What is your problem with sani bello leadership? Is buni own unquestionable? From the evidence, inec are rejecting the invite to the NEC meeting and nothing more
bring the questionability of buni leadership?

Inec recognize him, the law recognize him

Bello wasn't handed to properly

It is not in the place of inec to question leadership but to monitor or observe conventions and congresses
it is the place of INEC to question a leadership that deals with it

To deal with it you need to follow laid down rules incorporating them that you are the new Sherrif

After monitoring whoemever wins....his name is submitted then INEC begins to deal with that person. When that person is unavailable will INEC not seek clarification?

When correspondences are passed, the Chairman and/or Secretary are those who are in communication with INEC.

Anybody with a letter-headed paper can write to INEC telling them he is whatever, do you expect INEC to just start communicating with the person?

If Buni was travelling and indeed officially handed over to Bello, if he submits same...I don't think INEC will reject it. But there was nothing to back Bello's notion as Ag Chairman.

No letter from any meeting indicating change of baton, no notice of meeting, no minutes, no Secretary.

What about the Secretary, did he travel as well? In what meeting was he removed or did he resign?

In the case of Oshiomhole & Giadom, there was a Court order.

So, INEC is generally seeking clarification. The new Electoral Act, Section 83(2).

S83(1): The Commission shall keep records of the activities of all the registered political parties.

I totally agree but you are only wrong when you said it is notice or letter that inec need in the monitoring

INEC need to be physically present in such decision meeting, the constitution grouped such meeting in the same capacity as convention and congress

In convention and congress inec are physically present to observe

While inec sources was interviewed here is what they said below

Governor Bello’s letter, according to a source at INEC, remains strange AS THERE WAS NO TIME THE COMMISSION WAS INVITED TO OBSERVE OR MONITOR ANY MEETING WHERE THE CHANGES TOOK PLACE, hence, the letter was not honoured.

Section 82(1) of the new Electoral Act 2022:
Every registered Political Party shall give the Commission at least 21 days' notice of any Convention, Congress, Conference or meeting convened for the purpose of "merger" and electing members of its executive committees, other governing bodies or nominating candidates for any of the elective offices specified under this Act.

It is not new...It was just taken wholly from Section 85(1-2) of the Electoral Act 2010.

It is a practice that has long been done. Whenever there is a NWC or NEC meeting of political parties, INEC is informed or invited.
INEC cannot monitor meetings that don't involve mergers, election of members or nomination of candidates but they are in the know for record purposes. These meetings must have an agenda.

What INEC is saying is that: There was no notice or invitation of meetings wherein Buni & Akpan Udo-Edehe were removed or resigned. There is also no Court Order.

Election only takes place at Congresses or Convention that is why the Electoral Act 2022 grouped Section 82 as "Notice of Convention and Congress."

They were informed before the NEC meeting that produced Buni....they also need to be informed of the meeting wherein Bello came to be.

Let us assume the National Chairman of a Political Party dies or resigns, what happens? There will be a NWC meeting, wherein someone will be called up in Acting Capacity. It is not an election.

Did you read where the portion of the law says, "--- in any meeting" Any meeting that a major decision is going to be made INEC must be invited. You guys like interpreting laws to suit your purpose, same way they did and lose all positions in Zamfara and Rivers State. Common obedient to the rule of law becomes a difficult mountain to climb for you politicians but always looking for shortcuts.
Indispensable85:

Your problem is comprehension. Buni didn't need the permission of INEC to delegate power to Bello. His position is not substantive but acting in the absence of Buni.

The NEC meeting is not for nominating executives so INEC is not needed neither were they supposed to be notified abinitio.

I am not arguing that they failed the 21days dead line

My point is even if buni wrote a notice letter to inec saying he has handed power to bello it still would be illegal without a meeting inec attends to that effect, signature letters can be forged by anyone intimating change of guard

The section 82 (2-3) says INEC must be involved in meeting.

"Notice" is one thing, "involve" physically is another, from below screenshot Bello wrote a letter "notifying" inec of a NEC meeting and inviting them to be "involved" (attend) even when it was a meeting that didn't have anything to do with the major decision of choosing new NEC

Inec reacted the notice wasn't even signed by the right people and so can't be "involved" attend the meeting

Is English language so difficult for you?
In any meeting where exco members will be elected, congress , governing board. If any of these three things are not the reasons for the NEC meeting INEC has no business there.
