ANDREW91:And you take pleasure in lying. It wasn't 2011 but 2012 when he made that semantic statement of "dogs and baboons will be soaked in blood if what happened in 2011 repeat itself". He was referring to the technological rigging machine of PDP. Every right thinking Nigerians know how PDP have perfected the act of rigging and how the Supreme court of the land had in many instances acclaimed that the elections of 2007 and 2011 were flawed but still went ahead to upheld them. We all know that before now all elections are war that must be won by them at all cost. It was in 2007 during the presidential campaign in Ogun state that OBJ declared on a live broadcast that that year election was a do-or-die election and that was how it was. That was the only election that the supreme did declared that it never complied to the requirements of the electoral law but they still went ahead to declared a winner. It was also in 2011 that some states in south south recorded 90% of electoral votes in the history of Nigeria election. It was shocking that those states that have never recorded such feat in any election in Nigeria churn out such arbitrary figures and the supreme court went ahead to certified the election. That semantic words really helped, they would have churned out same figure but they were cautious. No single south south state recorded 60% electoral votes. Life is about cost and effect or action and reaction. When people reacted to an issue people will forget the action that preceded the reaction but focus on the reaction or effect. The why in it would not be mentioned. He did not wake up at the bad side of his bed to say "dogs and baboons will be soaked in blood" it was the cost he incurred during the 2011 general elections and in 2012 he bore his mind. Next time don't just quote negative words people said, also let them know what informed the negative words. |

JosephXavier: It is difficult to prosecute him base on those posts: The prosecution must proof three things: 1. He made the threat. 2. He intended on carrying it out or have the means to carry it out. 3. Items 1 & 2 above occurred concurrently. Someone asked, if you have a million dollar, what will you do? And he opened his mouth and starting talking…. We know he does not have a million dollars, so his response can be taken as an hyperbole. The prosecution botch this, they would have provided him with a million bucks and monitor him to see if he will start making plans to put his words into action. If someone have a gun and says…he will blow person A head off….that is a threat! But if someone say, if I win a million dollars, I will buy a gun and blow person A head off….it will be a difficult job to prosecute the second person, since the intent have not developed. |

The court does not prosecute. Furthermore, the court cannot take a position on any matter i.e. declaring a person guilty or not without the prosecution (in this case the government) bringing such a person PROPERLY before the court. There are laid down procedures for arraigning a person and initiating a suit from filing of processes and if not correctly done, the court will not entertain such a matter least of all pronounce any decision. If the litigants - prosecution and defence do not do their homework, the court will simply throw out (strike out) the case. For Kanu, if the prosecution (FG) successfully proves its case, the court will make its pronouncement of finding him guilty and sentence accordingly. Of course there is the right of appeal. On the other hand, if the defense team is able to rubbish the submissions of the FG, the court is bound to discharge and acquit him provided there is no political interference or deliberate ploy to keep him incarcerated as is usually the case once the FG (Buhari and minions) feels offended. The current case of this man that has been detained for 11 months is an obvious ploy of the FG to keep him in perpetual detention just because they have the power to and institutions are dead as usual. Otherwise the court should have made a consequential order immediately it struck out the case to have him released from detention but asking his lawyer to file a formal application is another delay tactic....
