Politics › There's No Legal Or Constitutional Basis For Saraki To Resign - Mike Ozekhome by BeeBeeOoh(op): 11:30am On Aug 03, 2018 |
Constitutional Lawyer and Human Rights Activist, Chief Mike Ozekhome has averred that there is no legal or constitutional basis for Dr. Bukola Saraki to resign as Senate President because he defected from the All Progressives Congress (APC) to the Peoples Democratic Party (PDP).
Ozekhome in his intervention on the recent gale of defections in the polity said Saraki would not lose his seat for defecting to the party. According to him, in line with the provision of Section 68 (1) (g), the 1999 constitution of the Federal Republic of Nigeria (as amended) permits a legislator to cross carpet if a division, factionalisation or merger has occurred in his party. “In the case of APC, 24 states held parallel congresses before the national convention. Can there be any better or stronger evidence of a division in a party? I think not. To add to the gravity of this internal implosion and vertical and horizontal schism, a new wing, r-APC emerged from the APC at the national level. It is headed by no less a person than Buba Galadima, a tested political strategist, Buhari's right hand man and former Secretary of Buhari's CPC”, Ozekhome said. The constitutional lawyer argued that despite the dismissal of the R-APC by the APC leadership, the Pandora Box was eventually opened with the defection of three governors, many Senators and Members of the House of Representatives. According to him, all the legislators, including Dr Bukola Saraki, are constitutionally covered and immune from removal from office, because their APC party is eventually irredeemably broken into smithereens and totally factionalized. He enthused that by virtue of constitutional provision, Saraki and Yakubu Dogara, Speaker of the House of Representatives (who is also likely to defect), can only be removed by two-thirds majority of the lawmakers. “In the case of the Senate, that is a humongous 73 Senators, and a whopping 240 members of the House of Representatives to remove Dogara. That is an impossible task under the present circumstances even if this corrupt government that feigns anti corruption war promises all the oil blocks and automatic tickets to the legislators”, Ozekhome said. https://www.dailytrust.com.ng/no-legal-or-constitutional-basis-for-saraki-to-resign-ozekhome-264077.html

Politics › Saraki, Tambuwal, Others Defection Unconstitutional - Falana by BeeBeeOoh(op): 6:14am On Aug 03, 2018 |
Human rights lawyer, Femi Falana, SAN, has faulted the defection of Senate President, Dr Bukola Saraki; Governor Aminu Tambuwal of Sokoto State, his Kwara State counterpart, Abdulfatah Ahmed, from All Progressives Congress, APC, to Peoples Democratic Party, PDP, saying, it was unconstitutional.
This is even as foremost constitutional lawyer and human rights activist, Chief Mike Ozekhome (SAN), condemned call by National Chairman of APC, Adams Oshiomole, that Senate President, Saraki, should resign as President of the Senate, after defecting from the APC to the PDP.
Falana’s position came barely 24 hours after Tambuwal and 48 hours after Saraki, Ahmed and 23 lawmakers in the state defected from APC to PDP
Falana, who faulted their action on the sideline during unveiling of Nobel laureate, Prof. Wole Soyinka’s new book, entitled ‘Who keeps watch over the watchman,’stressed that as stipulated in the 1999 constitution, there was no crisis in the APC to warrant their defection from the party to PDP.
He said: “1979 and 1999 constitutions have prohibited cross-carpeting on the ground that you are cheating or shortchanging the electorate. And that was stated under section 68 1 (G) of the constitution.
“The only provision is that if your political party is in trouble and is fractionalized, major division, you can cross over, but not a division instigated for the purpose of exiting, no.
“So if you are elected on the platform of party A you don’t want that party again, you must go and seek fresh mandate on the platform of your new party.
Meanwhile, Chief Mike Ozekhome (SAN), has condemned call by Oshiomhole that Saraki should resign as President of the Senate.
Ozekhome in a statement made available to newsmen yesterday, said: “In law, there is no legal or constitutional basis for Dr Bukola Saraki to resign or be removed as President of the Senate and Chairman of National Assembly for defecting from the APC to PDP.”
He further explained that “the first point to make here is that section 68(1) of the 1999 Constitution provides inter alia, that any member of the 109 Senators and 360 members of the House of Representatives who loses his Nigerian citizenship, or is made a minister, or decamps from his political party to another party AUTOMATICALLY loses his seat. https://www.vanguardngr.com/2018/08/saraki-tambuwal-others-defection-unconstitutional-falana/

