Family / Re: My Younger Brother Is A Bone In Our Throat. Pls Help! by BarristerNG: 7:16pm On Dec 24, 2021
The Family Caused his wildness, They treated him as if he is special because is a boy... He is not, He is the last of three Children and the youngest member of the family... If he was trained as a normal member of the family, he would have turned out good like his sibling.

PARENTS SHOULD KNOW THAT A BADLY TRAINED CHILD IS A CURSE.....
Cyntie55:
Good day nairalanders. Season greetings to y'all. I'm so angry right now. Please I need mature advice.

My father is not a learned person but he make sure all his children are graduates. My younger brother(last born and only son) rounded up his Nysc few months ago, we're just 2 girls. My elder sis and I. My elder sis is a nurse in Austria (3 years now), she's married with a kid in Austria. My big sister send money home once in 3 months, and I have been the one receiving the money. I share the money exactly as instructed by my big sis. I have never cheated anyone, Infact my Dad and Big sis communicate very well. My Dad trust me so much.

My younger brother is always angry, He said he feel cheated all the time. He shouts and talks to me anyhow like I'm his mate.
Honestly speaking, I gave my younger brother more love and respect that he could ever imagine. When he was serving, he would call telling me he need 10k urgently, sometimes 20k, that he will pay back. Immediately I will send it to him and he would never pay back. Same thing he does to my father.
If we ask him what's he using his allawee for?? He would angrily say so is becus we're sending him "chicken change" that's why we're asking jamb questions.

He said we don't regard him, he called my Dad a SIMP, he said my Dad listen more to my big sis and I....but he don't listen to any of his suggestions.

My brother is a 2:1 (second class upper) graduate in economics from UNIBEN. After his Nysc all he does is to sleep and eat. My Dad's good friend told my brother to come to Lagos and resume work with him. He refused. My Dad ask him if he wants to further his education (masters or professional courses)he said no....Okay follow my Dad to his cement shop and help him (my dad even promised to pay him salary) he refused....I overheard him on a call with a friend and i suspect he's now into yahoo yahoo.

Look at what happened. My big sis sent us money yesterday to celebrate this festive period. She said I should give my brother 50k, I should take 80k and give my father the rest (abt 250k). My Dad is always aware of everything.
I even added 20k out of my money and I transferred 70k to my brother, I was left with 60k (becus she also sent me hair and I plan to sell it becus I already had enough). You can imagine this ungrateful idiot started insulting me, that I cheated him. the fool angrily withdrawn the money from his account and SET IT ON FIRE (70k). He called my elder sister and started warning her saying "if he can't receive the money henceforth, she should stop sending him money again that he's the man of the house".
My Dad gave him a resetting, resounding, hot and dirty slaps. He pulled out a knife, deflated my Dad's car tyres and ran away from the house.

Everyone is not happy. I don't want my brother to live a wayward life. He's 24 years old. Please nairalanders Help!

Nairaland / General / Late Billionaire Ogbuawa’s Third Wife Defrauds Stepsons Of N170.1million by BarristerNG: 4:47pm On Jul 17, 2020
How Late Billionaire, P.O Ogbuawa’s Third wife allegedly conspired with Police and Rogue Businessmen to defraud Stepsons N170.1million

Barely Five months after his unexpected death and before his burial, Two sons of late Anambra Billionaire and industrialist, P.O. Ogbuawa, have cried out over desperate moves by the last wife of the late billionaire, Mrs Amaka Ogbuawa to swindle the business empire the sum of 439,147 USD using the DPO of Nnewi Central Police Station and two Businessmen, Mr Nonso “NONSEC” Ukatu and Mr Augustine “AUSTINE MANUEL” Jideofor.

In a press statement signed by the two sons Uchenna Ogbuawa and Onyedika Ogbuawa and made available to BarristerNG, they raised alarm that their lives are at risk while narrating the humiliating ordeal they have been subjected to by their step mother using the DPO Nnewi Central Police Station and the duo of NONSEC and AUSTINE MANUEL.

THEIR STORY

Upon the sudden death of their father in February this year, they, as Eldest Children of the late Billionaire and surviving directors of the company took over the management of the company pending the Burial of their father in April.

Notwithstanding that their father died without a will and in their resolve to keep the peace of the polygamous family, they made sure every member of the family is well taken care of as their father was doing before his untimely death.

