My attention has just been drawn to a trending story in which I was quoted as allegedly disowning one brilliant Mr. S.A.Oguntuyi, counsel for Yusuf Pam, the second defendant in a case in which the EFCC (as FRN ) jointly charged ex governor of Plateau State, David Jonah Jang and the said Pam to a High Court in Jos over alleged fraud.

The statement credited to the EFCC spokesman, Mr Wilson Uwujaren (I had expected him to deny and disown this warped report of today’s court proceedings in Jos, Plateau State) alleged that I disowned S.A.Oguntuyi’s line of cross examination on behalf of the second defendant, Mr Yusuf Pam.With due respect, this is a dirty lie from the pit of hell. Nothing of the sort happened. Indeed, what took place as recorded by the court was the exact opposite of the tissue of lies Mr Uwujaren, who was not physically present in court, was fed with. THE NBA’S SELF-ADMISSION OF NOT BEING A JURISTIC PERSON AND HOW THE SUPREME COURT WAS NOT PROPERLY GUIDED IN WOME MOSES ESQ. V NIGERIAN BAR ASSOCIATION (2019) LPELR-46918 (SC)

Please pardon my inelegant title, perhaps I was rattled by my recent discovery that the Nigerian Bar Association (NBA) is surprisingly not a juristic person according to the body itself and the Supreme Court of Nigeria as held in the recent decision in Wome Moses, Esq. v Nigerian Bar Association (2019) LPELR – 46918 (SC).
Lest I am accused of lifting the court’s ratio in isolation of the facts and circumstances of the case and also for the purpose of clarity as well as undiluted understanding of the court’s stand point, I shall set out the non-contentious facts as follows:

The Appellant, a legal practitioner practicing in Port Harcourt was briefed by a member of a family to represent him in a case involving family land. The Appellant’s client lost at the High Court and he appealed but while the appeal was pending, the Appellant (Wome Moses) allegedly partitioned the family land and sold them by representing himself as the family lawyer without valid authority.
The disgruntled family petitioned the NBA Port Harcourt branch which culminated in a referral to the Legal Practitioners Disciplinary Committee which ultimately found the Appellant guilty and consequently recommended the Chief Registrar of the Supreme Court to strike his name off the roll of legal practitioners.

Sergent Shedrack Nwadike of FCID Alagbon has confirmed the detention of Clearing Agent, Mr Chinedu Clement who was this morning abducted as he was driving to work near Abulo Ado Lagos State.

A close associate of the clearing agent who spoke with barriserNG stated that the policemen are detaining Mr Clement on a “container clearing transaction” gone wrong between Mr Clement and one Amaechi Ejiofor, a Lagos based trader.

According to our sources, Mr Ejiofor is using the police to settle business scores as he had earlier dragged the custom agent to SFU Police station Ikoyi, where the policemen reportedly decline to entertain the matter because it is a civil business transaction.

Efforts to secure the bail of Mr Clement was rebuffed by Sgt Shedrack Nwadike claiming he has orders from above not to give bail.

Mr Clement is now being detained at the police cell in FCID Alagbon.

Notorious Alagbon Police officer, Sergent Shedrack Nwadike this morning led policemen from FCID Alagbon and abducted a lagos based clearing agent, Mr Chinedu Clement as he was driving to work at Abuloado area of Lagos state.

The Policemen reportedly waylaid the clearing agent and abducted him in a very violent manner.

According to a relation of the clearing agent who spoke with barristerNG.com, the policemen did not show any identity card nor an arrest warrant while abducting Mr Clement.

“We have not been able to reach him since his abduction as his phones has been unanswered”, a relation told barristerNG on phone.

Efforts are on to ascertain the situation and where about of Mr Clement.

Sergent Shedrack Nwadike, was in July 2019 dragged to a Lagos High Court by a business woman, Mrs. Babalola Damilola, who was abducted in similar manner and forced by Sgt Nwadike to pay Tens of thousands of Naira in bail fees. The case marked ID/8016MFHR/19 is before Justice Yetunde Pinheiro and is coming up for hearing on October 4 2019.

