Also section 299 of the constitution has said the FCT should be treated as a state.

(a) all the legislative powers, the executive powers and the judicial powers vested in the House of Assembly, the Governor of a State and in the courts of a State shall, respectively, vest in the National Assembly, the President of the Federation and in the courts which by virtue of the foregoing provisions are courts established for the Federal Capital Territory, Abuja;

(b) all the powers referred to in paragraph (a) of this section shall be exercised in accordance with the provisions of this Constitution; and

(c) the provisions of this Constitution pertaining to the matters aforesaid shall be read with such modifications and adaptations as may be reasonably necessary to bring them into conformity with the provisions of this section.

The supreme court need to deliver a landmark judgement to put to bed this issue to forestall future argument that may spring up in subsequent elections.

When did khadaria become a constitutional lawyer? I keep saying section 42(1)b rubbishes the idea that FCT residents have any special vote. It clearly states you cannot enact or implement any law that gives residents of any community privilege or disadvantage over others.

If I know I can’t win the election but I am stupendously rich and have access to violence, all I need to be a spoiler is to focus on bribing the voters of Abuja or causing serious violence in the stronghold of a much loved potential winner in Abuja.
Does it make sense to make it so easy to destroy the mandate of a candidate who hypothetically can win 90% votes in all 36 states?

The 25% is needed in Abuja, as there’s no governor in Abuja, therefore it’s required to have the 25% cuz you’re the president and governor of FCT. Also this is a federal issue not a state issue compared to adeleke.
Abuja is treated as a state in times of federal elections..
