Y’all act slow in this country that why the government take u for granted… For Yankee if police no get warrant even if na the IG of police u can’t go to peoples property but for here ordinary sergeant dey harass and arrest una for inside una bedroom self without warrant… Bruh rest abeg
Please you are still talking about people's personal houses and not community like setting. There hundreds if not thousands of houses in that estate with so many people living there. It doesn't fit the definition of private which I suppose you are trying to put across. Again, don't be emotional here, the statement by the estate leadership clearly insinuate the CP was to be hosted by a resident. However, the guards were not aware which to me is not a problem. The guards are there to thwart security threats to the residents, how is a CP who oversees the state security next to the governor a security threat? The residents will call the CP immediately in case of armed attack. The guards must have done something that a high ranking officer like that acted the way he did.

Again in the same Yankee, police stop cars which are personal properties and search them randomly why flashing only their IDs. High speed chase is even common there, sometime resulting to death. We hate the police here, they are not innocent but majority of the citizens are not any better.

No estate is a privately owned property

To start with, a) govt owns all land, b) govt using tax payers money provides some amenities, road, etc, c) police and any other govt agencies should have unhindered access to any where in a society in the course of their duty, for instance, building inspection, environment, etc, talkless the police

An estate claiming privacy is what led to people like Evans getting away with criminality for so long (interestingly in the same Magodo Estate) and the same Magodo harbours the largest number of yahooyahoo boys on the mainland!

Investigating a crime is even more important than arresting

Pls address your questions to the Nigerian police(Lagos Command, COP) go to court too together with the estate and seek redress.

Did u go to court before u made all the claims that u made? Did the CP send u to defend him before u did or are u simply saying that u can't answer the following questions:

Based on section 41 of the constitution so quoted, are u saying that any Nigerian walk into aso rock or the police headquarters in abuja quoting that law?

In Section 4(g), was the street in question open to the public? Also take note of the word "facilitate". Was the CP facilitating or carrying out this function as at the time he visited the estate?

When u say that by reason of "sections 18 1(b) and (C) of the Administration of Criminal Justice Law of Lagos, 2015 (as amended in 2021) a police officer is mandated to arrest a suspect who commits an offence in the officer's presence or [b] a person who obstructs the police officer why executing his duty without an arrest warrant, can u pls tell me the arrest the CP was effecting and the offence that was committed?

Is this a private estate ?
If so what makes the Police Commissioner think that he can not be stopped from entering the estate?
Does the CP live at the estate?
Does the CP have the right to enter someone's private estate without permission?
Can the CP enter my house without my permission?
I need answers to these questions immediately.

Obviously you don't know the law. Jurisdiction is defined and regulated by the constitution of the republic and the police is only an agency of the federal government.

According to the law. Police and other law enforcement agencies do not have the right to intrude into a citizens private property without invitation except when there is a search warrant, arrest warrant or when responding to crime/emergency situation. That illegality is normal does not make it legal.

Mr CP came for a party and wants to barge in like it's a secret mission, without the owner of the house knowing? The security were in good legal standing to question him. The only "crime" they committed is stopping a big man from behaving like a big man.

So the street in that particular estate is private property or is someones house?? Why was fashola pulling down estate gates back then?? Is cos of such issues..if nigeria wasnt lawless and insecure there shouldnt be a gate on any street.. your gate should only be in your house which makes it a private property..the street is government property.. your argument would only hold if those houses in that estate belongs to one resident..hence a permit will be granted to such person to make it a private property, but if there is public street leading to another street in that estate no one has a right to put a gate there..but insecurity has made what isnt normal become the norm..

This loose head has gone from bizarre owning of the street near his house to public owned space vs privately owned space dichotomy.

Let me make it easier for you, once a road is being shared by 2 or more seperate residences nobody owns the road, it belongs to all of us, the government.

It's obvious you lack proper education. Since you cannot even argue without vulgarity as a civilised human being.

Government owns al roads whether tarred or untarrred. The road doesn't make a place a publicly owned place. If government would build anything on your street, they'll have to buy land there. And that land on your street bought by government becomes a government property on that street.

We're talking about an Estate, this ignoramus is talking about a road. Please get out of here. You're not in my class to be mentioning. I don't argue with simps.