They successfully ran the business and maintained the peace of the family until June 2020 when they got a visit from the duo of NONSEC and AUSTINE MANUEL claiming that the late billionaire was owing a Chinese supplier, FANG DU, the total sum of 439,147 USD for supplies made to PO Ogbuawa and Son Nig Ltd and NONSEC is the sole representative of the Chinese supplier while AUSTINE MANUEL is the President of Nnewi Market Importers Association. The two men threatened to shut down the business empire if the sum is not paid immediately to the Chinese supplier through NONSEC.

At first, the two brothers didn’t take the threat serious until two full containers of imported goods belonging to PO Ogbuawa and Sons Nig Ltd was seized through the instrumentality of AUSTINE MANUEL and diverted to NONSEC’s warehouse.

In order to avoid disruption of business and not suspecting any internal betrayal, the two brothers summoned a meeting of the family with AUSTINE MANUEL and NONSEC. At the meeting, their stepmother vigorously supported NONSEC and AUSTINE MANUEL and claimed that the alleged debt to the unknown FANG DU was legitimate even without any document to prove indebtedness. The two brothers fearing disruption in the business and trusting their stepmother’s testimony of indebtedness agreed to offset the debt within two years. Upon the agreement and on the insistence of their stepmother, Amaka Ogbuawa, 100,000 USD was transferred to the personal Bank Account of NONSEC.

Immediately the sum was transferred to NONSEC, their Step Mother and the DUO of AUSTINE MANUEL AND NONSEC started harassing them to pay up the remaining sum without delay notwithstanding the two years payment agreement. This raised the suspicion of the two brothers and upon their investigation, they noticed an unusual connection between their step mother and NONSEC. They immediately sought the advice of a lawyer, who informed them that the agreement they had with NONSEC and AUSTINE MANUEL is illegal as they cannot offset any alleged debt incurred by the late billionaire until the estate of their father is settled with a letter of administration. Their lawyer also informed them that the only prove of indebtedness in the circumstances is to show appropriate documents of the debt and not by verbal testimonies. The Two brothers immediately conveyed their new knowledge to both NONSEC and AUSTINE MANUEL and hell was let loose.

POLICE HARASSMENT, HUMILIATION AND CRIMINAL PROSECUTION

Brandishing the agreement between them and the Ogbuawa Sons, NONSEC and AUSTINE MANUEL with the full support of Mrs Amaka Ogbuawa, procured the DPO of Nnewi police central police and got the official Bank account of the Ogbuawa and Sons Nig Ltd locked. Unable to access the money in the Official Account for the running of the business, the two son’s opened a new company account. They were thereafter arrested by the DPO of Nnewi Central Police Station on the instruction of NONSEC and AUSTINE MANUEL and accused of STEALING.

They were thereafter humiliated and paraded like common criminals before the general public at the police station. The policemen thereafter dragged the two brothers to ZENITH BANK and mandated them to sign a transfer form transferring millions of Naira to the personal bank account of NONSEC but the Bank Manager sensing fraud stopped the transfer after the policemen left with NONSEC.

The two Ogbuawa brothers were later charged to Nnewi Magistrate Court for the offence of stealing from themselves. The Charge reads;

“That you Uchenna Ogbuawa and Onyedikachi Ogbuawa on or before the month of April 2020 at Nkwo Nnewi in Nnewi Magisterial District did conspire with yourselves to commit felony wit: stealing.

“That being shareholders/officials of P.O. Ogbuawa and Sons Ltd on the same date and period in the same magisterial district, did steal the sum of N23 million meant for repayment of debt of N202, 007, 600 owed Fang Du represented by Ukatu by P.O. Ogbuawa and Sons Ltd.

The Presiding Chief Magistrate, N.S.E Uzuodu adjourned the case to August 21.

THREAT TO LIVES

The two sons of Ogbuawa, Uchenna Ogbuawa and Onyedika Ogbuawa also raised alarm that their lives are in real danger as NONSEC and AUSTINE MANUEL had boasted openly that if they do not succeed in sending them to prison, they will “waste” them.

They appealed to the Inspector General of Police, Anambra State Commissioner of Police, all security formations in the state, Igwe Dr KON Orizu 111, Igwe Oraeri and the people of Oraeri to take note of the disturbing development.

Popular Nollywood actress and comic actor, Funke Akindele has hired popular and fiery human right activist, Femi Falana SAN, to quash her conviction for breaching social distancing law of Lagos state government.

Akindele and her husband, popularly called JJC Skillz, on April 4, held a party at their residence with over 20 persons in attendance.

