The ICC does not work like that. You cannot get up and go there to file a case as cases can only be initiated at the behest of:

a. The office of the prosecutor
b. The UN Sec. Council
c. Request by a state party to the Rome Statute--this can be turned down

That is, private individuals are not granted audience at their own instance, though a person who may be a victim in a case may be allowed legal presentation as a corollary to that case.

I presume you are referencing Article 15(2)--(next time be specific), now what it says is that the Office of the Prosecutor may seek more information from some of the sources you mentioned, of which individuals are not included. Now this does not in any way amount to a case being instituted at the behest of an individual. Rather, what it means, is that should the OTP become interested in a situation, it may in its own initiative reach out to seek for more information. There is little parallel between this and what you have described which in any case, is also very different from what the news story describes--which categorically states that service will be made upon Nigeria by next week.


Take it or leave it, but individuals do not have any capacity to institute a case before the ICC. It's almost like you people don't learn. Every group one group or another is talking about taking Buratai to the ICC. What has come out of these?