The NBA President, Paul Usoro SAN has advised a member diagnosed of Kidney sickness to seek help from his Branch of the Association as the National Leadership of the Association is unable to offer any help at this time owing to humongous debt left behind by former leaders of the Association.

The sick member, Mr Edmond Emekoba, is registered with the Abuja Branch of the Association. He approached the National Leadership of the Association for help as his doctors has advised him to raise the sum of Nine Million Naira for a kidney transplant in India. Mr Emekoba situation is said to be critical and the kidney transplant is needed urgently to save his life.

An aide to the NBA President revealed the NBA boss response to Mr Emekoba when the sick member sought the help of his branch to save his life.

The Abuja Branch of the Association has since initiated an Appeal for help on behalf of Mr Emekoba and members are contributing to save his life.

D.U Umeobika Esq, the lawyer, at the centre of the viral video showing FRSC officials and a Lawyer in a “brawl” has narrated his own version of the incident.



In a Chat with BarristerNG.com, the ex chairman of the Nigerian Bar Association NBA Aguata Branch, gave a very detailed account of his ordeal with the FRSC officials.



MY ORDEAL IN THE HANDS OF OFFICIALS OF THE FEDERAL ROAD SAFETY COMMISSION ON THE 21ST DAY OF NOVEMBER, 2018.
I am DAVID UCHECHUKUMEE UMEOBIKA, a Legal Practitioner of No. 23 Mercedes Avenue, Nkpor, Anambra State. I was called to the Nigerian Bar in October, 1987.
On Wednesday 21-11-18, I had the following cases in courts: – HOS/2C/2018 STATE V EKENE EZEABIKWA and MAG/57C/2016 C.O.P V TOCHUKWU NZEDIEGWU.
While the former is a manslaughter case at High Court Orumba South sitting at Umunze, the latter is an assault charge pending at the Chief Magistrate’s Court, Ekwulobia. I am for the defendants in both cases.
In the morning of the said date, I set out in the company of my colleague in chambers N.M. Okpala Esquire. We travelled in my car. My design was to drop my colleague at Ekwulobia Chief Magistrate’s Court, then proceed to Umunze.
Along the Agulu to Igboukwu road, I sighted men of the Federal Road Safety Commission (FRSC) on the road. I noticed their presence on the road after doing a bend on the road. Then I was going at about 60 kilometres per hour and I started slowing down on seeing them. I noticed that three of them were on the road. One Mrs Emesue was in front and others stood at some distances from her. That she had her two hands raised up and was right at the middle of my lane/side of the road. The place is at Oraeri in Aguata Local Government Area of Anambra State.
When I got to where she stood, I stopped the car, brought out my head from the car window and told her I was going to Court at Umunze. I had my black coat on. I also had my white lawyer’s collar (plastic) and bib on. When I said this to her, she stepped out of my course and I took it that she had allowed me to proceed on my journey. I then started moving the car again.
At this point and to my surprise she spoke raising her voice drawing the attention of others who closed in on my car which was moving very slowly. I drove the car slowly to the side of the road and stopped it. Three officials including the two Respondents came to my side of the car and demanded to have the key to my car. I was confused as to what they wanted to do and I repeated that I was going to court at Umunze and was late already. Then it was about 8.45 a.m.
It appears they were annoyed by my explanation and my failure to give them my car key.
Mr. I.P. Okonkwo one of the officials went over to the passenger’s rear seat (far side) of my car opened the door and jumped into the car calling me an idiot. My colleague N.M. Okpala occupied the front passenger’s seat. He turned and asked Mr. I.P. Okonkwo why he was calling me (an elderly person) an idiot. He retorted by saying that he would call me that again and in fact said to me a second time that I was an idiot.  N.M. Okpala Esq. then said to him that he was a fool. Mr. I.P. Okonkwo took offence and hit N.M. Okpala on his hand asking Mr. Okpala why he (Mr. Okpala) “a small boy” should call him a fool.
