Hello everyone,

I'm up for EB1-A, post I-140, and I’m planning to marry before the visa interview and want to add my spouse as a derivative.

From what I’ve read, the timing options post I-140 approval are:
• During DS-260 submission: Ask NVC to add spouse.
• After DS-260 but before interview: Ask NVC to add spouse.
• After Interview Letter (IL): Notify consulate directly

My goal: I want a joint interview rather than follow-to-join.

Question: which of the options above is the best based on my scenario.

If you are already DQ and married, the best option is to add your spouse after receiving IL. If you do before IL, you will loose your DQ date to the date of addition.

I added my baby after receiving IL and I didn't loose my DQ.

You cannot transfer it back after you have recieved interview letter, you can only transfer when it at NVC.

Says who. I'm talking from people around me that shared their personal experiences. One transfered back from Germany after receiving IL, another from SA. How do you mean it isn't possible.

This is a well put together thought. I suggest you transfer if you can. Consider Cameroon and Togo. Another option for those that has the principal applicants in sane countries (especially Europe, even South Africa), is to transfer their file, get IL, and transfer it back to Lagos. Don't transfer back till you receive IL. This is what people are doing. Don't sleep on it. Best wishes to everyone.

Yes, in all the groups I'm aware of, only one person indicated getting IL for lagos eb3 and I think that was on the 20th of this October. Her interview is scheduled for December. Her priority date is November 2022 and her dq was March 28th, 2023. As for me, my priority date is December 2022 and my dq is March ending, 2023. I'm sorry, I don't want to say the exact date. I'm on the eb3 route.

Omo, so Lagos never clear March 2023. It is well. If you can, transfer to another country. Love and light.

I have added the new drivative beneficiary (by requesting that via the Public Inquiry Form); I have paid the fee, filled the form, and sent civil documents for the new beneficiary.

I have today (7:08 am) received the type of letter that I received when I initially sent my civil documents in November 2023—stating that "The National Visa Center (NVC) received all of the fees, forms, and documents that are required prior to scheduling your immigrant visa interview at a U.S. Embassy overseas. NVC will work with the U.S. Embassy/Consulate General in Lagos, Nigeria to schedule an interview appointment for you. Once we have confirmed an interview date, we will send a notice to you, your petitioner, and attorney (if applicable).".

The letter contains the same details as the one received in November 2023, except for the date on which it was issued. So, I want to assume that the DQ date has changed. Though I am not so sure since only the priority date is specifically stated. The DQ date is not stated. I just assumed the DQ date is the date the letter was issued.

Please, guys, I still need information on how long derivative beneficiaries can be on "follow-to-join" and if I will be the one to inform NVC when they are ready for an interview, or if NVC will schedule them without asking me. I will be glad to know these. I have my beneficiaries moved to follow-to-join, for some personal reasons.

Best thing is wait till you get IL, then contact embassy to add the new derivative. After you receive IL, you have no business with NVC and you cannot loose any DQ.

With this, you have probably lost your spot on the queue for interview (Nov 2023). You could have added the new family member just after you receive IL, and you have nothing to loose.

Regarding follow-to-join, I will revert back shortly.

I have added the new derivative already. Also, I have made a payment and filled out the Ds-260 form for my newly added derivative.
I just want to know if I need to send photocopies of my new derivative to NVC, as I have done before. Anyway, I have told my friend to help me post it to them already.

DQ will definitely change. Best is to add derivative after you receive IL. At this stage, you deal with the embassy.

I. To add derivatives is str8 forward, contact NVC either via public enquiry (they respond at a reasonable rate this days) or email with the information of the derivative to be added (Full name, address, relationship of derivative to you). To make things easier and faster, Include civil documents to the request for adding derivatives e.g
a. passport biopage
b. birth certificate (double check what NVC accept for your country. If you are not sure ,check the one that applies to your derivative country of birth if he or she is not of same nationality as you).
c. police report of your derivative. If anything is missing, NVC would notify you.

II. DQ remains the same. However, I have heard one or two conflicting report (hear say, no evidence i saw for myself) that Dq changed.

Where are you doing the interview? Lagos or London?

I suggest you transfer to Cameroon if you can. You will receive IL in a month. It has been tested and proven.

