Supreme Court rules on Adeleke’s application

The Supreme Court has validated the judgement of the Court of Appeal which earlier struck out a motion challenging the educational qualifications of Osun State politician, Ademola Adeleke.

The court in a decision on Thursday agreed with an earlier ruling of the appeal court that the application was brought ‘outside of time’ at a High Court of the Federal Capital Territory where a decision was made nullifying Mr Adeleke’s candidacy in the Osun Governorship polls.

Mr Adeleke’s lawyer, Niyi Owolade, confirmed the development in a telephone interview with PREMIUM TIMES on Friday night.

According to the lawyer, the apex court agreed with the Peoples Democratic Party and Mr Adeleke that the High Court’s decision on the matter was a nullity.

Background
Following an application by two members of the All Progressives Congress, Wahab Raheem and Adam Habeeb, at a High Court of the FCT, the judge, Othman Musa, decided that Mr Adeleke did not qualify to take part in the governorship elections on the ground that he had failed to obtain a secondary school degree.

Dissatisfied, Mr Adeleke approached the Court of Appeal with a number of objections including the timing of the matter at the lower court.

Mr Adeleke, through his lawyer, Mr Owolade, argued that the case involved a pre-election matter and the APC members approached the lower court rather late, making it impossible for the high court to exercise jurisdiction on the issue.

In a decision in May, the Court of Appeal agreed with the PDP that the application involved a pre-election matter which ought to have been filed within 14 days from the date of the course of action.

What majority of APC members and their Party agents at the Unit level don't know according to the newly amended electoral law 2022 is that:

Any result signed and uploaded to the INEC Server in presence of Party agent, and later challenge at Tribunal for mis-conduct, such Party agent shall be Sentence to Jail of 3 - 5years with no fine options.

With this, my questions are:

1. Is Governor Oyetola want to send some of his Party members who serve as Party agent for his election to Jail or he don't know what electoral law says on it?

2. Does there Party agent knows that they are represeting there the image of there Party and there Party Candidate at there various Unit?

This Petition is already died before the arrival.

This will also be thrown out on technical grounds. It is a pre-election matter that should have emanated before the election.
The case is supposed to be handled by the FHC and not a tribunal.
A tribunal is a Special Court that only looks at what happened on the day of election to the declaration of results. Anything before or after is not within its jurisdiction.
This lacks merit and will be dismissed for sure.

749 PUs he spoke about will be reviewed, but Oyetola has a bad case here....

#OSUN: THE MAGIC THAT ENDS APC

All along, the APC form top to bottom is known for electoral fraud. The party can never in any part of the country win credibly without perpetrating evil. In the build up to the last Osun guber held on 16th July, the leadership of the party was boasting, fuming muscle that the election was already a walk over for them even before the election.

The election was free, fair and credible. The electoral umpire declared the PDP and her candidate, Senator Ademola Jackson Nurudeen Adeleke as the winner of the election. The whole Osun as a State was happy, there was jubilation at every nook and cranny of the State. The electoral observers across board commended the INEC, the security agencies for the job well done.

Congratulatory messages began to flow from every where to the Governor-elect, and to the PDP. Even though the outgoing defeated governor refused to congratulate the winner but nobody cares about him. The APC/Oyetola began the process of filing petitions to the tribunal and 1240 pages petition was finally submitted yesterday where the APC praying to court to nullify invalidate results of 749 pooling units spread across 10 LGs where the PDP won premise on over voting.

Several reactions have so far begun to generate as people believe with the use of BVAS machine used for the election, there can't be anywhere over voting would have been possible. However, the party agents in those units were there present on the day and signed after the election, and there was no news of challenge or uproar at the collation centres across board. The question bothering mind now is "how did the APC come about the thought of cancelling the results of the 749 polling units which her petition is premised on"?.

In the petition as well, Governor Oyetola claims the winner, Governor-elect Senator Ademola Adeleke submitted a forged certificate to the INEC to participate in the election. What a talk, what a ruse. The defeated governor Oyetola forgot to realize this is 2022, not 2018. He fails to realize that the earlier he comes out of his cubicle of defeat where he's hiding, the better.

As a political analyst, I understand the fact that the defeated outgoing governor knows there are still elections coming up next year February, especially that of the presidential where his uncle who imposed him on Osun in 2018 is the presidential candidate of the failed APC. He and his co-travellers are trying applying the tribunal tactic to hold and pin down the gullible membership of the party to gamer votes next year. Lolz

The fact remains the good people of Osun had spoken though ballot on July 16, and there's nothing anybody born of woman can do to steal their mandate this time around like that of 2018. The good people of Osun won't be friendly with anyone who tries nonsense this time around in the mandate joyfully jointly given to the Governor-elect and the PDP.

The magic that broke the backbone of the defeated governor and his disjointed, scattered broom APC is the newly signed electoral act, and the BVAS machine which to a reasonable extent curb electoral fraud during elections. As of now I'm sure the leadership of the APC will be seriously frowned at Buhari for signing the electoral act. The leadership of the APC if allowed will not he happy seeing the INEC talking of using the magical BVAS machine for the future elections again.

As far as Osun State is concerned, APC has lule, and may we never hear anything called APC again till thy kingdom come. The outgoing and defeated governor should realize every kobo spent during his reign would be accounted for by the time we assume office come November by God's grace.

he will never do that. That’s how APC were formed. Blowing lies and propaganda in order to paint the other parties bad. This time around their cases in all the court of justice doesn’t hold any water. Instead of him to restrategised and restructured APC in Osun State more, Oyetola keep on destroying Osun State APC beyond repair. Not only that, APC keep on falling apart by the day. By November 27th, 2022, he will have been ex governor of Osun State and the disgrace will be more much on all of them. Besides, Tinubu will be further disgrace and shamed in the poll in February 25th, 2023. The disgrace will start from Osun State in February 25th, 2023. There wrong with Oyetola going to court if he feels aggrieved. It is the right thing to do in a democracy. The tribunal was set up to listen to aggrieved parties like him.

Hopefully, the tribunal will review all evidences presented by all parties to the case and ensure that justice is done at the end of the day.

Eh please calm down and read.
Nowhere was it stated by the court that his certificate is not forged. If such pronouncement is missing then I will be less pompous if I am in your shoes here sounding like the Judge.
I am aware that he has a forgery case but I will be disappointed if it is that same controversial certificate he submitted again.
Read the court judgement slowly and go read that of Bayelsa. Sen. Adeleke may be in trouble actually.
