigation (without prosecution) infers seeking-out the truth of an allegation, gathering evidence and documenting it. No more, No less.
Even the President can be investigated while in office but he cannot be charged to court and prosecuted.

Even other highly corrupt countries are forced to do the right thing when caught like gandollar.

But not Nigeria, shame and honour is not in their dictionary.

Even the president endorsed him without shame, and he is supposedly fighting corruption.

The judge said there is no proofs the said video is with the efcc
Meaning the efcc must have the video and must have done forensic investigations to proof it's the governor in the tape and not a doctored tape
The judge also said the freedom of information act says such request must be with the organisation u are requesting it from
Since he couldn't prove the efcc has the vidoe and has done the said forensic investigation

It is you that did not read the Judge's reason for dismissing the case.
Read it again and come back.


The Judge dismissed the case for[b] lack of substantial evidence[/b].

Bulama had approached the court seeking an order to ask EFCC to provide report of its forensic investigation analysis on the said video showing Ganduje receiving bribe from an unknown contractor.

Justice Egwuatu ruled that “even though where the affidavit deposed to, is not countered, it is deemed admitted, the evidence therein must be cogent and verifiable.

The judge added that “the provisions of Freedom of Information Act 2011, required that information requested must be a public record and in the custody of the instruction of organization so requested from.”

Justice Egwuatu dismissed the case on the grounds that the evidence before the court has not shown that the EFCC has the record of the forensic analysis of the bribery video allegations, noting that the report ought to be given to the Kano state House of Assembly ad-hoc committee set up to investigate the matter.

You see how the useless Judge "deflected" from the prayer being sought?
The prayer was for EFCC to PROVIDE THE REPORT of the INVESTIGATION it did (it already did the investigation of the Governor, based on a video of him collecting bribe, which he claimed was not him in the video!)
The Corrupt Judge then went on a tangent, implying that the information sought is not in the possesion of EFCC, it is not a Public record and that the applicant shoudl go to the House to act on the Video. angry undecided

Pay particular attention to "investigation" and "prosecution".
My point is, the Governor or anyone can be investigated.......... but he cannot be prosecuted while in office.

To those who do not understand and have been misreading this ruling, What they dismissed was an action to compel the EFCC to investigate Ganduje. Case wasn't filed against Ganduje. Was filed to compel EFCC.

So the ruling was not about Gandujes bribery issue but the desire to have him investigated.
