Secondly: this case was just filed a few days ago, how did they get speedy judgement on it, yet the tax case btw states and FG dragged for a long time, Nigeria has never had it this bad in law, what Malami just did does not hold waters, the supreme court will throw it out(except the supreme court is compromised)...

Malami has turned to a lawmaker...


I have been getting mentions from people supporting Malami, please read this before you quote me

To delete something means to make change and not interpret, to interpret is to explain for better understanding, that is not what happened here, deleting is to remove something which was legislated upon in the constitution, no court not even the supreme court has the power to delete any part of the constitution made by the legislative arm, if they can add or remove any part of the constitution then they have made themselves law makers too, which is not under their jurisdiction.

That is why till today no region can sue the FG to court asking for a referendum because the constitution does not support it, no court can add it, only the law makers can do that, so please know what you are saying, what happened here is judicial rascality...

This is deletion, deleting it from the constitution is a different thing, deleting means to remove, that is amendment, who amends the law, the legislative arm or the judiciary...

The deletion is in order with the constitution. The deleted law was against the rights of political appointees to participate in congress or convention which is illegal.

Let's look beyond who it favours.

In the constitution there is right to life.. If the law makers amend the law and put a clause or phrase that tramples on your right to life.. That controversial law is subject to interpretation and then the interpretation of the judiciary becomes the law. That is what it is and that interpretation is executed by the executive. Do you understand it now... Now apply it to what u read up there.. If u can't still understand it sorry I can't be of further help..

The lawmakers made a law that states that political appointees have to resign to contest for any elective position, how is that constitutional rights infringement , it's like you saying that saying the IG of police can retain his position as IG and at the same time contest for an elective position while holding his appointment as an IG, are they not all federal government workers and appointees, the lawmakers are only expanding it to all government appointees, how is that infringement, you guys just keep supporting evil...

Why wouldn't Malami quickly effect it. Hope you remember that after Buhari signed the amendment electoral acts into law and had passed it to the National Assembly, that was when Malami now remember that they should have deleted section 84(2) of the electoral act that says if you are having a political position and you need to contest for another post, you should resign first....he quickly recalled the electoral act for another amendment but the National Assembly refused to send it to Buhari.....so the devil of a man called Malami that controls the stupid idiot of an illiterate president now perfect another way which was bribing a judge from the south to enact a suit to delete the act which if not that Malami's interest and some other stupid politicians fate that are heading a post now but still want to come as a Senator or any other post in the next election is finally sealed and guaranteed to contest without resigning. SO Malami wins at the long run. This man is just a shrewd criminal.....

Bros, I know say you no like am. NASS was self-serving in adding that clause. When Buhari returned the bill to them, all what was requested was for them to delete the controversial direct primaries clause. Instead of just doing that they forayed into an area that clashes with constitution. That said, the judge did nothing that requires NJC pinishment. The Nigeria Constitution is SUPREME, any law that directly or indirectly changes the constitutional provision is inferior. At Gazette, such section or sub-section is only included or mentioned like, Section 8(c) DELETED. This is what Malami is doing. The gazetted law will be made available first thing Monday and nothing anyone can do. That clause was never necessary, but some fools thought they were wiser.
If NASS want to amend the constitution, that is different, not smuggling inferior clauses here and there.

It's one thing to declare the law null and void its another to delete. The judiciary cannot amend law.

This case will probably be exhausted up and until the supreme court. Malami sneakign a kangaroo judgement on friday isn't going to help him.

I maintain that nobody's rights were violated by that law. It is simply an appendix to the terms of appointment of political appointees.

If this thing scales through, then be prepared for employees in the private sectors, militray and police to go ahead and contest for political officer because of the constitution.

Simple.

Then it shows you are not an educated man and we wasted money trying to educate you. The constitution is the fundamental law and any law that is contrary to the constitution is illegal. Sharia law is recognized in the constitution, the same way traditional law (polygamy) is recognized In the constitution again showing you are only half educated.

The Nigerian law recognizes 3 legal systems, the white mans law under which most of us operate, traditional law and sharia law. You cannot marry 2 wives in court under the white man’s law but you can under sharia or traditional law. You cannot marry an under age in court but you can under sharia or traditional law. It is legal!

What you have exposed is your ignorance!
