Accordingly, while we can all empathize with the effects of purportedly bad policies, the law courts (including the Supreme Court) are neither empowered nor equipped to determine which policies of the executive branch are substantively ‘good’ or ‘bad’. You have not answered the question thrown at you. Court is to interpret laws enacted by the National Assembly. They are not to make law or add arbitrarily to it.
The case brought to it was mopping of the old notes from the circulation by some governors on the order of the president which does not go well with the citizens within their jurisdiction because it heaps untold hardship on them. That the time frame was too short and they even claimed they are not against the policy but they are against the timing.
But as the supreme court delivered the judgement. It chided the president for breaching the law that the president needed to have consulted the council of states before giving such directive but surprisingly instead of the supreme court to dwell on the merit of the case brought before it, it went doing the work of president, CBN and council of states altogether by setting date when the old money would not be legal tender in Nigeria. That is on it own affront to the law. The supreme court should have just voided the directive of Mr. President and ask the parties involved to follow the rules of law than acting as the CBN, president and council of states in such manner. Nigeria is not a banana republic. Rule of law must reign supreme. Supreme court cannot be the alpha and Omega of everything. They can only be the alpha and Omega of interpretation of laws but not other aspect of governance.
On the withdrawal limit, supreme court should have also go ahead and place a limit to the amount that can be withdrew since its placed date when the old notes will not be legal tender. Why saying it was against the law to place limit on the amount customers can withdraw and not go further to give limit for withdrawal. And the funny thing is that they did not quote a single law to back up their claim.
We need be very careful in this country the type of power we are given supreme court justices, hence they will turn this country upside down. Same way someone that doesn't obtained form for senatorial seat was declared as the winner of a primary he never partook.

Nothing concerns CBN and court rulings. CBN is independent of them all except the President in some certain matters. Nothing wey court go do cbn governor!

The Supreme court is not challenging the powers of CBN to create and drive monetary policies.
Please understand that even with the powers CBN has, there are certain monetary policies that the Apex bank cannot take unilaterally without proper consultation with key stakeholders and economic decision makers in the country.
The Supreme court is faulting the recklessness of implementation in that the CBN did not even consult the Council of state, Federal executive Council, National Economic Council e.t.c.

The CBN governor went straight to the President who demonstrated ignorance by signing the policy without demanding that the CBN carry out the necessary consultations.

Hence, the court rebuked Buhari for acting ultra vires and as a DICTATOR. This recklessness on the part of CBN and Buhari created aggrieved parties and represents a breach of fundamental human rights.
That is why the Supreme court insisted that they have a right to hear the case because if the powers you have infringes on human rights and creates aggrieved parties then the court can hear the matter. After all, every power, even the powers of CBN and the President is derived from the Law.

The greatest challenge of this naira scarcity is movement from place to place. I believe only those who have cars are the only ones not complaining because they can buy fuel with credit card.

But you can't pay for transport with cards.

And when you do not have physical cash, you movement is restricted.

Don't think about yourself only. So many are not having it funny.

It is a wicked and useless policy.

You said he did not quote any law. You probably read extracts of newspaper reports. He quoted the Federal Constitution but let's even stay with the Banking Act

20.-(1) The currency notes issued by the Bank shall be legal tender in Nigeria at their face value for the payment of any amount.
(2) The coins issued by the Bank shall, if such coins have not been tampered with, be legal tender in Nigeria at their face value up to such amount or amounts as may be determined, from time to time, by the Bank.
(3) Notwithstanding Sub-sections (1) and (2) of this section, the Bank shall have power, if directed to do so by the President and after giving reasonable notice in that behalf, to call in any of its notes or coins on payment of the face value thereof [/b]and any note or coin with respect to which a notice has been given under this Sub-section, shall, on the expiration of the notice, cease to be legal tender, but, subject to section 22 of this Act, [b]shall be redeemed by the Bank upon demand.”


I have bolded the necessary sections.

The court held notice given was not reasonable because in a federation, the constituent states must be consulted

The court held the withdrawn notes should under the Banking Act be redeemable on demand which was not the case.

I am surprised to hear anyone who is not a fascist talk about the powers of the supreme court bring used recklessly when in fact it is a trite saying that a court is the last hope of the common man. If a President has a numerical majority in the house and states - how else can he be checked. Is it the legislature who are beholden to him? Can the minority check him? Can his fellow executives check him?

It is curious to hear buhari being given these extensive powers by people who were in opposition to him. Even if such people believed that the cash crisis would favour them, this has been proved patently wrong.

I can only surmise that it is a case of whatever my opponent is against I must be for even if it makes no sense.

It would be funny to see what would happen were BAT to begin exercising actions which are ultra vires the President while holding a clear majority in both houses.

Any nation is only a step away from becoming a dictatorship where it does not have strong independent judiciary.

Political affiliations has beclouded your sense of judgment. CBN Acts is subject to the Supreme Court scrutiny. In fact every Act or law establishing all agencies of government are to be interpreted by the court.
