I'm going to be as explicit as possible and I need professional legal counsel/inputs to the issue stated below. (Pardon all blunders biko)

My wife recently got fed up with her place of work and decided to tender her resignation letter. She happens to be in the teaching profession and we all know what goes on in the private teaching schools (Most anyways).

On Friday the 4th of March which was supposed to be her final day at the school, the school's HM instructed her phone to put her phone on her desk (HM's) on the pretense that it was an open day and didn't want her distracted. She did exactly that and the day went just fine, after which, she dropped all the school's materials/properties with her and left.
On getting home, she went through her phone and discovered that her WhatsApp messages and conversations had been deleted, text messages deleted, all her contacts deleted, and all chats on her phone read. As if that wasn't enough, a few of her contacts called her to tell her they received messages from the school asking what her relationship was with them? Imagine!!!

Moreover, I think it is also good I state the fact that she and the HM haven't been best of friends due to an event that happened sometimes back between both parties. But for her to pick up her phone and go through it, and not just that, but also deleting her chats and wiping off contacts, deleting photos that has to do with the school, that's to the extreme haba!!!

Is there any legal ground to pursue this case or is it me just being emotional hurt that my wife's privacy has been trampled upon and I need to act. What should be my next point of action?

What do you hope to achieve?
To get the lost information back or to extort the school?

Now, nowhere in your story did you mention that your wife saw someone operating her device thereby breaching her privacy, technically that puts you on a lower ground legally because it's all assumptions.

Phones can factory reset themselves when the limit of wrong password input has been reached.
It could be this.

But,

You have evidence of messages that didn't originate from her to her contacts. But that is no proof either.
A good lawyer could pin those messages on your wife, claiming they were sent by her with a malicious intent to blackmail the school or that she has a dissociative indentity disorder which would further cast aspersions on her sanity as well as her credibility.

So,

As long as your wife does not have nudes of you or herself on the phone or any other incriminating file, you should not be bothered.

If she does have nudes or other vital information she wants back, I could help you retrieve those lost information.

But,

By default, I do not trust women.
I'd advice you not to.
Do not excavate a graveyard except you are hunting for skeletons.

Apparently, your wife is a threat to the HM who does not want her taking advantage of connections she garnered in the course of working for her.

The proprietress found out she was was sharing his preek with the same people she was paying salaries and it brought about squabbles amongst the teachers and most of them just like your wife, tendered resignation letters but never told their husbands the true reason behind their leaving.

Those husbands till today see their wives as victims of unjust treatment in the school they served in not knowing that they, the husbands, are the actual victims.

If the contacts were deleted, it may not mean much but sending messages to my contacts to know my relationship with them is a red line my friend . Report to this court funmi in lagos or go to any court and make a criminal case or direct court complain and see how the hopeless person will rot in jail.

Stop glorifying these bandits called proprietor or proprietress of a thing. They are modern slave traders.

So her phone is not password ? Abeg forget all those talk. The man or HM will only be selective when deleting messages that and phone number. Maybe your wife have something that she don’t want you to know. She can never leave her phone without lock on his desk like that as a woman for that matter. They are more secretive in all their doings. If people and witness confirm that he really called them on phone to know about their relationship, then you can sue the hm for that.

You are trying to sound clever but you came across as clever by half. The phone that called her wife's contacts can easily be identified as coming from someone from the School.

Or will your clever Lawyer also argue that an unknown phone made the calls because of factory reset?

The husband should first confront the HM of the school (and record their conversation) before suing.

You have the right to sue but the challenge is evidence. She could deny that she is not the one who deleted the messages and contacts. She was not caught red handed.

If you can Sue , it will most likely be based on the principle of “Unity of Spouses “. And that will only apply if you guys got married under Common Law, ( Court wedding).

If you have only done traditional marriage, (native law and custom) , then it would depend on whether the action is contrary and repugnant to natural law and justice.

White wedding is a Christian thing , with no real basis in Common Law, so no real grounds for suing.

Now you have given OP reasons to sue.