Immediately after, Mr. I.P.Okonkwo from the rear seat of my car reached for the key which was still in the ignition. He made to take it with his right hand. I blocked him with my shoulder, whereupon he gave me a fist blow on my right shoulder with his right hand. In a flash, Mr. I. P. Okonkwo again went for the car key and I still blocked him. Again he hit me with his fist on the right shoulder. At this point, I grabbed my steering lock and N.M. Okpala faced him and he jumped out of the car the way he jumped into it.
Almost simultaneously, Mrs. Emesue was pulling on my door trying to get it open and I held fast to the inner door handle of the car. In the process of her relentless pulls, the car handle (inside) got broken.
I was complaining about that when she made to take the car key from the ignition using her right hand while standing outside the car. Though I blocked her move, but she tore off a glass key holder with N.B.A written on it and the justicia symbol made on it. I bought it at the last N.B.A. conference at Abuja in August 2018 for N 2, 000 only.
I was then bitterly complaining about the conducts of the officials and while still seated in my seat in the car, Mrs. Emesue pulled the lapel of my coat and I lost one of the buttons of my coat. As if that was not enough, she held me up on my neck where I wore my collar and bib and pulled it roughly and real hard tearing the bib into two and breaking the plastic collar. Even this was not enough for her, she and Mr. I. P. Okonkwo moved about like mad jackals with Mrs. Emesue tearing at me at intervals and menacingly daring me to come down from the car. Mr. I. P. Okonkwo threatened to make me eat grass if I came down from the car.
I was all the while seated in the car and in terror as to what they would do next. At this point I have become thoroughly irritated also and I knew I needed to do something to stop them from getting me naked on the road.
I came down and brought with me my car steering lock intending to use it to ward them off from further attacks on me.
Even that did not deter them. Mrs. Emesue particularly continued her aggression on me and ended up shredding my coat. Even after shredding my coat, she continued her attack on me despite the belated pleas by her colleagues for her to stop her aggression.
When she tore my bib, one bit fell on the road and the other remained on the string used in tying it to my neck. I picked the one that fell on the road afterwards.
Thereafter, the most senior official there suggested that I drove my car while we all went to their Igboukwu office. When I made to go into the car, Mrs. Emesue jumped into the car and sat on the driver’s seat insisting still that I must bring the car key which I now had in my pocket. It took her colleagues about five minutes to persuade her to leave my seat.
At their office, the Unit Commander was away and we were taken to the office of the man in charge of operations. He asked my colleague and I what happened and we narrated our ordeal to him. He asked his men what happened and they gave their side of the story. They denied asking me for my car key, they said they asked for my driver’s license instead. Then Mrs. Emesue was holding my broken car key holder in her hand and I asked a question to the effect that if they did not ask for my car key and struggled to take it by force how come she was having my car key holder. She immediately pocketed the key holder and that was the last time I saw it.
At that time about fifteen officials of the FRSC entered the office with a cell phone which the said contained a video of what happened. They watched the video without showing it to us. After watching the video, they roared up calling us names, pouring invectives on us and saying unprintable things against lawyers generally. Only the man in charge of operations was calm.
Days later, when I had the opportunity of watching the video, I noticed that they only brought out an aspect of the encounter so as to give the impression that I was the aggressor.
After the uproar following the watching of the video by them had subsided, one of them declared that the matter must not end that day. The man in charge of operations said they were going to impound my car to await the return of the Unit Commander on Friday 23/11/18.