My point is, if we are arguing rights for the CP was the reason why he arrested the guards on his way in. What then was his reason to arrest the replacement guards on his way out if not that excess display of power and propensity to annihilate a perceived "insolent " person that persons in power display in this country. Just like the el zakzaky you referenced, was it really necessary to go to his place of worship and kill everything that moves and level the place, after dealing with his followers on the road, all because a general's convoy was blocked. Using a sledge hammer to kill a mosquito is not a demonstration of strength in my opinion

It's a 3rd world country. Stuff like that, are the norm. Expecting civilised behavior from members of the ruling class, is the aberration.

I'm not making excuses for him, but I can almost imagine the replacement guards being reluctant to allow him leave without releasing their arrested members. Pple like that, need little to no excuse. Someone that arrested a mother and her kids and you're acting shocked he's arresting replacement security men

In 1st world countries, such blatant disrespect for rights are not commonplace, though they happen.

It happening in a 3rd country shouldn't be a surprise.

It is wrong for those security men, to delay the CP for whatever reasons. Using the excuse of giving him directions is stupid, allow him go and at worst, send a detail to monitor him.

Let me quote your post but l will be speaking "generally"
I think we should explain things in our native language, maybe it will help all of us understand.
Most of you are "Reasoning without Context" of usage of the English phrase!
maybe they dont teach Grammar, Lexis and Structure anymore in our Schools otherwise, the kind of ignorance (no offense Sir) l am seeing on this thread, just to understand what "Private Property" means, is astonishing!

I have seen hundreds of Estate, outside this country, bult by private Developers, Fenced and Gated and despite paying Tax to Govt, it is stilla Private Estate.
There was one which a Phone Snatcher ran into and we reported it to the Police, by calling emergency Numbers.
The Police arrives and phoned the "Private Security" employed by the owners of the Estate, explained to them what their mission was and asked to be let-in (ordinarily, they cant refuse to let the Police in but as a matter of courtesy and respect for the rule of Law, the Police have to ask first!
It is only when they refuse to let them in, that the Police will now invoke their own Powers, under the Constitution, to legally perform their duty, by getting an instant warrant of entry over the phone (l am sure most Nigerians have not seen or heard of that one) and force their way in.
The fact that they have obtained (an emergency) warrant of entry, before pulling down the gates, means it is no longer a "forced entry" and the owners/private security of such Estate can even be sued for "Obstruction of Justice", preventing the Police from doing their work.

The Private Security Opened up, cooperated with the Police, gave CCTV footage and the thief (and those who housed him) were promptly fished out and arrested. The Police thanked the Private Security and left with the Accused persons.
That is how Private Security and Police synergize together, in an environment where everyone adheres to the Law, not in our own case where "Dont you know me and Bigmanism" is the order of the day.

A few things l noticed on that day was that:
- The Police who came were on official duty and so dressed.
- The mission was logged on the Police "Coordinating Software" and those who responded were responding to "a Call incident"
- Nothing was taken "Personal", it was all done Professionally and the Police were not trying to show Superiority (like we dont know who is superior!?)
- The Police did not barge in or shout at the private Security men nor Order them to Open the Gate. They explained and were let in as expected.
- Police does not see the Private Security guys as their inferior or enemy but as "Partners who assist them to fight Crime, doing the otherwise rudimentary Work that would have engaged Police time (it is only in Nigeria that the job of "State-trained' Policemen is to carry the Bag of the Wife of one Big Man grin or do the job of Gate Man!)
- The Police were thankful after the operation, were courteous all through and the privat Security did everything to assist them.
One may ask: Why all these Courtesy by the Police, despite their superior and legally backed activity? The answer is because they were trying to work in a Private Estate .. and there was a sign boldly anchored to the gate proclaiming: This is a Private Property Estate, Please Report to the Security Staff to gain Entry.
The Police knew what this meant and these were Canadian Police!

Now, in the case of Nigeria:
- CP was in Mufti, he was coming in on a Public Holiday, there was no prior distress call and so he was not responding to any Emergency!
- CP was was a Social Visit, to attend a Party. (In sane Climes, he wont even come with a barrage of escorts, just him or maybe one orderly but in Nigeria, everything is a "Power-Show"wink

- CP indicated he was going to see a resident of the Estate. For Security reasons, it is the duty of the "Gate Security" to contact the Resident first, inform them of the Visitor and ask if the Visitor is expected and should be allowed in! There are cases when you dont want a Visitor or the Visitor is coming -in, unannounced or even a danger to such resident, it is the duty of the gate Security to find out whether to allow the Visitor to visit the Resident, based on the express instruction of the Resident!

