He should contact an immigration lawyer before the expiration of 60 days but also start looking for a sponsored role.


Using the lawyer route could be very expensive and take long to be decided, within that period he could struggle to keep his jobs as employers typically avoid keeping an employee with an immigration case, so he should also be looking out for a new job that can sponsor him.

Good Day all. Please I need an urgent advice about my situation.

I am a student visa which will run out in the next 8 days. I got a COS from my company, and I applied for my visa on the 11th of December but to my surprise my visa is not yet out. I've seen couple of friends and even two people in my company who applied for the visa after me and the main applicant application got approved within 24hours and they are only waiting for their dependants visas to come out.

After 3 weeks of applying the home office got back to me that it's taking them time to make decision on my application that they have requested more documents and action from my employer.

I contacted my employer and they said the home office are requesting them to make corrections on my COS that the minimum threshold is not enough to sponsor me. Funny enough it's the same £23200 stated on my colleagues COS that was also on mine.

I'm very confused because I don't know why the visa officer said the money was not enough. My visa will be running out on the 20th of January and I don't know what might be the out come of the decision. Meanwhile my wife is heavily pregnant and her EDD is very close.

Should I just apply for PSW and terminate the skilled work application?

I think the general rule is you are in the "green" if you are awaiting a visa decision while on an expired visa provided you made your application before your visa expired.

However, don't hesitate to get in touch with an immigration lawyer to confirm.

• Are childminders a more affordable and reliable option?
• For those working from home, can you manage watching a one-year-old while doing low-level tasks (no online meetings)? Is it realistic?

As someone advise, create a safe area where your child can play, preferably somewhere you have a line of sight to see the child ok.

WFH is a good way to cut down the cost. Preferable you and your madam can alternate WFH days but spending a day or 2 at day care is not bad as it helps the child build social skills.

For WFH, get noise cancelling headsets, observe and note times your child will typically nap, require food or a nappy change and plan online meets and calls to exclude those times.

Buy plenty toys for the child, get an tablet for the child if not playing where the TV is. I restrict tablet use to when I have very important meetings where I don't want any background noise or distraction. Cartoon on tablets are good at keeping infants very engaged but also create some undesirable character behaviors if use if extensive, so I strongly restrict it to most important meetings.

Let your colleagues, bosses know you have an infant at home. Gives them a heads up for possible background noise and easier to ask to reschedule a meeting.

The majority of Nigerians that came through the study route, did not do so having paid their full tuition and the bulk of them successfully did so and stayed lawfully in the country. You are not the first or an exceptional case.

The difference is many of them manned-up and took on the challenge with a positive attitude while you opened a thread singing like a canary, claiming there is no job in the UK and it was near impossible to do.

You also complained about the landlord asking for 3-6 months' rent upfront. You were informed to get someone as a guarantor. You complained that Nigerians would not help as a guarantor. Did you think we all came into the country with 6 months' rent at hand or relatives living here?

You're a very negative person, one that people looking to move forward should definitely avoid.

She would need at least a 2 bedroom apartment. If they are less than 10 years old, she will have to drop and pick them from school, pay for after school of She can't pick them by 3pm, ensure there is always someone at home with them with no recourse to public funds for at least 5 years.

She is also unlikely to find anyone willing to shoulder than responsibility in a country where people love to live their best life.

I don’t know how UK immigration works, but the fact they didn’t live together and she was removed from the visa after he graduated is sufficient backup.

The lady could have easily dragged the guy along when her visa was cancelled. They fact that they live apart would have been a strong indication to HO that it was an arranged marriage and the HO is aware of such schemes.

If this is true, the guy is very lucky.

At the point where he took her off his visa, she could have also reported him to the home office for the past misrepresentation of their relationship which would adversely affect him.

Even if they did on the paper, the substance of their relationship was false. They didn't live together and the lady can easily pull together other information and records showing it was a financial arrangement rather than marriage.

I don't think this is recent. The US will not grant him a visitor visa while he is on a pg visa in the UK. They will almost definitely reject it except there is something special about his case.

He needs to apply from Nigeria and event then, he's chances may still be low but far higher than applying in the UK on a pg visa.

As some have mentioned, you are unlikely to be granted a visitors visa to the US while still being on a PG visa in the UK, except you probably decide to apply from Nigeria , which also has a low chance of approval without strong ties indicating that you will return. You likely stand a better chance applying from Nigeria though. The UK one on a PG visa is likely an automatic rejection.

As others mentioned also, what makes you believe you will find it better as an irregular migrant in the US if you do not find the UK suitable as a regular migrant?
