OlujobaSamuel:

The house was demolished by the state government not FG. Read the report again. FG can't demolished any building not within federal government land.
Enugu State capital development authority demolished his house somewhere else within the state.

Then that raises the question of: On WHICH ORDER, did the state Govt demolish his house?
Granted that All Land Title rests with the State Governor and it can withdraw a Cof O "BUT" once the Governor or his agents sign your C.of.O, that parcel of land becomes yours and the Governor has entered into a contract with you, for a payment of consideration, transfering it's Title to you.

For the Governor to withdraw that Title, the law requirs he enters into negotiation with you and pay you more than adequate compensation.
Now, this obviosuly was not the case and the Governor at the time of demolition (acting on the behest of the FG), has no "Valid Court Order" authorising such demolition.

The guy can go back to court to enforce his fundamental Right to own property and the Court will order the Govt to pay him more than adequate compensation and additional Cost.

But we know that the Nigerian Govts, including States are perrenial Law breakers that disobey Court Orders.
Buhari was ORDERED BY A COURT ORDER to release El Zaky, he refused, reelase Dasuki, he refused. release Sowore, he refused for many months and there are so many young people in DSS and Police Jails in Nigeria, held indefinitely without any court order, but on th eorders of Politicians, including patience and Jonathan, who order a young boy who parodied Jonathan to be held for the last four Months, in DSS detention.
Small time, Jonathan will be forming "gentleman" that conceeded election loss, like that act is supposed to win him a Nobel Prize in Cowardice! grin
That is how LAWLESS this Nigeria Leaders are

There was a case concerning the land in court some years ago between the man and FAAN which the man won and FAAN was asked to vacate the land for the man and FAAN duly obeyed, the fast foreward to now, Govt through Min. of Aviation decided to expand the airport and the expansion encourached into the said land. The man then felt it incumbent to act and the result is what is evicent today. Many people were disposed of their land not only the man.

Thanks for the info, appreciate

Think before you talk, please.
He did not take laws into his hands, he only enforced his "Cout awarded Rights", with the Court Staff (Bailliff) present and his lawyer.
A competent Court has given Judgement that the land is his property so he has the right to that property and all he did was to ask the Court or aid the Court to enforce that Court Order, using the Court Baillif, Lawyer and Police Officers (Sate officers).

The Aviation Minister just want to show him that Buhari and Northerners are in Power, believe me, if he was a Northerner or Military General, Minister Sidika will simply go to Court, not come and demolish his house.
If the man was really "ready", he should have sprayed Bullets on those who came to destroy his house, including that Minister and his entourage.

The man forged judgement. He took himself to court and won himself, then took police to court for not enforcing the judgement and got judgement same day. The judge that gave the fake judgement is in big trouble. The man himself is wanted for previous unanswered crimes and for breach of national security.

For the person talking blah blah blah below, keep saying what you don't know. If you see the so-called documents he got from court you will weep for Nigerian judiciary systm. So many irregularities and other things. For example he got the judgement for an area and was executing the judgement in another area. The court judgement is so vague and doesn't contain beacon numbers or well-described address of the said place.

The NJC has already started making enquiries on the judge.

You are EVIL and you know you are lying against the man!
How can a Court Judge issue a Judgement and you say the applicant FORGED the Judgement? Are you that daft?
You confirmed that the judgement was given by a Judge, ..and you said he forged the judgement at the same time!
shocked shocked

It is not the Applicants (the man) problem, if a Court if competent jurisdiction gave a judgement in error, the Defendant (govt) simply has to appeal the judgement to a higher Court, to correct the error, not go demolish the man's house on those grounds, assuminng but without conceeding that it is true.

The action of Govt is sheer Lawlessness, if we look at it objectively, because they have no court order to do what they did. its that simple.

Good riddance.

There are better ways to claim ownership of landed property than destroying your government's fence. His bravery is outright foolishness.

Seizing his house would give him hope, but this demolition simply means that he tasted from his own tea.

The poetic justice metted out on him is highly commendable

Does 2 wrongs now make a right?
Should government also behave as a rascal?
Does the house encroach on government land?

Whilst his action is very unacceptable, government action is very unbelievable.
I can't believe government taken that kind of action without proper judicial process.

"This kind of Tit for Tat mentality from government only shows how crude and Raval they are. Thug-life government!

Shut down your rotten brain and fingers.

Do you know who I am to think an architect would know about land matter than me?
What side of a story can a man has as excuse for destruction.

I'm not talking about the legality or morality of the action, just responding to who the culprit is.
Our govt or should I say everyone with little authority sees themselves as the law.

This is the most stupid thing to do. Demolishing the government’s property, claiming encroachment into your land/property.

The property he claims to have is not his, he is only occupying the land cos the Land Use Act of 1978 has placed all land within a state in the hand of the State Government (apart from the mining site). His Certificate of Occupancy can be withdrawn, revoking his right to the land.

His stupidity can make him lose his property and even go to jail, cos the state government can be compelled by the federal government to revoke his CofO.
It is always good to apply wisdom in all we do. He could have find a way to resolve the issue by demanding for compensation for the land encroached or litigate and resign to fate on any outcome from the court.
My problem is the idiot is an architect that is supposed to have known even better.

I think the government ignored him, and he did that out of anger. I can remember when Ebonyi State Government came to my father's property, destroyed the uncompleted buildings there and used it to build fire service. Later, they seized the other one. At present, they're using mago mago to share the other land among themselves, without giving us any compensation. They're doing all these illegalities because we're from Anambra State. They also seized other lands owned by mostly Anambrarians. If I retaliate tomorrow, people will say all sorts of things. It's only in Nigeria that people in government will use their power to trample on the rights of others, yet we cry to high heavens that black lives matter if a white man does that. The hypocrisy of Africans is outrageous.

Are u saying what he did is right?

This saying that no one can fight with government actually irks me. So government (which by the way is nebulous) has a right to perpetuate illegality just because it is government? As they say, in saner climes, you can contest with government, take your matter to court, get judgement and get the government to obey. This comment about the infallibility of government begs the question as to whether government is always right , which i honestly do not think is correct, well except in Nigeria.

Even if you got favourable judgement against the government, you still need the presence of police and the court officials to execute the judgment. The man went to destroy airport fence with thugs thereby putting the lives of others in danger. Government has reason to make him a scapegoat by all standards.
From Nigeria to USA to China, you can only use the law to fight the government. Any other means will get you hurt, you are likely to lose everything if you decide to go physical

What did judgement says? To demolish the structure or just that he was the rightful owner?
How did he execute the judgments matters a lot. With whom did go there, with police and court officials or with thugs?

Why would he decide to lose his life over a piece of land provided by nature? That's madness! That land wasn't all he has got. And who even ultimately owns all the land in any state? No be state government again? With c of o, I'm sure there would still be clause that could be triggered to take the land from individuals

From my own point of view
The government should not behave this way.
Even if everyone in the country behaves like animals
The government should be sane.
The man should be arrested and charged to court

My point exactly.... govt shows by leadership and example that they can follow the rule of law even at the height of provocation.. not start doing their own version of jungle justice..