- this angered the CP because, as a "Big Man", he is above all those level and how dare ordinary Gate Security men, ask him to wait while they contact the resident or find out if the Resident should allow him inside! "Dont you know Who l am", is a very familiar phrase in Nigeria. grin
- And the CP showed his POWER! His abuse of State Power! Power that he may not have tomorrow, Power that should otherwise be deployed in arresting Bandits. But he chose to deploy such Powers against innocent, Private Security men, doing their job.
Such is the recklessness and impunity amongst we Nigerians. We abuse Power, from the very top to the agressive gateman.

Now, on the flip side, let us assume, without conceding, that the Security men were "Rude" to the C.P (you can define that Rudeness as: Sir, is the Resident expecting you? You will have to wait here while we contact the Person you came to see. Wait here Sir.
Yes, that is "rudeness" to any "big Man" in Nigeria, they cant wait, they dont obey Protocol, they dont follow rules, they are just too big to follow the rules they make. The Nigerian Big Man is just to be feared.. grin

And God help you if you allow the "Big Man" in a Nigerian, especially the one that has State Power, to show its face.
C.P bundled then into his Van and straight to illegal detention but of course, this is Nigeria, who will challenge the Power of a 'big man'?
This is "Rule of Power", not "Rule of Law"! Raw, naked Power!!
And he extended the "goodwill" of his Power to the substitutes that were brought-in, after he has left for his party. grin
Not minding that they have not done anything to him or even met him in Person, the fact that they did not all scamper to safety and as Fela Anikulapo Kuti will put it, "Everybody Scatter-Scatter and run, run-run", he also bundled them into the cell. illegally.

For the avoidance of doubt, "Private" means exactly that.. "Private", NOT GENERALLY OPEN TO THE PUBLIC.
Unlike a Public Street with individual Houses, the Occupants of a Private Estate have a Single Landlord of the fenced (enclosed) land Area (the original owner of the land, sold to individuals as land or as built houses).
The Occupants have a prior agreement in place, prior to occupancy, to come together as a Unit (Estate), to work together and have an MOU of Rules to guide them. In some cases, the Estate are Registered with the CAC.

But for a "Public" Area, everybody dpes as they like and there is no agreement to any rule, before occupancy.
For those who saying Govt owns the land and therefore, there is nothing like "Private Estate", l say you are very ignorant!
Even the salary you work for, your own money, you still have to pay Income tax on it but what is left of such income, is your money, your PRIVATE Money, to spend as you deem fit.
Payment of Land use Tax is legal but doe snot vitiate the Rights of the owner of the land, within the ambit of the law.

The Constitution of Nigeria also allows ownership of Property Privately. It is there in the Constitution of Nigeria: the right to OWN Property.
So, whatever you OWN, is "private" to you and you can extend such ownership to others, at your pleasure, within the ambit of the law.

In the academics, their is a branch of Law called "Private Property Law", to distinguish it from public Property Laws.

C.P is the typical Nigerian and we can see some Nigerians (if not most), clapping for him, for "Exercising Power" to the maximum.
Abuse of Power, is not the same thing as Exercising conferred Authority. This is the simple knowledge that most people are lacking.
Power conferred by virtue of the Position you occupy is service to the Public, is to be used with discretion and not to be abused.
Such Power is not meant to be used to intimidate the Citizens or harass them or abuse them , it is to be used to protect and serve them.
The C.P. if the account we hear is true, has erred, he should apologise or be repremanded.

Because we have allowed impunity to reign for so long, Nigeria has become a terrible place for the sane to live and we can all see the impact, in our daily lives. When was the last time that you heard that a Police Officer followed a citizen tot he ATM at gun point, just to extort him, in those sane countries? But it has become "normalised" in Nigeria.

Just as some are normalising the CP's abuse of Power, despite their ignorance of what "Private Porperty" entails.

Thank you for reading, please disagree, it is your right to do so.

People get overly emotional and even hypocritical over this issue because a police officer is involved.

1. The Commissioner of Police Odumosu didn't need to give advance information of his coming to the Estate security men because it would be stupid to for him state his movement. Of course, giving such information would require the CP's security details to secure the Estate gate security until he arrives.

