Echocho had dragged Wada to an Abuja Federal High Court asking it to declare him the valid candidate
of the PDP for the December 3 elections on the grounds that he won the party's primary held on the 9th of January, 2011 and that his name was forwarded to the INEC
as the governorship candidate of the party for Kogi State.
But the Court of Appeal, Abuja Division, dismissed the appeal .
QUESTION:
Will the Supreme Court say Echocho is not the valid candidate of the PDP for the December 3 elections when the same Apex court had declared the tenure elongation as null and void?
If 'tenure elongation' has been nullified, wouldn't that make Echocho the valid candidate of the PDP for the December3.
Is there suppose to be two primaries simultaneously before a governor is

town, but he reportedly moved to
Accra this week. Efforts to get him
to deny or confirm the rumours

ABUJA—THE face-off between the House of Representatives and President Goodluck Jonathan over the poor implementation of the 2012 budget rolled over to the Senate, yesterday, leading to a walk-out of a high powered delegation of the Presidency from the Senate building.

The delegation led by the Secretary to the Government of the Federation, Senator Anyim Pius Anyim was turned back from the scheduled Senate public hearing on the implementation of the 2012 budget, following the unsuppressed anger of senators over the absence of the Minister of Finance, Dr. Ngozi Okonjo-Iweala.

The anger of the senators was further stoked by allegations that the real level of the implementation of the 2012 capital budget was 12.16% and not the 56% as claimed by administration officials.

The Deputy President of the Senate, Senator Ike Ekweremadu who represented the President of the Senate, Senator David Mark at the aborted hearing, gave Okonjo-Iweala an ultimatum to appear in person at the hearing which was rescheduled for tomorrow or risk arrest.

Administration officials led by Anyim, himself a former President of the Senate and shored up with Senator Idris Umar, the Minister of Transport also a former senator, could not save the day in the face of the blistering anger of the lawmakers. The administration officials including the Minister of State, Finance, Dr. Yerima Lawan Ngama, the Auditor-General of the Federation were not given any opportunity to talk as they were turned back in the absence of Dr. Okonjo-Iweala.

Announcing the formal cancellation of the Public Hearing, Senator Ekweremadu said Senators were not happy with the attitude of the Finance Minister neglecting the event for what he described as a less important function in London.

According to Ekweremadu, the hearing was scheduled for last Thursday, but the Minister was in Delta State for another event which forced the Senate to push it for yesterday.

Noting that the level of implementation was below commendation despite the fact that the National Assembly approved the budget as proposed by the president, he said it was as such realistic for the Senate to find out from administration officials reasons behind apparent low-level budget implementation.

The Deputy Senate President who noted that it was absolutely impossible to continue with the public hearing following the absence of the Minister of Finance ordered the Secretary of the Committee to summon her for Thursday (tomorrow) failing which a warrant of arrest would be issued on her.

Yesterday’s development came on the heels of the face-off between the Presidency and the House of Representatives over low-level budget implementation. Members of the House had threatened to initiate impeachment proceedings against the president if by September the administration fails to fully execute the budget as passed.

Dr. Okonjo-Iweala had on Monday claimed that the 2012 capital budget implementation as at June 20, was 56 per cent. However, a document on budget performance submitted to the Senate committee on Finance by the office of the Accountant General of the Federation showed that a total sum of N401, 648, 460, 791 has been so far released with N324, 556, 851, 948 of that amount being cash backed.

According to the document, out of this, only N184, 848, 092, 533 has been utilized as at 20th July 2012, just as capital allocation for 2012 budget stood at N1, 519, 986, 106, 691 and only 21.35 per cent of the total allocation has been cash backed. And the percentage amount utilized from the releases so far stood at 12.16% as at July 20th.

It’s not 56% performance

“The performance of 56.95 per cent as indicated by the office of the accountant general is the percentage of amount utilized (184 billion) of the amount cash backed (342 billion) as at 20th July, 2012 and not of the entire capital budget. The actual utilization of N184 billion against the total capital of N1.5 trillion is 12.16 percent,” the document read.

Expressing the hurt of the senators, Ekweremadu said: “We had expected the Minister of Finance and coordinating minister for the economy to be here today because she’s central to all that we are going to discuss here today as our chairman on appropriation had mentioned this matter was supposed to be discussed last week but the Minister was unavoidably absent.

“We learnt that she went to Asaba to declare open a SURE-P Programme. We consider our meeting with her on an issue that has to do with budget implementation to be more important than any other assignment. Today we have also been told that she’s gone to London to represent the President on an investment forum for which we know there are other ministers and government officials that could as well have done that to enable her to be here with us this afternoon. So it is regrettable that she is not here.

”One of the excuses we’ve read from the pages of newspapers for non performance of the budget is what they considered as the tinkering of the budget by the National Assembly. And so what we had wanted to do today is to hear from the executive where the tinkering is.

