I had the same issue and what I did was to get another birth certificate from NPC. I was able to do so because the name on all my certificates were the same as that on my international passport except birth certificate. What name is on your important certificates?

You may be able to straighten your claim IF a paid representative other than your uncle was used to file the application. Thereafter, an intelligent argument can then be allowed to flow against the misgivings of the representative and backed with an Affidavit of Fact to demonstrate your innocence. Don't do this if your uncle filed in the application himself. You can forge through the headway of fate and accept the outcome with bravery. This is the only dreaded way a solution and an answer can be gotten simultaneously.

Good morning good people, I just received an admission letter from my agent telling me I've been admitted into a school in Canada.
I was of the opinion that during this pandemic, no school should be Operating. He did the first one that I was admitted into the university of Saskatchewan, later I couldn't continue the process cos he said I was late in payment of acceptance fee. On the other hand, my fiancee was admitted to Dalhousie University. She paid for the acceptance, she was given an invitation to go do data capture at lekki. She went to vsf global at Manor hall to do data capture and we didn't hear from them up till date.
My good people, I want to know if this is actually a scam or it's just circumstances that is debarring me and my fiancee from going.

My little advise, using a agent is not advisable if you are willing to put on the hard work you can get everything you need on this platform. That is my advice.

Letter of explanation (LOE) and Statement of Purpose (SOP) both represent same purpose. More often, applicants who have been denied a visa prefer using an LOE to address the concerns raised by the visa officer in their previous applications. Whilst, the SOP serves to address the applicant's intent to study the program in Canada, why the applicant chose the proposed school and the future career goals upon their return home.

It's very necessary to bring to your comprehension that when it comes to Canadian Immigration process, no two applications are the same. Each applicant case is unique and as such treated independently based on the visa officer's discretion and the information presented by the applicant. As the saying goes "Different strokes for different folks", what worked for Mr. A might not work for Mr. B. I will advise you leave your application simple and concise as possible. Your letter should focus more on explaining to the visa officer what you have done differently based on the concerns that were raised in the past application and how your situation has substantively changed.

This is very informative and thanks for your contribution again sir. i would like to add that i am using LOE but this is my first application. I am using LOE because of the study gap i have and LOE will be the best to explain what i have been doing since and the certifications that i have gotten since then. Graduated 2013 and going for diploma at Holland College.

You only overstayed your VISA to UAE which you eventually got renewed. Dubai is not considered as a good travel history in the Canadian Immigration officer's assessment. You don't need to provide proof that you paid any fine as you might be complicating things for yourself in your application. A scanned copy of your previous visas to the country and other countries will be fine. Also be truthful as possible in your application by mentioning all the visa refusals you had in any country.

I have been read this thread from page one and at page 24 or 25 i saw someone explaining that he got refused twice because he was using only LOE as his supporting doc, but he got the visa when he used LOE and SOP together. Please what is your opinion on this sir and would you recommend it sir.

This is what I meant:

– No, I was saying the only way you can try to convince the VO in regards to the wrong information passed about your parents death is if MAYBE your uncle used an agent. This way, it may be easy for you to explain and provide clarity to the VO that the oversight came from the agent.

– That if its actually true an agent was used and with the reason that you may not have known how the agent had filled your personal information and never asked for more documents. And you never gave him any document regarding the death of your parents.

– That you should then swear an affidavit attesting and reaffirming that your parents are indeed alive and hale.

– That if your uncle filed the application himself, you shouldn't do as suggested but put in your application. This way, at the end, you will surely get to know if the application was refused due to misrepresenting or approved because your application was assessed and processed indepenently.

– Misrepresenting of facts and/information is a serious inadmissibility crime. They ain't likely to seize his legal documents but may face certain penalty especially if he has broken the law before. For more information, you can read more on inadmissibility from IRCC site.

Thanks for the support sir, i would like to clarify somethings that you said
1. I will use a paid representative(agent) to apply for my student visa
2. And then i will let the representative argue on my behalf for the misgivings of information and i will back that with a swore affidavit of fact.
3. You then said i should not do this if my uncle file the application (are you referring to the sponsorship application or my student visa that i am about to apply for .

Question: is it possible that IRCC will seize his PR and that of his family because he tempered with information and this is fraudulent according to the IRCC website?

This application might still be refused again. If I may ask, what sponsorship category or visa type were you been sponsored by your uncle? Was it Family Class?

I believe the immigration lawyer advised for the request of your GCMS notes before appealing?

What information was conveyed therein and what are the stated reasons for the first refusal and that of the appeal or did the lawyer also not give explanation?

