Even of you plead guilty without any deal, you will still get a 2 point reduction. The sentence is calculated by a set guideline. Judges just don't wake up and just give whatever sentence they want. There's a book that spells out the time for each crime. If you go to trial and lose, you will.more.than likely get time because there's no reduction in sentence plus the judges will try to impose the maximum. Back to.my main point, in Mr Oyenma's chances that he can walk into the court and just pay a fine is very slim to none. It's not impossible but I seriously doubt that can be an outcome based on the seriousness of the charges. |

Anywho knows anything about the federal court system will tell you that those that plead guilty almost always get less time than those that goes to trial. This is basic ABC of the court system. CanadaOrBust:NO! The system is not based on feelings and sentiments. Its very straight forward. If you plead guilty, an officer of the court will visit you for what is called a PSI (pre sentencing investigation) report that will be presented to the judge before your sentencing. This PSi will basically tell the judge what kind of time he can imposed on the accused based on the federal sentencing guidelines. Anyone that pleads guilty and accept responsibility for their actions will get less time than those that went to trial. This is done to encourage people to plead guilty because if everyone should decide to go trial, the system will collapse. People get arrested everyday by the Feds for one crime or the other. It's about 3pm on the east coast right now. There are people that will be arrested before 6am tomorrow morning and they have no clue right now. They are at home chilling right now not knowing that the feds will be banging on their doors bu 5am tomorrow morning. Once they come for you, you are done for. |

They give more time for 3 reasons - when you go to trial, you are in essence saying that you do not believe that you have really committed these offenses, hence you have not taking responsibility for your actions. This is very very big in front of any federal judge. The second and third reasons are that you have wasted the govt resources such as time and money to prosecute your case hence you deserve more time than those who simply accepted their guilt and didn't waste govt resources. |

The FEDS do not like to go to trial and 90 percent 9o Federal cases do not go to trial simply because by the time they charge someone to court, they usually have more than enough to win the case. The Feds do lose cases but they win more than 90 percent. Mr Oyenma has money hence he can afford very good lawyers, this will make his case winnable(5% chance) or at least get the best deal he can get out of it. If I have to predict now, I will say that he will end up doing some small time and forfeit a lot of money. Only because he can afford good lawyers and he has connections in high places unlike other accused persons. Most people in the US don't have this kind of money hence most usually plea guilty and end up in prison. |
