A Federal High Court in Lagos Monday awarded N1.2 billion as damages against a multinational pharmaceutical firm, Glaxosmithkline Consumer Nigeria Plc (GSK), and its parent company, Smithkline Beecham Plc, based in the United Kingdom for infringing on the trademark and patent right of a Lagos-based indigenous pharmaceutical company, Continental Pharmaceutical Limited (CPL).

The court also placed a perpetual order restraining the companies and their agents from adopting the features of the plaintiff’s registered trademark comprising the eclipse logo with blue and white package design for the manufacture and sale of the Panadol and Panadol Extra products.

Delivering judgment in the 16-year-old legal battle that witnessed about 50 appearances by counsel to the suit, Justice James Tsoho not only dismissed GSK’s counterclaims dated January 22, 2009 but also awarded another N150,000 against the defendants as exemplary cost following the application by the plaintiff’s.

In the verdict, which lasted for two hours, the judge held that the defendants illegally adopted the plaintiff’s trademark to deceive the buying public in an attempt to pass out their Panadal as the plaintiff’s product.

The judge barred the defendants from importing, manufacturing, selling or supplying any analgesic preparation containing the active ingredient known as “Paracetamol” bearing the name Panadal or Panadol Extra in a container or any packaging with the logo closely resembling the plaintiff’s registered trademark for Conphamol to mislead the public.

He also ordered the defendants to swear to an affidavit that it would remove all goods in their custody, control and possession bearing the marks complained about by the plaintiff and which would be a breach of the orders of the court.

While describing the defendants’ submission regarding the copyright’s idea and ownership as inconsistent, Justice Tsoho submitted that it was wrong for them to assume that the ownership of copyright between an employee and employer could be the same.

It faulted the defendants’ submission that it had been marketing Panadol products prior to 1981, saying that this did not mean that it did not infringe on the plaintiff’s trademark and copyright.

He further held that the plaintiff’s Registered Trade Mark (RTM) 40551 and device was valid and subsisting and consequently dismissed the defendants’ counter-claims that they did not infringe on the plaintiff’s trademark.

The judge however refused to award the plaintiff’s relief seeking a N1,000 per package cost on the proceeds of the infringed trademark prescribed under section 20(1) of the Copyright Act, Cap C of the Law of the Federation of Nigeria 2004, saying that it related to criminal matters liable upon conviction and not applicable to civil proceeding such as the suit.

While the judge awarded N500 million against the defendants as damages for passing-off and for infringing on the plaintiff’s registered trademark for Conphamol and Device in Class 5, he awarded N700 million as special damages for infringing on the copyright in the artistic work of the trademark.

Trouble started for the defendants when the plaintiff, in its statement of claim, stated that after due diligence it registered a product known as Conphamol on November 10, 1981.

It contended through its counsel, Mr. Ekpe Asuquo, that upon a test that was conducted by the Trademarks Registry on the said “Conphamol and Device” applied for, it revealed that there were no conflicting marks on the Register which made “Conphamol and Device” to be accepted and numbered 50551 for publication on June 14, 1982.

The plaintiff also contended on March 20, 1992, that the registration was renewed for a period of 14 years with effect from November 10, 1988, adding that since then, it had exclusively, extensively and continuously used its registered trademark in relation to its pharmaceutical preparation, Conphamol, for the treatment of rheumatic pains, toothache, period pains, cold and influenza, chest and throat infections, mild immunisation and vaccination reaction in Nigeria and abroad particularly the ECOWAS sub-region without objection to any individual or corporate body and sold multi-millions of naira.

However, it stated that in 1995, it started noticing various pharmaceutical purporting to be analgesic preparation containing the active ingredient “Paracetamol” not to its manufacture but sold in packages and get-ups similar and identical to its registered trademark for Conphamol.

The above judicial pronouncement is a COPY RIGHT INFRINGEMENT but not a PATENT RIGHT INFRINGEMENT. In a case of A PATENT RIGHT INFRINGEMENT with WIPO CERTIFICATION NUMBER PCT/GB/2010/000074, the infringers must pay more.


The burden of evidential proof in a process patent right infringement litigation lies on the defendant (MOBIL OIL). Mobil oil must proof the inventor of the paint they use to coat their pipeline. The application of reversal of burden proof will come to play.

Patent right infringement is a criminal offence in Nigeria. Time does not run against a state in a criminal matter. No more statute bar. Mobil oil must pay.

Compliment of the season to all patentees on this assembly.I wish everybody a very prosperous new year.Now,what is going to happen this year.I went to ogudu head office of comandclem around that december time.I met one of comandclem director,I asked him how long it will take supreme court to deliver judgement on this issue.He told me that any case with supreme should not be more than nine months,that everything should be concluded within the nine mth.So,what is latest now?

RE: REPLY OF BRIEF OF ARGUMENT OF CCNL BY MOBIL OIL IN THE SUPREME COURT OF NIGERIA.


We have received quite a number of calls, and messages on our email/facebook to the effect that whether Mobil Oil has filed a reply in the Supreme Court or not. We appreciate those patrotic dispositions of CCNL PATENTES in the bid to monitor their respective investments in Comandclem Nigeria Limited.

We shall state categorically that the Management Of Comandclem Nigeria Limited has done all the necessary legal requirements in law to drag Mobil Oil before the Supreme Court Of Nigeria in the relentless efforts to ensure the payment of royalty.

For record purposes, the Management Of Comandclem Nigeria Limited has fully established the case of patent right infringement litigation against Mobil Oil where the said case (SC./69/2011) has been assigned to five supreme court justices. A documentary evidence on the subject matter was attached to this forum some times ago.

Further more, some times ago, we disclosed on this forum documentry evidence of petition to EFCC, MINISTER OF JUSTICE etc to the effect that a patent right infringement is a criminal offence in Nigeria and appropriate security agencies should do their jobs on the subject matter.
The above documentry evidences produced by the Management of Comandclem Nigeria Limited are pointing to the facts that CCNL has done what are required within the confine of laws of the federal republic of Nigeria.

Under a normal situation, Mobil Oil is expected to file a reply to the brief of argument of CCNL on 19th of December, 2011. As at today, there is no strong indication that Mobil Oil has filed a reply in the Supreme Court. We see this as a deliberate action on the part of Mobil Oil to cause unreasonable delay in the final judicial determination of the case.

It is not the duty of the Management of Comandclem Nigeria Limited to force Mobil Oil to reply its brief of argument. A thief can not talk.

What next? u asked. Just as a Comandclem manager was asked: what does Comandclem have in stock for patentees this year? He said: we ll be organising sub unit meetings for patentees to let them know how important it is to pay their N2000 levy. Very interesting.

N2000 levy again this year, people invested their money, they not see the return for the past 3 to 4 year and you are still asking them to come and pay 2000 levy. let comandclem tell us the reality concerning this case either good or bad.
