LOL

As far as I am concerned....Tinubu, Obi, Atiku, Buhari, GEJ and Obasanjo as well as Yaradua are the same members of the same party.

I stand by what I wrote. It would take more than BVAS anyway to get free and fair elections in this country.

Move along now.

I would appreciate it if someone could clarify this for me. How do any of these pieces of evidence prove that Obi won the election?

The argument seems to suggest that if the results were not uploaded to iREV, the entire election should be invalidated for this argument to hold true. However, I am trying to comprehend the logic behind claiming that everything went well until the upload process, without any indication of the results being altered. The argument seems to be solely relying on the fact that the results were not uploaded as evidence of winning.

I have mentioned before that Obi, along with his lawyers and supporters, is aware that he did not win. Therefore, he is not even attempting to demonstrate his victory; he is solely relying on the non-functioning iREV system.

Nonetheless, INEC should provide a thorough explanation for the malfunctioning aspect of the process.
Section 60 of Nigeria Electoral Act 2022 mandated the PO to transmit results and failure to do so attracts penalty of either #500,000 or a term of at least 6 months minimum.

Read below the electoral Act as quoted verbatim with little footnotes:

(1) The Presiding officer shall, after counting the votes at the polling unit, enter the votes scored by each candidate in a form to be prescribed by the Commission as the case may be.

'footnote'
Note the words "to be prescribed by the commission"

(2) The form shall be signed and stamped by the presiding officer and counter signed by the candidates or their polling agents where available at the polling unit.

(3) The presiding officer shall give to the polling agents and the police officer where available a copy each of the completed forms after it has been duly signed as provided under subsection (2).

(4) The presiding officer shall count and announce the result at the polling unit.

(5) The presiding officer shall transfer the results including total number of accredited voters and the results of the ballot in a manner as prescribed by the Commission.
'footnote'
Pls what are they transferring?
Did the commission prescribed any method to transfer the said accredited voters and results of the ballot?

(6) A presiding officer who wilfully contravenes any provision of this section commits an offence and is liable on conviction to a fine not more than N5 00,000 or imprisonment for a term of at least six months.

'Footnote'
This is the penalty accrued for not following the law and guideline provided by the commission.

Internet connectivity didnt affect anything! THe refusal to upload the presidential results were deliberate (orders from above); anyone (even the blind) could see that clearly.

I can go pull up some old circulating videos where voters battled election officals to upload the results; the officials bluntly refused citing 'bad network' as the problem. In some cases, voters even offered to hotspot internet from their phones, but the officials refused claiming the problem was from the INEC server and not the internet connection in the area. Some other officials claimed their ogas didnt provide a specific pass code which they claimed was required to securely upload the presidential results. In some units, after the mob pressure from the voters, 'network' miraculously appeared and the officials were forced to upload. Now an AWS official has just prrovided evidence that there was nothing wrong with the health status of the INEC cloud services on that election day; this already rules out the foolish lie by INEC officials that their network was down.

Even a blind person or a child could easily tell that the selective refusal to upload just the presidential results was deliberate. But then, we're in Nigeria, a shithole African country, so even if all the evidence in the world is provided to the court, I dont still trust the already compromised courts to do anything right.
Let AWS staff go beyond to proof that to us abeg

The good part is that none of the witnesses states that the presidential elections were rigged, they both maintained that the elections were peacefully conducted, results announced and results shirts signed and issued to all Party agents.

INEC as an independent body, has the right to alternate the transmission of electoral results when the BVAS failed without consulting any political party, organization or court.

Only if the petitioners and witnesses says the elections were rigged that there would've been issues, since both remain resolute that the elections were peaceful but only the results were manually transmitted, Obi, LP, APM, Atiku Abubakar and the PDP have no case.

Obi star witness, a mathematical professor says elections were rigged in Rivers and Benue, however, you cannot contest the outcome of presidential elections in just two states, it must be across the 36 states.
Mr. Man, it is not only when election is rigged that invalidate an election. Not following the enabling laws, guidelines and manual for an election invalidate an election according to Nigerian Electoral Act section 65.

Read below:
Section 65 Nigeria Electoral Act 2022
Decision of returning officer on ballot paper

(1) The decision of the returning officer shall be final on any question arising from or relating to –
(a) unmarked ballot paper;
(b) rejected ballot paper; and
(c) declaration of scores of candidates and the return of a candidate:

Provided that the Commission shall have the power within seven days to review the declaration and return where the Commission determines that the said declaration and return was not made voluntarily or was made contrary to the provisions of the law, regulations and guidelines, and manual for the election.

This last paragraph is even the cruise of everything. The commission even reserve the right to void an announced results within seven days wherein its detected that the declaration was done against the provisions of the laws and guidelines and manual for the election.
'footnote'
Note this, breached of:
1. Provisions of the law (both constitution and Electoral Act)
2. INEC guidelines
3. INEC manual so provided
The breached of any of these three can render the election null and void according to Electoral Act quoted above.

The petitioners know what they are doing. They either void or invalidate the election through either malpractice or manipulation, suppression of votes or noncompliance to the electoral Act or guidelines so provided for the elections.
The respondents have a high mountain to climb.

It's the mentality of the Nigerian people, I mean, just look at peoples response to the elections. They're saying, they should just leave it, and wait to the next elections. Nigerians need to get serious about their future, because with the way things are going, it's going to get rather bleak.

You came to NATIONAL television and publicly stated that INEC will transmit all results from the BVAs direct to INEC servers.......

And that is one reason , you are proposing for an estimate of #3Billion for the election...

But , on the election day, nothing like that was achieved in the most important election which is the Presidential election...

The person that planned this could have just made both the senatorial and HR results to malfunction as well but they sensed Nigerians will easily find out....

Now if you say , that the reason why Presidential results where not able to upload is because it noticed cyber hacking and all have you, does it mean the Senatorial and HR results where also manipulated?

If you can be able to prove the Presidential election not uploading, tell us why the Senatorial and HR was able to Upload.....

I kind of expected this to happen months ago.

Nigeria does not have decent internet all over the country. Even me, when I join meetings on Zoom atimes, sometimes I get logged out because bad network...and I live in one of our main cities!

BVAS was brought in because of far too many contests over elections. The problem is, it uses internet...and in most rural areas, internet is either bad, non existent, or 2g internet which was what we used....17 years ago.

The problem with Nigerian elections is, at the end, they are only fair if 'my candidate wins'.

Anyway, we wait till the court process is over.

P.S

Anyone who accuses me of defending evil misses the point.

You are trying so hard to doged the main gist which is, why did BIVAS refused to upload the Presidential election results, but same BIVAS uploaded the National Assembly election results held simeoustaniously and on the same day and same time

INEC does not have any special internet network...they use what is on ground. And beyond our cities, internet is bad, very bad.

(I've even tried it, if I am on a long journey as a passenger, after passing a certain limit, I cannot browse on my android).

BVAS was not going to work very well. Anyway, as time goes on....

Please just shut up!
Listen to yourself when you talk.
INEC used same server for those results. Glitches or downtimes would have affected all categories transmitted via that server. But here certain category uploaded successfully and certain did not.
Glitches in network won't respect certain categories over the others. The glitches would have cross hampered the senatorial and reps result as well. But here is an intelligent selection, not a random one.