“Let us hear and let the people of Nigeria hear what the National Assembly did to the budget that made it impossible for it to be implemented so that our committee chairmen here would have the opportunity of responding.
“So it is not enough for the Executive or the Minister of Finance to accuse the National Assembly of tampering with the budget that made it impossible for it to be implemented and then National Assembly is saying no, it is not so.

”So we decided a situation where the press will be the arbiter and then they will listen to us and the executive and then know where it went wrong if it did. And if there are areas that the National Assembly should be blamed and the Nigerian public should hear and if they have response from the National Assembly, our appropriate committees should also respond.

“Now, the stage is set but the minister is not here and we are worried about it. So, it will be absolutely impossible for us to do this dialogue with the absence of the coordinating minister of the economy. I have discussed with my colleagues and what we intend to do now is to allow our committee on appropriation to look for an appropriate date possibly by Thursday and ensure that the minister comes. Even if it needs summoning her to ensure that she appears before the committee to tell Nigerians the degree of releases and of course for the SGF to tell Nigerians the degree of utilization by MDAs.

“It is not just enough that releases were made and then utilization. We want to see whether those releases and utilization are impacting on Nigerians. We want to see it in roads, we want to see the water projects going on; we want to see the electricity projects going on. We have appropriated for the security situation in the country. We want to see whether there have been releases and whether they are utilized. That’s exactly what we thought this public hearing will afford all of us today.

“So for now, we are disappointed that it is not going to take place. I have the mandate of my colleagues to adjourn this public hearing to enable the Minister of Finance and coordinating Minister to show up and, as I said, the chairman of the committee on appropriation should take immediate steps including if possible summoning the minister to show up before the senate committee on appropriation and other relevant committees by Thursday this week.
“So this public hearing is adjourned to Thursday at the same time and the minister for finance is expected to be there no matter the circumstance”.

Speaking earlier yesterday, the Chairman of the Senate Committee on Appropriation, Senator Ahmed Maccido noted that even in the third quarter of the year, budget implementation was still a far cry from the expectation of Nigerians.

The recent recruitment by the Nigerian National Petroleum Corporation (NNPC) is lopsided in favour of some states and has not reflected the Federal Character principle, an analysis of the recruitment document obtained by Daily Trust has revealed.


The list of those recruited is due to be released early next month. Insiders allege that the process has ignored qualified candidates from many states, particularly from the northern part of the country.


The list, for instance, shows that out of the total 132 senior officers employed, there were no candidates from Kano, Kaduna and Sokoto. But Bayelsa, the home state of President Goodluck Jonathan and Minister of Petroleum Resources Diezani Alison-Madueke, got 11 slots making it the highest.


Also, Kogi State, where the immediate past Group Managing Director of the Corporation Engineer Austen Oniwon comes from got nine while Rivers and Imo states followed with eight candidates each.


The North East's states of Borno, Taraba, Niger got one slot each while in North Central, Nasarawa, Plateau states and FCT got one slot each.


Insiders told Daily Trust that the lopsidedness did not only stop at the recruitment list but also postings to some of the core technical areas in the industry. The source said most of the northern staff recruited are to fill non-technical positions.


When Daily Trust wrote NNPC demanding to know the recruitment procedure, the number of applicants from each state, points scored by each candidate at the test and interview levels, benchmark points set by the corporation, number of candidates that qualified with their states of origin and number of candidates employed by the corporation and their states or origin in line with Freedom of Information Act (FOI), the corporation said the provision of the Act does not bind statutory corporations like NNPC.


In a letter dated 17th July, 2012 with number CSLD. 1099, signed by the NNPC's Secretary and Legal Adviser, Anthony C. Madichie, the corporation said that: "We are not bound by the provision of the Act."

The letter also reads: "Please be informed that the Freedom of Information Act applies to Public Institution as defined under the Act. In this regards, section 31 of the Act defines Public Institution as follows: '... any legislative, executive judicial, administrative or advisory body of the government, including boards, bureau, committees or commissions of the state, and any subsidiary body of those bodies including but not limited to committees and sub-committees which are supported in whose or in part by public fund or which expends public fund and private bodies providing public services, performing public functions or utilizing public funds'.


When contacted about there ruitment, Acting Group General Manager, Group Public Affairs, NNPC Mr. Fidel Pepple said he is not aware of the recruitment list. "I don't have information about that one," Pepple said.


Spokesman for the Federal Character Commission (FCC) Mr. Chuks Okoli told Daily Trust last night that recruitment and placement into government organisations are based on proportion of existing staff.

He said: "If they have up to a hundred and something people recruited, the guideline is that every state must get, but those who are over represented will get less; those who are underrepresented will get more. That is our guidelineand anything outside that is a breach of our guideline."

"Going by our guideline, provided that they are taking a hundred plus people, each state must get but not that they will get equally. It is expected that those who have morein the NNPC will get less and those that are underrepresented will get more."