The duo later appeared in court charged with contravening Regulation 8(1)(a) and (b) and 17(1)(i) of the Lagos State Infectious Disease (Emergency Prevention) Regulations 2020, and therefore committed an offence under Section 58 of the Public Health Law Cap P16 Vol. 9, Laws of Lagos State 2015.

The law deals with the social distancing policy targeted at minimising large gatherings in the effort to contain the dreaded Coronavirus pandemic.

They two were thus sentenced to 14 days community service, besides other penalties, by Chief Magistrate Court 1 Ogba, Lagos.

Many lawyers criticized the conviction and contended that it will be quashed if it is challenged.

Nairaland / General / Police Humiliate And Disgrace Lawyer In Rivers, Collect N60k Bail From Clients by BarristerNG: 12:33am On Sep 18, 2019
How Omoku Area Command Police Humiliated and disgraced a Lawyer and Collected N60,000 bail money from his clients over civil matter

A Portharcourt based Legal Practitioner and a member of Nigerian Bar Association, Chukwudi S. Onyimah, Esq, has petitioned the commissioner of Police of police, Rivers State Command over humiliation he suffered in the hands of Policemen of Police Area Command, Omoku Rivers state.

The Lawyer’s Ordeal stated when he was brief by six farmers in ONELGA over an invitation to the police Area Command in Omoku. When he arrived at the Police Station from Port Harcourt, One CSP Elijah Eleke who was in charge of the division humiliated him and his client for the effrontery of his client to enter the police station with a lawyer.

The Police thereafter locked up the six clients and chased the lawyer out of the station. The police further refused to accept bail application of the lawyer.

According to a petition written to the Police CP, Rivers State by the Lawyer and copied to ICPC and other agencies, the lawyer, described how his clients was extorted 60 thousand Naira in bail money after the policemen initially rejected his pleas for bail.

Below is a copy of the petition from the Lawyer sighted by BarristerNG;

THE COMMISSIONER OF POLICE,

RIVERS STATE COMMAND,

STATE COMMAND HEADQUARTERS,

MOSCOW ROAD, PORT HARCOURT,

RIVERS STATE.

Sir,

THE PETITION OF C.S. ONYIMAH, ESQ. AGAINST CSP ELIJAH ELEKE, 2I/C AREA COMMANDER, OMOKU AREA COMMAND HEADQUARTERS AND SGT. MATTHEW NATHANIEL ON A CASE OF UNPROFESSIONAL CONDUCT AND CORRUPT PRACTICES

The above subject refers please.