If it was me, first thing I do is request for the notes. You have to understand that for your application be declined for the second time with the help of an immigration lawyer, maybe you may want to be curious enough to wonder why.

Each Canadian immigration route has their independent requirements that should be satisfied to find yourself eligible. The VO may however act on discretion to verify some information and satisfy some curiosities. If you do the right thing now, you won't complicate and contradict yourself further, in terms of certain sensitive information or personal details.

Yes it was family class . But i did not give my document for that application because it was my sister who he was trying to sponsor so he just named me has her younger brother. The matter is complicated and people her asking me to expunge any ties i have with her from my application and that my uncle also. And also this is a student visa application.

Perhaps I am missing something here. If your uncle in Nigeria has enough funds, why does he have to pose as your father? Uncles do sponsor people don’t they? I don’t really understand how it will complicate things for him.
I was referring to the uncle in Canada . And you are right my uncle in Nigeria can sponsor me as a uncle.

As long as you keep your stories consistent. Why does your Uncle want you to use your other uncle in Nigeria as your father? Why can’t he sponsor you as your Uncle? As long as he has the funds?

Most times it is just best to tell the truth.
My uncle in Canada cant sponsor me because is name is tied up in my sisters application and sponsors from Canada are advisable to apply for visa. That was why he suggested that i use him has my father.

Ok that’s a little better. But at the same time he will still have to fill her name as his sibling in the Family Information form. How will they be siblings and she is an orphan while his parents are still alive?

Unless he plans to never list his sister as his sibling in any document meaning he cannot sponsor her neither can she claim points with him later on after he has presumably gotten his PR.

I did not give any document and any biometric during that application . it was my sister who gave her document . And also this is my first time applying for a student visa in Canada but i have previous travel his to UAE and Kenya. Also i am not planing to name that i have any connection to him and i am supposedly not going to mention my sisters name in my family ties.

YOUR FATHER isn’t deceased. If you go with the advice of your uncle, this lie will come back to hunt you in the future when you have forgotten. Don’t lie!!! Simply state that your father is alive but you have an uncle who is interested in sponsoring you. Irrespective of whether you bear the same name, you would submit his documents, like data page of international passport and his business documents. Save yourself the stress and explain yourself.
I really appreciate your contribution, i just want to clarify that if i explain myself this can really complicate things for him in any future application.

Just expunge his name from that application and don’t even think about him sponsoring you. Since it was your sister and not you he previously intended to sponsor, you can go ahead with your visa application. I believe you just have to truthful. When filling your application for visa, you would also fill in your sisters name and they might probably go through her records. You may have to explain this to them to prevent problems for yourself.

That solves part of the problem am also looking at the parent that he claim was deceased and if i can used there names or use the name of my dads elder brother who is my sponsor and we are bearing the same surname.

The truth is the only safe ground to stand upon. Very risky move. So if you were granted visa and maybe later, I’m sure you would have forgotten, your sibling or yourself would want to sponsor your parents to come over. This is very wrong on all level and it is fraudulent.
I understand this risk so that is why i am seeking another solution. I believe that nothing is impossible and during the time he was applying for this sponsorship he did not ask me to submit any document, he only requested for my sister document and the main purpose then was to take my sister over there.

The simple truth is, if you don't know, for sure, why the app was rejected, the reasons quoted and the concerns of the VO, based on the GCMS note. You may be entering a complicated issues.

If you change your details as against what you have already quoted in the past, they will know, and this may likely shot you in the leg.

The wise thing to do, is to ascertain why the app was rejected. Then you will better be informed on how to present yourself this time around.

Anyways, feel free to follow the guidance of your uncle.
I really appreciate the advice and the point that you keep hammering on that i ask for the GCMS note. Also a quick note that the latter was the application for sponsorship while the one am applying for now is student visa.

But start from here, what was the specific reasons for the denial? Do you get GCMS note to ascertain what why the VO rejected your app.

Thanks for the question. According to my uncle he did not tell me if he requested for the GCMS note but what i know is that he appealed the cased and they rejected it again . i am about to apply for my student visa and looking for a way to go about it or i should just go with what he suggested.

Hello everyone please i am asking for the gurus wisdom on my student visa application that i am about to apply for . My uncle in Canada wanted to sponsor us when he received is permanent residence and according to the IRCC the conditons were that our parents had to be deceased for him to sponsor us . So he forwarded the application and claimed that our parents were deceased (which they are not actually ) and they application was refused . So he appealed the case with a immigration lawyer and it was denied again . Now i have gained admission and want to apply and this thing is making me confused on what to do but he is suggesting that i used my dad elder brother as my father and he will also be my sponsor with is salary account and birth certificate proving that he is my father. Please i need your wisdom on this thanks.