Politics › Defections: God Will Continue To Fish Out Bad Eggs Among Us - President Buhari by BeeBeeOoh(op): 8:35pm On Aug 02, 2018 |
President Muhammadu Buhari on Thursday asked supporters of the ruling All Progressives Congress not to be disturbed by the recent gale of defections from the party.
He said, “God will continue to fish out the bad eggs among us,” as the country approaches the 2019 general elections.
According to a statement by his Special Adviser on Media and Publicity, Mr. Femi Adesina, the President spoke at the commencement of the campaign rally for the Bauchi South Senatorial District bye-elections and the formal presentation of APC candidate, Gumau Yahaya, for the August 11 poll.
He assured party supporters in Bauchi that his administration will continue to work hard to surpass its campaign promises for a better Nigeria.
The President Buhari told the rally that the APC-led government had remained faithful in implementing its campaign promise of improving the economy, securing the country, and the fight against corruption.
He said, “The work we are doing is because of God, our country and you. I want to inform you that the knowledge we have garnered over the years, we won’t allow you to be cheated.
‘‘Like we promised, what will determine a good future for the country are security, strong economy and to stop corruption.
“We campaigned on these things, you voted for us and we will never forget.”
Endorsing the APC candidate for the senatorial bye-election, the President who was accompanied by the party Chairman, Adams Oshiomhole, Governors of Bauchi, Plateau, Kano and Imo States, and other party officials said, “we have confidence in him and we trust him.”
He, therefore, urged the people of Bauchi South senatorial district to vote Yahaya in the upcoming election.
The President also thanked the people of Bauchi for defying the heavy rainfall and coming out en masse to welcome him and show solidarity to the party’s candidate in the Senatorial election. https://punchng.com/defection-god-will-continue-to-fish-out-bad-eggs-among-us-buhari/

Politics › Any Attempt To Impeach Saraki Will Be Resisted - Tambuwal Says by BeeBeeOoh(op): 7:28pm On Aug 02, 2018 |
…Saraki, Ortom, Kwankwaso, others, attend PDP NEC Meeting
…As NEC approves amendment of rules to accommodate Not-Too- Young-To-Run ActBy Dirisu Yakubu ABUJA-Sokoto State governor, Aminu Tambuwal has warned against any illegal attempt to effect a change in the leadership of the National Assembly, warning those bent on impeaching Senate President, Bukola Saraki to perish the thought.
Tambuwal who stated on Thursday at the 81st National Executive Committee (NEC) of the Peoples Democratic Party (PDP) noted that any recourse to illegal impeachment would be matched by an equal force of resistance.
Berating the state of affairs of the nation under the All Progressives Congress, APC-led administration, Tambuwal said when Nigerians trooped out enmasse to elect the current government more than three years ago; they expected a robust democracy where they would be free to hold contrary political opinions without fear of harassment.
“Only about three days ago, I did say that Nigerians will not accept prison-yard democracy; a situation whereby people would be simply framed up on account of disagreement in terms of political leanings, is unacceptable. And we cannot afford to allow our country to drift further. It is not about any interest, it is about this country. This country is on a cliff. We must retrieve it, we must position this country and restructure it for the benefit of Nigerians. “When they talk about cross carpeting, I began to wonder. When I cross carpeted the other time, did they complain? When I hear that some people are trying to break into the chambers of the Senate to steal the mace and install a pseudo President of the Senate, I wonder whether they actually know the rules of our democratic engagement. It’s not a Gestapo. We are in democracy. “The constitution of this country is very clear that members of the Senate and the House of Representatives can choose from among themselves their own President of the Senate or Speaker (of House of Representatives) without leaning to any political party. https://www.vanguardngr.com/2018/08/attempt-to-impeach-saraki-will-be-resisted-tambuwal/