I, C.S. Onyimah, Esq., legal practitioner of Agorondu & Agorondu and member of the Nigerian Bar Association, Omoku Branch hereby petition your esteemed office to convey my profound concerns and distaste on the very corrupt practices and unprofessional conduct of one of your men serving at the Omoku Police Area Command Headquarters as 2I/C Commander (2nd in Command), Mr. Elijah Eleke, a Chief Superintendent of Police (hereinafter referred to as CSP Elijah) and Sgt. Matthew Nathaniel; and to formally request investigation and appropriate disciplinary action whereof.
The very unfortunate and regrettable incident giving rise to this petition is hereunder set out as follows:
That on Friday 13/09/2019, six persons namely Mr. Emeka Ekwenze, Mr. Uche Duaka, Mr. Sampson Agworo, Mr. Ndubuisi Nnamdi and one Mr. Israel who are farmers living and farming in Umu-Ajie village in Ndoni District of Ogba/Egbema/Ndoni Local Government Area (ONELGA) (hereinafter referred to as my clients) were served with a police invitation on the instructions of CSP Elijah, to appear at the Omoku Police Area Command Headquarters on 14/09/2019 by 10:am in respect of an investigation of an alleged case of Conduct Likely To Cause The Breach Of The Peace. A copy of the invitation is herein attached.
I was contacted and briefed as their legal representative in respect of the invitation. Consequently, I advised them to honour the invitation and assured them of my presence to accompany them to the station as they requested.
When we got to the Omoku Police Area Command Headquarters on Saturday 14/09/2019 by 10:am, we had to wait for Matthew Nathaniel who is the Investigation Police Officer in charge of the matter (and hereinafter referred to as the IPO), as he was out of the station. We waited for about two hours.
The IPO arrived the police station at about 12:32pm. From my preliminary interaction with the IPO, he informed me that the complainant, an elderly man who was also present had alleged in his statement that my clients went to their farms on a day the villagers were customarily forbidden from going to the farm, which according to him amounted to conduct likely to cause the breach of the peace, hence their invitation to the Omoku Police Area Command Headquarters for a detailed investigation. My clients promptly refuted the allegation.
The IPO thereafter took the complainant to meet with CSP Elijah in his office. Few minutes later, the IPO came out. He invited my clients into CSP Elijah’s office. The IPO told me to my face before my clients that CSP Elijah has instructed that I should not be allowed entry to his office with my clients.
Perhaps (my thoughts) I needed to politely explain to CSP Elijah that I am the legal representatives of my clients and I came all the way from Port Harcourt in respect of his invitation, on my clients’ request.
As soon as I got into CSP Elijah’s office, he violently flared up, fiercely threatening to first deal with me physically before ordering my detention if I did not get out of his office immediately. He then descended on my clients for their effrontery in briefing and coming with a lawyer over the matter and ordered the IPO to lock them up in the detention cell.
He also instructed the officers in charge of the detention cells never to allow me access to my clients. I was asked to wait for my clients in court whenever the investigation is concluded. Thereafter, CSP Elijah drove out of the station after giving his orders.
I sought audience with the Area Commander whom I was told was not on seat that day, leaving me and my clients at the whims and mercy of CSP Elijah, the second in command.
I explained to the IPO that the allegation against my clients to which they have all individually refuted, was not even an offence but could at worst, be described as a purely civil matter or at best, a village matter that is usually resolved traditionally by the villagers; that even if it is true, it was not an offence known to law for which my clients could be detained. He told me he was only following the instructions of his superior, CSP Elijah.
When one of the relatives of my client arrived the station, I applied in writing for the release
or bail of my clients, but the IPO refused to receive my application letter for bail. I made efforts to submit the application to the office of the Area Commander even though he was not on seat, but the officers bluntly refused to receive anything from me. One officer Solomon on duty informed me that they have been instructed by CSP Elijah not to attend to or receive any letter from me. The Application for Bail is herein attached. I was helpless, stranded and frustrated as a lawyer.
Before leaving the station at about 5:47pm, I met the IPO again who then informed me that his boss, CSP Elijah has instructed him to discuss the bail of my clients directly with their relatives only.
He further informed me in the presence of my client’s relative (a lady pastor) that CSP Elijah has instructed him to demand Thirty Thousand Naira (N30, 000.00) on each of my six clients from their relative as bail money, she was also asked to provide four persons to stand as sureties before my clients would be freed from detention, otherwise, they would remain in custody and be taken to court whenever the police conclude with their investigation, however long it takes them. The lady objected to the demand and rather dared them to charge her brothers in court instead.
However, later in the night of same day at about 10.22pm, one of my clients, Mr. Emeka Ekwenze called me to inform me that he and the other five clients have just been granted bail after their relatives had paid the IPO the total sum of Sixty Thousand Naira (N60, 000.00) at the sum of Ten Thousand Naira (N10, 000.00) on each of them as the only condition to secure their freedom.
Sir, in the light of the foregoing set of facts, this petition most humbly prays your esteemed office to direct an investigation into the sets of facts contained therein, with a view to ascertaining the veracity of the foregoing complaint against CSP Elijah and the IPO, officers under your command, control and supervision and if proven, effect the following demands to wit:
Activate the appropriate machineries to ensure the application of adequate disciplinary measures and sanctions against them.
Any other official procedures deserving of the justice of this case in the circumstance, in accordance with police service rules and manual.
Sir, your kind and prompt response to this complaint and your taking appropriate action on the aforementioned demands thereof will assure me, my Chambers: Agorondu & Agorondu, the Nigerian Bar Association (particularly Omoku Branch), relevant anti-graft and human rights agencies and organizations, civil society bodies and ofcourse members of the general public who may later become seised of this matter, that the Rivers State Police Command under your leadership, superintendence and command does not and would not tolerate or condone any act of bribery and corrupt practices, police brutality, abuse of human rights and unprofessional conduct by officers under your firm watch, and that you do not shield or protect any errant officer from being sanctioned and or held accountable to face the law, if or whenever he commits any such infraction.
However Sir, if after ten days of the receipt of this petition, my complaint herein fails to get the attention and prompt action it deserves from your good self, I am determined and committed with the full backing of the law office of Agorondu & Agorondu (Omarunma Chambers) to pursue this matter to its logical conclusion including but not limited to further petitioning superior hierarchy of the Nigerian Police Force, involving the Omoku Branch of the Nigerian Bar Association, Independent Corrupt Practices and Other Related Offences Commission (ICPC), Nigerian Bar Association, the National Human Rights Commission and other relevant human rights agencies and organizations and ofcourse, enforcing the fundamental human rights of my clients in court to ensure that this matter receives the deserved attention, and that CSP Elijah is sanctioned and finally brought to book.
Commissioner Sir, it is the desire of every patriotic Nigerian that while we appreciate the good efforts of the Nigerian Police in fighting crime in the country, the incessant cases of police brutality and unprofessional acts of violence against young lawyers, the vexed issue of money for bail in Nigerian police stations and similar corrupt extortions from innocent Nigerian citizens, are reduced to the barest minimum. It could as well begin with this very case.