I resisted the move to impound my car, where upon he placed a call across to the Unit Commander who asked him to give me the phone and he did. The Unit Commander told me through the telephone to hand over my driver’s license and vehicle papers to the man in charge of operations and go with my car. I handed over to him my driver’s license, insurance papers, Roadworthiness certificate and the vehicle license. All the documents are originals. I also left my shredded wearing apparels with the official.
On 23-11-18,  my colleague and I went back to their Igboukwu office. We met the Unit Commander and narrated what happened to him. Thereafter he said they had reported a case of assault occasioning harm against me at the police station, Ekwulobia and that we were to go to Ekwulobia. Himself, two other officials, my colleague and I went to the police station.
There the D.P.O. listened to me and asked me to make a statement under caution. This I did. He granted me bail in my self recognizance and asked us to come back on Monday. He muted that the matter would be best settled amicably. I was at the police station on Monday but the D.P.O. was away. He left regrets.
On 4/12/18 the I.P.O. in the matter called me at about 9 a.m and informed me that the D.P.O. would like to interview us at 3 p.m same day. At 2.50 p.m on 4/12/18, I was at the Police Station Ekwulobia and waited till 5.00 p.m when the Igboukwu Unit Commander and Uzoma Enweluzo Esq. a lawyer with the FRSC, Awka arrived.
The D.P.O. wanted to know what next and the Unit Commander and the lawyer said that the Sector Commander at Awka and the officers at Abuja after watching the video clip said that I must be prosecuted for assaulting Mrs. Emesue.
The D.P.O. turned to me and I said I was ready to swallow the assault, insult and other losses I incurred if they wanted settlement, otherwise I knew I can pursue some of my rights infringed upon by the officials. The D.P.O. spoke to us at length and still suggested amicable settlement as the best option in the circumstances of the case.
At last the D.P.O. advised me to go to Awka office of FRSC and meet the Sector Commander. I eventually agreed to do so.
Outside the D.P.O.’s office I agreed with my learned friend Uzoma Enweluzo Esq. that I was going to go to Awka on the 6/12/18 to see the Sector Commander. On 5/12/18, in the evening Uzoma Enweluzo told me through the telephone that the Sector Commander said that he was not going to see me for anything; that I must be prosecuted. The same evening I called Mr. Francis Eban, the Unit Commander Igboukwu, who corroborated what Mr. Uzoma Enweluzo said.
At this point I informed Sir R.O. Ezenwosu the leader of Aguata branch of the N.B.A about what was going on. He later informed me and I verily believed him that he reached Mr. Uzoma Enweluzo who said there was nothing he could do to secure settlement out of court.
I have not been arraigned before any court.
They are still with my driver’s license and vehicle papers to my injury. I was not booked for any contravention. They did not even check my vehicle on 21-11-18 owing to the confusion brought about by the conducts of the two officials.
Rather than arraign me, they and their colleagues have resorted to making the video clip (which is inconclusive of my encounter with them) go viral in a design to bring me to disrepute.
My shredded coat, collar and bib are with the Police at Ekwulobia Police Station. I have also passed through mental torture, discomfort and inconveniences owing to the acts of the officials.
However, the most agonizing of the episode so far is the public statement made by Kunle Edun the Publicity Secretary of the Nigerian Bar Association. Without making any efforts to trace me and hear from me, Kunle Edun made the publication vilifying me. His publication came to me as a shock. It traumatized me. It sheered my heart like a red hot iron shaft.
I am particularly pained by the action of the Mr. Edun because the N.B.A. is an association I have belonged to for thirty one years and two months since my call to bar in October, 1987. I have also served the N.B.A. locally and nationally. Between 2008 and 2010 I was the secretary of N.B.A. Aguata branch. Between 2010 and 2012 I was the chairman of the branch. I had been chairman of the committee of Chairmen and secretaries of all the N.B.A. branches in Anambra State. I was a member of the N.E.C. of the N.B.A. for six years running 2008-2013. I have served in a number of national committees of the N.B.A. I believe that I am not a personality Mr. Edun would have had difficulties in tracing if he had made any effort.