2. On arrival at the Estate gate and having PROPERLY identified himself as CP of Lagos State, he ought to have been allowed in immediately. Keeping him at the gate is unnecessarily exposing him to possible attack by criminals. Even a military formation would know better than keep a properly identified CP exposed to danger at its entry point.

3. CP Odumosu didn't need to tell the Estate security men the exact house he was going to before being allowed in. That's a classified information until his details secures the house for his safety.

4. Deliberately tagging the CP's visit as social to denigrate him is pure IGNORANCE because even a 'common' DPO is always listening to his radio equipment and giving directives anywhere he is. The fact is that when not on official leave, a CP is at work everywhere and every time.

5. I doubt if the police singled out that widow for arrest for nothing. She may have jumped into the matter and said unsavoury things. Being a resident in an Estate, I am familiar with some 'radical' busybody residents that would jump into issues without complete knowledge.

6. This is not the first gated estate that the CP has had cause to visit in Lagos. The truth is this incident was avoidable if only the Estate security was more professional and less power-conscious. Their unprofessional attitude activated power-tussle mode in the OFFICIAL state police force to show their constitutional superiority. The irony in this drama is that when armed criminals show up at the Estate, it is the official state police men that are called in to risk their lives.

7. By the way, is an estate which has individually-owned houses a private property or a community? If Magodo Brooks is NOT owned and rented out by one person as its private owner, is there any difference between this Estate and for example Ajegunle in the eyes of the law?

8. Yes, Nigeria police has many outright criminals as members but it is still the only one we have to enforce law and order and maintain security.

QED.

This idiot keeps exposing his ignorance, does not know that all lands belong to government, you are only an occupant. Land in Nigeria is never bought or sold, talkless of government buying land. No slowpoke, if Government wants to put something near a public street near you, they will revoke your occupancy and compensate you for loss of building and economic value, not land.

What you are trading is occupancy.
Nobody occupies a public road, wheather in an estate or not.
For those of you still arguing about magodo being a private estate, simple answer is that it is not. The residents bought their plots individually from Lagos State Govt. None of them bought the roads nor were the roads ever up for sale.

In case you are still lost, While you are talking of an estate, the police is talking about public road running through your estate. Get a grip. Maybe I should repeat slowly so you can understand.

Thank you very much.

He over reacted too.

Personally, I believe when you start a fight with a knife, don't act victimized or shocked when your victim pulls out a gun! You don't get to dictate

Bro, u didn't answer my questions:

How and why is it wrong for "mere security men/protesters to delay the head of a law enforcement agency for whatever reasons" in a 3rd world country?

Why are the security men "mere security men"?

Based on what u said above, is it therefore right for "mere security men/protesters to delay the head of a law enforcement agency for whatever reasons" in a first world country?

What is more embarrassing than for ordinary security guard who is not even qualified to clean CP shoes to keep him waiting at that gate in the name of trying to confirm which apartment he was heading to. Did CP tell them he missed his way.

You still haven't said what is wrong in delaying the CP. What makes the security guard "ordinary"? Can u pls tell us who is qualified to clean the CPs shoes and what that qualification might be? How does asking the CP to wait while they confirm where he is going to a crime as far as the statute books of Nigeria is concerned?

No estate is a privately owned property

To start with, a) govt owns all land, b) govt using tax payers money provides some amenities, road, etc, c) police and any other govt agencies should have unhindered access to any where in a society in the course of their duty, for instance, building inspection, environment, etc, talkless the police

An estate claiming privacy is what led to people like Evans getting away with criminality for so long (interestingly in the same Magodo Estate) and the same Magodo harbours the largest number of yahooyahoo boys on the mainland!

Investigating a crime is even more important than arresting

If u say no estate is privately owned property, then what are they?

How does govt own all land? What crime was the CP investigating as at the time he arrived at the estate? What law gives the govt agencies u referenced to d right to "have unhindered access to ANYWHERE in society"? Take note of the capitalised word

You sef think am na. The official head of policing in lagos state, is being questioned by civilian/private security operatives?! What so difficult to understand about that?

No where in the world is that acceptable! 1st world or 5th world

Johnbull, you are one of the people with common sense in this place. You are truly my son!! grin cool

The Nigerian Big Man is just to be feared.. grin
