Based on the interpretation of Section 133(b) of the 1999 Constitution as amended, a presidential candidate cannot be declared the winner of the presidential election if he or she fails to win the Federal Capital Territory (FCT). The section requires that a presidential candidate must have not less than one-quarter of the votes cast at the election in each of at least two-thirds of all states in the Federation and the Federal Capital Territory, Abuja. The word "and" in the section is interpreted as conjunctive, meaning that it requires the fulfillment of all the conditions that it joins together. Therefore, winning the FCT is a necessary requirement for a presidential candidate to be declared the winner of the election. The FCT is considered a state under Section 299 of the 1999 Constitution as amended, and the provisions of the Constitution apply to it as if it were one of the states of the Federation. Therefore, winning the FCT is essential for a presidential candidate to meet the constitutional requirements for the office of the president. If a presidential candidate fails to win the FCT, the only available path for the Independent National Electoral Commission (INEC) is to call for a fresh nomination, according to Section 133(b) of the Constitution. |

I'm not interested in those below-standard elections but the SAN or the reporter are labouring 'disjunctively'. The conjunction 'and' simply means 'plus'. If Abuja is treated as a state then we have 36 states plus one state = 37 states. Did Tinubu lawfully get the required ¼ of votes lawfully cast and lawfully recorded in ⅔ of the 37 states? That is what should be taken to court, please. |

The first person to have started breaking electoral laws was buhari when he showed publicly his vote what then do you now expect? make we forget Nigeria matter. Abi is it not the same electoral laws that states that for a candidate to be declared winner he must have won 2/3 of the vote cast across the 36 states and 25% in the fct what then happens to winning 25% in FCT 1 Like |