Politics › Umahi Bars APC From Using Abakaliki Stadium For Rally On Saturday.. by BeeBeeOoh(op): 4:24pm On Aug 02, 2018 |
Ebonyi State Governor, David Umahi, has barred members of the All Progressives Congress, Ebonyi State Chapter, from using the Abakaliki Township Stadium as venue of its rally scheduled to hold on Saturday.
Umahi, who spoke through his Chief Press Secretary, Emmanuel Uzor, made the assertion on Thursday while addressing members of the State Chapter of the Sports Writers Association of Nigeria during a courtesy visit.
He announced that the stadium was undergoing reconstruction work, including asphalting of the entire premises and installation of floodlights.
“I urge the opposition All Progressives Congress in the state to look elsewhere for its proposed rally slated for Saturday.
“The Abakaliki Stadium it vowed to use for the rally is still undergoing reconstruction and renovation,” the governor said.
Continuing, he said, “Abakaliki Stadium, as you all know, has been under reconstruction and as I am talking to you, the asphalt work at the back of the stadium is ongoing and the illumination of the floodlight and the popular stand are ongoing too.”
The Governor reiterated that any political activity in the stadium, especially by a particular party that is divided along different factions, will jeopardise the construction work in the stadium.
“We believe in accommodating all the different voices, especially different parties in the state.
“We don’t want to stifle any opposition. Any opposition with credible integrity that wants to do anything is free to do it; but as for the stadium, you’ll notice for some time that even the state government has not done anything in the stadium because of the work going on there”
“So, I want to use this opportunity to tell the faction of the APC to start looking for an alternative.
“Of course, they have their own stadium at Nkwegu Ugballa Grand Arena. The rally can be held there.”
It would be recalled that a faction of the APC in Ebonyi State has announced that it would hold a mega rally this weekend at the stadium to map out strategies and educate its members ahead of the forthcoming 2019 general election.
Umahi returned to the state on Wednesday after a two-week investment tour of China geared towards showcasing the economic potentials of Ebonyi State and to also woo foreign investors. https://punchng.com/umahi-barrs-apc-from-using-abakaliki-stadium-for-rally/

seunmsg: Brilliant analysis from prof. Itse Sagay. A division occurs in a party once there is a parallel faction irrespective of whether inec recognises the faction or not. And I also support the idea of allowing political office holders to join whatever party that appeals to them. Their should be no legal restriction for an elected or unelected politician to move from one party to another. The people should be allowed to decide their case during election. Do you have anything to say concerning Saraki's defection? |

Politics › "We Are Concerned With 2019 General Elections" - APC To Defectors by BeeBeeOoh(op): 10:54am On Aug 02, 2018 |
The All Progressives Congress (APC) has said that its priority for now is about the 2019 general elections, not the defections of its members to the Peoples Democratic Party (PDP).
Sokoto State Governor, Aminu Tambuwal, yesterday dumped APC for PDP.
Tambuwal’s defection came 24 hours after the Senate President, Dr. Bukola Saraki, Kwara State governor, Abdulfatai Ahmed and some others defected from APC.
The defection of Tambuwal has brought to three, the number of APC governors that have defected from APC in the last one week.
Also, 14 Senators and 36 House of Representatives’ members of APC had defected to PDP and other opposition parties.
But reacting to the sundry defections of APC members, the party, in a statement by its Deputy National Publicity Secretary, Yekini Nabena, said that the APC was neither surprised nor disturbed by the defections.
Nabena said: “The defection of Senate President Bukola Saraki; Governors Abdulfatah Ahmed and Aminu Tambuwal of Kwara and Sokoto states respectively; National Publicity Secretary, Mallam Bolaji Abdullahi; and others, to the opposition PDP neither surprises nor distracts the APC. Every follower of events in recent times could decipher the signs that foretold the exit of Saraki, Tambuwal, Ahmed, Abdullahi, from our great party.
“We thank them for their contributions to the APC for the period they were with us. We also salute their courage to openly declare where they belong, as we had always advised.
“APC is a party founded and run on the principles of freedom, sincerity, and forthrightness. Saraki and the others have the freedom of association and the right to pursue their political ambitions wherever they deem fit.
“Our advice and hope is that those who have left should also have the courage to inspire in their respective political environments the atmosphere of unencumbered freedom created by the APC, which enabled them to leave without let or hindrance.”
Expressing indifference on the defectors, APC said: “As a party, our attention is on the matter in hand, the 2019 general elections. We are united and focused, with an eye to continuation of our winning streak in all elections this year, next year, and beyond. And we will win!
“To our members in Kwara, Sokoto and the other 34 states of the federation and the Federal Capital Territory (FCT), remain steadfast and courageous. Encourage one another in our streets, teeming with APC members and supporters from North to South, and East to West.” https://newtelegraphonline.com/2018/08/apc-to-defectors-were-concerned-with-2019-elections/