He said however that the commission will swing into action if any breach of guideline is observed.

The recent recruitment at the NNPC was subject of several controversies. The corporation, in conjunction with a recruitment firm, Phillips Consulting Limited, invited thousands of qualified candidates to an aptitude test which was held on Saturday, March 23, 2011 at various centres across the country.


The interview was conducted in August 2011 but the result was kept in secret due to alleged political interference by highly influential figures.

The list obtained by Daily Trust did not give details about the recruitment of graduate trainees and operators but the corporation said it had recruited 348 Graduate Trainees and 116 Operators, raising the total recruitment 596.

Hmmmm once again the cockrel has sound out the call and has state his administration intentions.
We have had from his Brothers in the past sounding their horns how they would perform,but ended up given us eggs in our faces.They delivered corruption,ghost workers,unfinished projects,high unemployment,nepotism,tribalism,poor parastatals,hospitals without running water: beds.blankets,no ambulance for emergency services,ghost ministries were created; the list is endless.
If Gov.Capt. Wada is serious, let him first tell us how much money was handed over to him from the kogi state treasury by his inlaw?
He must also investigate all the unfinished projects and publish them not to cover up the tracks and corruptions left behind by his predecesure gov.Idris.
It is easy to say that he will handover any of his elected officials to EFCC if found to be corrupt or failed to deliver. My advise to him is simple,you can not plant seeds without cultivating the soil.
Investigate your inlaw and all his ex-cronies and publish your findings,then we can start to trust that your administration means business otherwise,stop making perverse statements Capt. Wada and tell us about the level of corruptions and maladministrations you inherited.

There are indications that the much-awaited three Greenfield Refineries billed for Lagos, Bayelsa and Kogi States, scheduled to come on stream by 2017 may not be realizable.

This, it was gathered, is because the construction earlier planned to begin this month has been put on hold due to the Nigerian National Petroleum Corporation’s (NNPC’s) inability to secure Federal Government’s approval to commence work.
THISDAY checks revaled that the NNPC, which is to provide 20 per cent of the amount budgeted for the project is still planning to put together a consortium for the purpose of raising the funds.

The NNPC and the China State Construction Engineering Corporation (CSCEC) Limited had in 2010 signed a Memorandum of Understanding (MoU) for the joint sourcing of funds for the construction of three new refineries and a petrochemical plant in Nigeria under a $28.5-billion provisional deal.

The project had been envisaged to increase Nigeria’s refining capacity to over one million barrels per day (bpd) from the current 445,000 bpd capacity and stem the flood of importation of refined products into the country.
The parties had fixed (this month as the new date for the commencement of construction, following the NNPC’s inability to meet the May 13, 2011 date.

Front End Engineering and Design (FEED), site preparation and infrastructure had been scheduled to start in February 2012 to be followed by construction works this month of July.

Under the agreement, the Industrial and Commercial Bank of China (ICBC), the world’s largest bank, was to provide 80 per cent of the $11.3 billion budgeted for the project, while the NNPC will provide 20 per cent equity, to be diluted for private sector participation later.

However, a source familiar with the project told THISDAY yesterday that the project will no longer come on stream as earlier planned because the NNPC is still awaiting Federal Government’s approval to begin construction. The source said aside from the delay in securing government’s approval to begin construction, two other major challenges were the issue of funding and the delay by the National Refinery Special Task Force to submit the report of its findings on the traditional refineries, located in Warri, Kaduna and Port Harcourt.

Commenting on the project, the General Manager at the NNPC’s Group Public Affairs department, Mr. Fidel Pepple, told THISDAY that the Final Investment Decision (FID) had been completed and soil analysis revealed that the project is viable.
He explained that commencement of construction could not take-off as scheduled because the NNPC is still awaiting government’s approval.

On the issue of funding, Pepple confirmed that NNPC plans to float a consortium to enable it raise enough funds for the project.
He said: “The issue of funding is not a problem. What we are waiting for is federal government’s approval to commence construction, once that is done, we will put together a consortium to raise the funds, as the NNPC alone cannot do it”.

The initial plan was that each of the Greenfield Refineries would be able to process around 250,000 barrels of oil a day, but their combined capacity was later downsized to 400,000 barrels per day. Under the new arrangement, the capacities of the plants to be built in Kogi and Bayelsa were reduced to 100,000 barrels per day (bpd) each, while the one to be located in Lagos, will now have the capacity for 200,000 bpd.

THISDAY gathered that the capacities of the plants were downsized based on the new Detailed Feasibility Study (DFS) prepared by Wood Makenzie & Foster Will.

The NNPC had repeatedly stated that the new refineries, when completed, would help to eliminate the country’s current reliance on imported petroleum products and position it (NNPC) to engage profitably in the international trading of refined petroleum products.
The delay in its take-off is considered a major setback to Nigeria’s plan to increase her refining capacity to over one million barrels per day by 2017.