A former Chief Judge of Enugu State, Late Hon Justice Innocent Umezulike who was buried months ago is among the Nigerian top dignitaries banned by President Muhammadu Buhari from travelling outside the country.

In a list published by the presidency, pursuant to Presidential Executive Order, Late Umezulike was listed among top Nigerian personalities under security watch.

It is unclear, whether the presidency is aware that the late Jurist is already resting in peace in his grave in Enugu State or whether the ban is intended to operate even from his grave.

This however is the not the first time the presidency will be listing dead Nigerians in its data as among the living. In December 2017, President Buhari appointed 8 dead people as Board members of government agencies and ministries.

A lagos based Engineer, Mr Stephen Chikwe has dragged KC GAMING NETWORKS LTD, the owners of popular football betting site, www.bet9ja.com to court over failure to pay him the sum of 9.4 million Naira he won during the 2018 world cup tournament.

Mr chikwe had staked various games during the tournament for individual games on 14th, 15th, 16, and 17th of June 2018 with redemption dates specifically stated for 18th and 21st June on the bet slip.

However, the gaming company, Bet9ja, changed the nature of the games, after Mr Chikwe had won the games, from being a single game bet to a tournament bet claiming they have the power to do so under their “terms and conditions”.

Mr Chikwe accused the defendant, Bet9ja, of fraud and fraudulent change of the terms of the bet after the bet has been closed and won and swore to fight for his win.

The defendant, Bet9ja had asked Mr Chikwe to accept the full refund of his staked sum and nothing more, an offer, Mr. Chikwe refused outrightly.

In the court case filed at Lagos State High court, with suit number, LD/28/3GCM/2018 made available to www.barristerNG.com, the claimant is asking the court for the following:

A declaration that the defendant cannot change the status of an already played bet from a single game to tournament.
A declaration that The Plaintiff is entitled to be paid all betting games that went in his favour.
AN ORDER OF The Honourable Court for The Defendant to Immediately Pay The Sum Of N9,466,772 (Nine Million four Hundred And Sixty-Six Thousand, Seven Hundred And Seventy two Naira) being sum won by game bets he placed with the defendant.
Interest of 25% per annum on the judgement sum from the date of filing this action till judgment and thereafter on the judgment sum at the rate of 10% per annum until the final liquidation of the judgment sum.

Other customers of the company who spoke to our correspondent complained of the company’s penchant for refusing payment of wins under the guise of their “terms and conditions” and praised Mr. Chikwe for his courage at challenging the fraudulent acts of the company.

Jonathan Gunu Taidi Esq, an aspirant to the office of the General Secretary of the Nigerian Bar Association, NBA,  has condemned the reported killings of innocent civilians in parts of Plateau state.



In a statement sent to the press, the Minna based legal practitioner bemoaned the failure of security agencies to bring the perpetrators to justice.
He further urged President Muhammad Buhari to rise up to the security challenge to stop further loss of lives and properties.




Information began to filter in yesterday that hundreds of defenceless Nigerians in parts of Plateau State were murdered in gruesome circumstances due to our perennial security deficit. This is indeed a very dark period given the frequency with which the lives of Innocent citizens are taken through unconstitutional means.
It is worrisome that, as usual, the perpetrators of this condemnable and dastardly acts have remained faceless, and have not been brought to justice. I commiserate with the entire people of Plateau State and Members of the various Branches of the Nigerian Bar Association who lost loved ones and pray for a peaceful repose of the souls of the victims. I must urge President Muhammadu Buhari to rise up to the challenge and redesign the security architecture of our country so that never again will the life of any citizen be lost in such gruesome circumstances.

The office of the Chief Justice of Lagos State has recently been receiving serious attention from the legal world and beyond.

The Chief Justice of Lagos State, Honourable Justice Opeyemi Oke, has been accused of unleaching unnecessary high handedness and untold hardship on her subjects.

A 2017 NYSC member took to his instagram handle @facedtruth2017 to condemn the acts of the chief judge and her refusal to pay their monthly allowances on the premise that they worked during the administration of her predecessor, Honourable Justice Atilade, hence not entitled to any remuneration.

He lamented that the monies wasted by the Chief Judge on frivolities could have been given to them to offset debt incurred while working for Lagos state government.


According to them,

It is so unfortunate that the Lagos state judiciary is in a mess with the advent of a new Chief Judge of lagos who does not really know that one of the features of government is that it is a continue process.

We the outgoing corp members of Lagos State Judiciary Ikeja, after working earnestly for the judiciary and we expect to be paid our monthly allowance as stated in our acceptance letter , the new chief judge refused to pay us stating that we worked under the administration of the former chief judge, Atilade and not hers so we are not entitled to any remuneration.

It is so regrettable that the CJ and all the Judges travelled to Switzerland and she was able to afford bags of rice for all the judges and renovate her office that was on standard condition before the former CJ vacated office but due to her fear of the Unknown either that the former CJ can use black magic on her, she demolished the building.

