The whole thing is very simple.

1) Femi Gbajabiamila won an election into the House of Representatives.

2) Before the inauguration of the House there were rumours that he would be made chief of staff, but he told a journalist that he should wait for the proper process to play out.

3) President Tinubu told governors that he will appoint Gbajabiamila as chief of staff.

4) Gbajabiamila was sworn in as a member of the House of Representatives and voted in the speakership election.

5) He will resign from the house today and take up the position of chief of staff.

6) There will be a bye-election to elect a new representative for his constituency.

On June 2, President Bola Tinubu announced the appointment of Femi Gbajabiamila, speaker of the house of representatives, as his chief of staff.

Gbajabiamila is expected to commence his role as COS on June 14 after he would have resigned as a member of the house of representatives.

On February 26, he won his election for a sixth term to represent the Surulere 1 constituency at the green chamber in the 9th assembly.

Now that he has been appointed as the COS to the new president, questions have duly been asked about how Gbajabiamila is expected to transition from 9th national assembly speaker to COS.

Legally, the lifespan of the 9th assembly will expire on June 11 which is a Sunday, a non-working day, while the next day, June 12, is Democracy Day.

The 10th assembly will be inaugurated on June 13 after which Gbajabiamila, who would automatically not contest for the role of speaker anymore, due to zoning, is expected to resign as a lawmaker and start a new role as COS.

WHAT HAPPENS NOW THAT GBAJA IS COS?

The new presiding officer of the house (speaker) will declare Gbajabiamila’s seat vacant after the 10th assembly is inaugurated.

The Independent National Electoral Commission (INEC) will then organise a by-election wherein the APC would have to nominate another candidate to contest with candidates from opposition parties for the seat.

Constitutionally, no law prevents Gbaja from operating as speaker and COS to the president until he vacates his seat, however.

The office of COS is not a member of any body set up by the constitution.

Speaking on his appointment, Gbajabiamila said he is due to take office on June 14 – days after the inauguration of the 10th assembly – when he should have resigned.

“I shall give my best when I take office on June 14, 2023 as reflected in Mr. President’s official letter,” he wrote.

Section 306 [7] of the constitution says “the notice of resignation of a member of a legislative house shall be addressed to the president of the senate or as the case may require, to the speaker of the legislative house in question”.

He has already been announced as Chief of Staff and by law he cannot be chief of staff and a member of the House of representatives.

I want to believe the aim was to make his vote count which is clever and that officially he is not yet chief of staff.
I expect him to resign from the House of representatives before resuming as Chief of Staff

He only formally received his certificate from the house which belongs to the APC.

The APC will nominate his replacement as the APC owns the seat and not Femi.


He must first resign as a house of rep member, his resignation will be announced on house.

There is no such law

The appointment of Senator Bala Mohammed by GEJ as minister of the FCT

Bala Mohammed's seat belonged to PDP.

PDP Bauchi renominated some one to take over his seat.

Where some one dies, the ticket expires and a bye election must be conducted .

Bye elections can only be conducted when an individual is recalled , dies, resigns or loses his seat via impeachment or conviction.