We dey run am oga mi, good to hear from you. as for petition, I notified my petitioner that i am done waiting , the ball is in their court at this point to do whatever they want, if they want to cancel , no P, if they want to wait, same noni, as foe me , i am done with waiting. Pivoted to another space, fingers crossed to see how that turn out.

It's clear the lack of transparency and no effort of communication (even when contacted by lawyers and member of congress) on the part of the us consulate in Nigeria shows they are up to no good with regards to Eb interview scheduling.

There's so much excuse you can make before people see through the BS you are up to! wishing everyone goodluck with the wait though.

I recommend renewing your passport without reaching out to request an update, as doing so could potentially reset your Documentarily Qualified (DQ) date. Instead, bring the renewed passport to your interview and inform the Consular Officer directly. Alternatively, you can notify the document reviewing officer during your first visit to the consulate.

It may not be favorable for immigration based on Republicans lean towards firmer immigration policies.

Any major and needed immigration changes however require bothe parties in House of Reps and Senate to agree on a Bill . This has not happened in decades and next year will show whether they have SENSE.


BACK TO WHAT CONCERNS THOSE IN NIGERIA waiting for interview dates.

Hopefully, since Biden is leaving. Lagos Consulate may rush and get as many as possible scheduled for interviews for family based immigrant visas before He comes into office in January.

This is because in2020 Trump signed 2 executive orders that made both Nigeria and those on certain Family based categories unable to be interviewed in Lagos. That stalled interviews in Lagos significantly.Biden reversed those executive orders in 2021 Jan.

So if you are DQd and PD is current, get your documents for interview ready, go and set money aside for medicals and flight tickets.

Hopefully by grace interview letters will start coming faster

They should just remember the EB1 and EB2 categories. Many of us are DQed close to 2 years now, and current.

Going through recently published updates on Non-immigrant and immigrant visas issued as of August, concentration still seem to be prioritized on B, F and immediate relatives and a bit of other family relative. Pretty much a game of wait and see if we get IL end of this month or next month. Fingers crossed.

quick update and Question for the house:

I. some Fb group is showing that some IR1 August DQ got IL yesterday. I guess expectation of IL for EB (candidates with available visa in the visa bulletin) is not far-fetched in coming weeks. earliest 1st week september

II. In case anyone has update about Police clearance certificate requirement (old vs new) kindly inform the house. I had the "old"one done in february '23. I am trying to be reasonably proactive.

I am also trying to be optimistic and hopeful EB categories get IL latest next weekend.

Regarding old police clearance certificate, I think the old one should still suffice if not expired. Mine was done in Jan 2023.

That acknowledgement means you're DQ. The DQ process is pretty fast usually from 2-21 days. If outside of that range, the applicant/petitioner is missing something.

I think this confirms my thought too. The acknowledgement means you are DQ. It is even possible your DQ date is a little earlier than acknowledgement date like in my case. I got acknowledgement email after I made enquiry from NVC (3 weeks after documents delivery), so I felt my DQ date was the acknowledgement date. I later got to know my DQ date was a week earlier, through the 60 days notification from NVC.

Congratulations on your DQ. Ti be honest, I do not think DQ would take this long after delivery of documents.
Were you asked to provide other documents after NVC documents acknowledgement?

Please i am completing the Form I-140 from Nigeria but I am confused on some of the items on the form and if they apply to me: for instance, do i need to state my address in Nigeria as my mailing address or do i use the address of a relative in the US?

Preferably, a US address is better so you can easily receive notices from USCIS.

Your case is very similar to mine.

I applied from Nigeria and had a similar experience. I submitted my documents to the NVC in late October 2023, even though my Priority Date (PD) was January 2023 and not yet current. In November 2023, I received an acknowledgment from NVC that they had received my documents and would contact me when a visa was available. However, this acknowledgment did not mean I was documentary qualified (DQ).

My PD became current in the June bulletin for July 2024, and on July 1, 2024, I received an email from NVC indicating that I was now DQ. This means the NVC acknowledgment is different from the DQ notification.

So, my advice is for you to hang in there. My wait period after receiving an acknowledgment of the receipt of my documents from NVC was about 7 months.

Which date is your DQ date? Nov 2023 or July 2024?

If your documents delivered since more than 3 weeks ago, I suggest you write NVC to confirm they received them and ask if they need more information from you.