Our allowance is just N20,000 compare to what she would have spent on all the trips both local and international, since she resumed office it’s so unfortunate that the judiciary empowered to curb abnormality are the ones trending in the abnormality. Please pay us as some of my creditors are seeking the money borrowed from them to come to work…”

Also speaking to BarristerNG.com on condition of anonymity, a Lagos State Judiciary officer stated that Justice Oke demolished and renovated the CJs offices at Lagos and Ikeja at a whooping cost of 66milion.

The officer went further to state that the current Chief Judge has not paid any allowances owed during the tenure of her predecessor which ended in September 2017.

According to the judicial officer, the chief judge not only cancelled the valedictory court session of her predecessor but went further to seize vehicles from staffs who worked for the predecessor as against tradition.

Justice Oke was some months ago, sworn in as Chief Judge of Lagos State after the retirement of Justice Atilade.

The Nigerian Bar Association President, Mr AB Mahmoud SAN has weighed in the hijab Controversy generated by the refusal of the council of Legal Education to call a law student, Amasa Firdaus to Bar for refusal to remove her hijab prior to the call ceremony held in Abuja.



The law student, a Muslim by faith wore the religious head gear, which is not allowed for the call to Bar ceremony and refused to remove same notwithstanding entreaties, consequent upon which she was denied being called to the Nigerian Bar.

Reacting to the controversy, the NBA President tweeted a photo of her daughter being called to the New York Bar with her hijab on and said the controversy is needless.

The picture clearly show that the NBA President is in support of wearing hijab to the call to Bar ceremony and may be a subtle call for change of the call to Bar rules.

Professor Ojukwu began his career in 1985 when he simultaneously joined the services of Abia State University as an Assistant Lecturer and began to practice Law in the chambers of Chief G. N. Atulomah. In 1988, he left to establish with his friends, a Law firm named Eleuthera Chambers. He rose to the position of Dean of the Faculty of Law in Abia State University where he served from 1995-2001.


Professor Ojukwu has also been a very active member of the Nigerian Bar Association, with a tremendous record of service at the local, regional and national levels, and has at one time or the other held the following positions:

MAZI AFAM OSIGWE

Arguably the most popular and most loved lawyer of his generation, Mazi Afam Osigwe, The immediate past General Secretary of NBA is a household name within the Nigerian Bar Association political circle. He is rumoured to be nursing the ambition of replacing Mahmoud SAN as NBA number one.

Mazi Afam was the Publicity Secretary (PRO) of NBA Abuja, from 2006-2008.He became the Chairman of the Branch from 2010- 2012. He was a member of NEC from 2011 to 2013, he was also the Editor-In- Chief of the Unity Voice (the monthly newsletter of NBA Abuja) from 2011-2013. Under his able leadership the Unity Bar FC (the football club of NBA won both silver medal at the Football Tournaments at the Port Harcourt, AGC and Gold medal at the Abuja AGC respectively.

Bridget: APC Led government has been accused of human right abuses and disrespect to valid court Orders. What is your take on this?

Afam: My take on it is that every government that wants to fight corruption must also show an excellent respect for the rule of law. For the courts because the executive needs the courts to fight the war. The trials must take place in court and the same federal government goes to court to secure orders to detain People. So where the same court has given order that persons be released, the government must comply. El-Zakzaky and Dasuki are two sore thumbs in this regard. Detaining people for long periods of time without charging them to court, putting up news items, damaging people’s reputation, never apologizing, never charging them to court, to my mind are obvious cases of abuse of human rights. It speaks of the government as one that has scant regards for human rights of its citizens and a government must engender confidence in its ability to treat all manner of men fairly as well as its readiness to respect the rule of law. The government must respect the rule of law. If the government is not able to do that, it may also trigger a corresponding lack of respect for the law by the citizenry. And at the end of the day, the government will be the bigger victim of it. There may be break down of law and order. It may explain why people are continually taking the laws into the hands, meting out jungle justice, threatening the unity of the country, breathing fire and brimstone and engaging in all manner of brigandage. An unwillingness on the part of any government not only to respect the rule of law but to enforce it, ultimately leads to break-down of law and order. You her such things as ‘No election will be held in this state, and nobody dares try to conduct elections here”, “Oh, we will expel you from our own part of the country, if you don’t leave, we will do this”. And watch out, there may be killing associated with such things too because people feel that the government is not doing the right thing to stem the tide of lawlessness or to do the lawful thing. People lynch alleged thieves or kidnappers, communities go to war against one another, herdsmen kill people etc: nobody is investigated, nobody is brought to book. People feel that we are approaching the hobbesian state of nature where man has become wolves unto another because the government has not shown a firm commitment to fight this malaise in our society. So they are worrisome signals. Whether it be at the States. Not only federal government, so many states are also guilty of it. If you criticize them on Facebook, or social media, they trace you in any part of Nigeria and bring you to the state and arrest you, calling it all manner of names: Cyber Stalking, Criminal Defamation, and we should watch it because the level of intolerance by those in positions of authority is increasing. Even recently extending to an alleged order by a speaker of a state house of Assembly to his orderly to shoot Road Safety people on duty because they dared stop his wife’s car to book her about an alleged traffic violation. It is increasing and it can only get worse.