Please accept the assurances of my esteemed respects.

Yours in the hallowed temple of justice,

………………………

Nairaland / General / Revolutionary Magistrate: Imo State Should Learn From Ogun State - Lawyer by BarristerNG: 9:22am On Sep 16, 2019
I have restrained myself from commenting on this write up but decided to respond because everyone here is celebrating the Magistrate. Everyone in Owerri has been circulating and celebrating this Magistrate but when it’s time to appoint our own Magistrates, list will fly from Govt House and upstairs, Judges sons and daughters who have not moved a motion (even ex parte) before and house wives who has been nursing babes at home will make the appointment and you expect them to conclude a trial in a day. Seriously
Please abeg make I hear something jaree…a system gets what it deserve.

We have refused to tell ourselves the bitter truth. Every time we will be complaining. When it is time to send someone to the court of appeal, we will select the oldest amongst our judges and send, tomorrow we will want to be CJN or President of the Court of Appeal. If some chances comes now, no one will consider young names like Justice Orjiako, Justice Opara, Njaka etc. We are the architect of our own misfortune.

When was the last time we conducted an aptitudes test to select our Magistrate. When last did we appoint Magistrate here bases on merit, knowledge of the law and experience? Here if it is 10 chances, the slots will be shared and distributed even before the call for application. Who is deceiving who? Mr A will get one slot, Governor 4 slots, Justice B 2 slots Justice Y…1 slot, Justice K…1 slot etc.. and they can just bring any idiot of their choice and they will be appointed. It is here I heard that you learn on the job. Lol

Tomorrow we complain. Are we not tired of complaints?

When the next set of Judges will be appointed, before our own eyes, 65 plus old men and women with the help of affidavit (see Atiku v Buhari) will apply and will get short listed, house wives who have not practiced before will be appointed provided she is up to 10 years at the Bar. And we will all defend it depending on the side we are.

In 2014-2016, I was privileged to be a member of the NBA Owerri Executive and there was appointment of Judges. S.C. Imo, Esq was the Chairman. As required the list of the shortlisted candidates were sent to the Bar for her inputs. Of course, the Bar screened the list and made recommendations part of which was the rejection of some names considered too old and not too fit and proper. But what happened next?

Some of them still find their way to the bench and to result is what we all faces today. The result is that today we have judges that adjourn application for leave to serve a writ outside jurisdiction for more than 4 months, by the time the ruling is sluggishly delivered, the writ has expired and you are faced with another motion to renew the writ.

The consequences of that appointment is that we have a judge that adjourn ordinary divorce ruling (uncontested) for more than one year before judgment. Some people may doubt it but this is happening in our Imo State Judiciary today.

We cannot be doing the same thing everyday and expect a different result. You reap what you sow. This story of a Magistrate from Ogun state is a wake up call for us especially as we prepare for appointment to the bench soon.

My name is Mazi Udegbulem, Esq and I practice in Imo State.

Nairaland / General / Ebonyi’s New Law Disqualifies Police From Prosecuting Criminal Cases by BarristerNG: 9:11am On Sep 16, 2019
Ebonyi State has repealed all hitherto existing laws and procedures in the administration of criminal justice.

This followed the effectual commencement of a new law on Administration of Criminal Justice delivery, tagged: “Administration of criminal justice law of Ebonyi State, otherwise known as law 014 of 2019.”

The State Attorney General and Commissioner for Justice, Cletus Ofoke, made this known on Friday while briefing newsmen on the provisions of the new law.

According to Ofoke, who is also the Chairman, Ebonyi State Criminal Justice Sector Reform Committee, the new law was an adopted replica of the Administration of Criminal Justice Act of the Federal Government, which was assented to by President Muhammadu Buhari in 2015.