Reminds me how some female Teachers in my Childrens' former school were extremely playful and superbly nice to me, tried to flirt with me using romantic gestures a couple of times, especially when I came to pick the Children alone. Including some Wives and Single Moms of other pupils.
Omoh, it became too much that I had to change their school without informing Wifey my true reason.

Let her be sure of the time in between the phone was collected and the time the messages were sent to her contacts and also know the assignment she was given at that point in time. That's enough alibi and evidence. Cross examination will do the rest. She will surely fall because of hatred. Who knows others might come out as witness against her

If we all start viewing things like, we'll never be able to address any issue in our lives.

As a warrior that i have always been, i'll immediately start by forwarding a petition via my lawyers to the State CID, putting more allegations on her head, getting her arrested and while other things come later.

You can sue the hm for privacy violation ....there is an evidence since u said your wife contacts get messages from the hm about there relationship with her..all you will do is to call those ppl ,meet ith them and ask Dem not to delete the message on there fone for evidence and also make sure you try call the number to be sure it is d hm dat owns d fone. Act as if you wanna apply your wards into the school and get more info from dere but make sure when calling you record the calls for evidence proofs...he /she needs to go to jail so as to reach other school owners dat spoils image of someone who wanna quit the school for another or greener pastures...

But I think he should just let it go.
I started litigation with hard evidence 7 years ago, Its only ending of last year we completed trial. Even the sum I sued for is rather not worth it anymore as naira has lost value over the years. As at when I sued ₦1.5m was equivalent to $10,000.
Now ₦5.8m is same $10k!

Aside the Lump sum I paid lawyers, aside the agreement on percentage on winning litigation, I have spent atleast 1.5m on lawyer appearance "otaining", fuel, my time, stress etc.

Yes it's worth it. It will not only serve as a deterrent to others it will give the person's business the right name it deserves. Most private business owners are just simply wicked, unappreciative and barbaric. Let her start with criminal case and end it with a civil case or better let her take her to human right where she will be disgraced publicly cos I know she will prove stubborn.

Why should you drag Nurses into your contribution. It makes your whole point senseless.

To get the lost information back or to extort the school?

Now, nowhere in your story did you mention that your wife saw someone operating her device thereby breaching her privacy, technically that puts you on a lower ground legally because it's all assumptions.

Phones can factory reset themselves when the limit of wrong password input has been reached.
It could be this.

But,

You have evidence of messages that didn't originate from her to her contacts. But that is no proof either.
A good lawyer could pin those messages on your wife, claiming they were sent by her with a malicious intent to blackmail the school or that she has a dissociative indentity disorder which would further cast aspersions on her sanity as well as her credibility.

So,

As long as your wife does not have nudes of you or herself on the phone or any other incriminating file, you should not be bothered.

If she does have nudes or other vital information she wants back, I could help you retrieve those lost information.

But,

By default, I do not trust women.
I'd advice you not to.
Do not excavate a graveyard except you are hunting for skeletons.

Apparently, your wife is a threat to the HM who does not want her taking advantage of connections she garnered in the course of working for her.

Just let sleeping dogs lie.
So you do not go and find out that the preek of a rich parent is the reason behind your wife and her HMs' squabbles.

I'm not saying that teachers are as wayward as nurses, I'm just saying I know someone who is a big benefactor in his kids' school; the story of his goodwill and philanthropy brought the Proprietress and most of his kids' teachers to his bed.

The proprietress found out she was was sharing his preek with the same people she was paying salaries and it brought about squabbles amongst the teachers and most of them just like your wife, tendered resignation letters but never told their husbands the true reason behind their leaving.

Those husbands till today see their wives as victims of unjust treatment in the school they served in not knowing that they, the husbands, are the actual victims.

Unfortunately, you do not seem to have sufficient proof that she may have deleted anything. If they have a CCTV, the school may be compelled to provide footage from when the messages were sent to confirm she was with the phone. Me, I personally suggest extrajudicial punishment. Find her, BEAT her, then delete everything on her phone...even her emails

You can sue if you what your wife told is true and you have a substantial evidence to show same. You need to track the time when those files were deleted, if it falls within the time when the phone was in the HM custody then there is reasonable ground to believe he deleted or caused the files to be deleted. You can sue the school and HM.