Bridget: What do you think is the way forward in the War against corruption?

Afam : If we fight a genuine war aimed at rooting out corruption from our society, we do the right thing, we put the Judiciary to very good use, we do lifestyle audit for those in public office, if your earning is one million Naira but you fly business class that cost millions of naira, your children attend schools where they pay thousands of dollars and it seems from your lifestyle, from your pay that you cannot sustain your lifestyle, it is a good starting point and we do this without fear or favour of who is involved and have an even-handed fight against corruption. We dwell more on the media mileage we get by talking and talking and pulling down institutions and if a court discharges and acquit anybody, we criticize it and make it look as if the judges have taken bribe, are deliberately sabotaging the war against corruption, lack a good knowledge of the law or are even “stupid”. Even in the absence of clear evidence to sustain such views, we criticize the judiciary for being the weak link in the fight against corruption. No person acres that proper and thorough investigation to sustain the charges were not carried out. Proper and thorough investigation should be carried out. Prosecutors should never rush to court until they have built up a good case. If we continue the total reliance on alleged confessional statement by suspects without doing a corresponding investigation to back up whatever statement were obtained, building up a case that can be sustained beyond reasonable doubt, increasing the forensic ability of our investigating agencies regarding this, we are wasting time. Of course you have to have the political will too, to appoint the right persons and give them institutional support and insulate them and fund them very well and make sure that those who also risk their lives in either investigating or prosecuting these cases are not only well remunerated but there is security of their lives as well as that of their properties.



Bridget: President Buhari has been away on medical vacation for more than 3 months. What is your assessment of the Acting President so far?

Afam: Well I think in the circumstances, the Vice President has done well but the uncertainty as to whether the president is returning any time soon we know will ham-strung him and it appears there are vested interest bent on seeing that the Acting President does not fully exercise the powers of that office. As I don’t want go into the realm of politics and I would rather wait to see what happens in the coming weeks. I think the president has been away for too long and if he is no longer capable of discharging the functions of his office, then something should give so that the nation will move forward. I don’t think it serves the society any good for us to have governors trooping down to London take pictures with the president just to prove that he is alive and well. If the president is really healthy as he is made out to be, the President should release a video recording speaking to Nigerians. We all get sick and some sicknesses may take longer than others to heal. If that is the case with the President, we want to know but if it is such that the President cannot discharge the functions of his office either as a result of old age or infirmity of the body or the mind, especially of the body, then the nation should not be held down. We should be able to move forward because having an Acting President means that there are certain decisions he may not want to take without clearing with the President. And if it is in doubt whether the President is in such a situation as to discuss these problems and be able to proffer solutions and reach an agreement with the Acting President, we will also have a problem in that regard because it means that some of these decisions may not get taken or some persons may purport to be conveying the position of the President actually be exercising presidential power by proxy notwithstanding that we have an Acting President. This is also a very big problem and could give room for mischief and will slow down governance. There is no way an acting President who finds himself in this kind of situation would be able to do much or would be able to at least do as much as he would do if the extent of his powers are fully utilized.
