Politics › NJC Dismissed N25m Bribery Petition Against Justice Ademola, Official Says by BeeBeeOoh(op): 6:13am On Jan 19, 2017
An official of the National Judicial Council, Mr. Eugene Odukwu, said before a High Court of the Federal Capital Territory, Maitama, on Wednesday, that a petition accusing a judge of the Federal High Court in Abuja, Justice Adeniyi Ademola, was dismissed by the council.

Odokwu, who is the Director of Administration of the NJC, said this while appearing as the fourth prosecution witness in the ongoing joint trial of Justice Ademola; his wife, Olabowale and a Senior Advocate of Nigeria, Mr. Joe Agi, on charges bordering mainly on receiving of gratification.

The said petition in question was sent to the NJC, by a former Director, Pension Accounts Office of the Head of Civil Service of the Federation, Dr. Sani Shaibu Teidi, alleging that Justice Ademola demanded N25m as bribe from him while standing trial before the judge in 2013.

The petition was signed by Teidi’s wife, Fatimah.

Teidi’s trial before Justice Ademola in 2013 had to do with his (Teidi’s) alleged involvement in pension scam.

It was alleged in the petition sent to the NJC that Justice Ademola attempted to obtain N25m as gratification from Teidi as condition for granting him bail in the course of the trial.

Following the raid on Justice Ademola’s residence by the operatives of the Department of State Services on October 7, 2016, the Federal Government filed 16 counts bordering mainly on receiving of gratifications, against the judge, his wife and Agi.

In one of the 16 counts preferred against the defendants, Justice Ademola was accused of attempting to receive gratification from Teidi.

The NJC official, Odokwu appeared in court as the fourth prosecution witness to tender documents in the custody of the council on Wednesday.

The witness tendered among others, the Certified True Copy of the proceedings of the council on the petition and the CTC of the report of the NJC in respect of its findings on Teidi’s allegation.

He responded “yes” when asked under cross-examination by Agi’s lawyer, Mr. Jeph Njikonye, that the petition on Teidi’s allegation had been dismissed by the NJC.

Also at the Wednesday’s proceedings, a Deputy Chief Registrar of the Litigation Department of the Federal High Court, Abuja, Mrs. Christine Ende, appeared as the fifth prosecution witness called upon to tender documents in the court’s custody.

The documents she tendered were in relation to the suit with number ABJ/CR/82/2013.

They were the CTCs of the charge, the amended charge, the motion for bail, ruling on bail application, motion for variation of bail conditions, and ruling refusing variation of bail conditions with respect to Teidi’s case.

Earlier, a former legal assistant to Justice Ademola, Mrs. Ojima Etuh, had also, under cross-examination, confirmed that the petition on Teidi’s allegation was dismissed by the NJC.

Etuh, who appeared in court as the third prosecution witness had maintained that she neither received nor laundered gratification for the judge.

Narrating how she knew Agi, Etuh said she knew the senior lawyer as Justice Ademola’s lawyer who had in the past defended the judge at the NJC.

Under cross-examination by Agi’s counsel (Njikonye), the witness confirmed that it was a petition by Teidi’s wife that was the subject of the case in Agi defended the judge before the NJC.

She added that when she was invited by the DSS, she told the interrogators that she did not know any case of gratification between the judge and Agi.

She also said she never received any gratification on behalf of Justice Ademola.

The prosecuting counsel, Mr. Segun Jegede’s attempt to call the sixth prosecution witness was objected to by defence lawyers on Wednesday.

The defence lawyers argued that the witness, one Malik Olatunde, an official of Guaranty Trust Bank, could not begin his testimony while his written statement made to the DSS had not been made available to the defence.

The trial judge, Justice Jude Okeke adjourned the trial till January 30 for ruling on the defence lawyer’s objection.

Business › We Simply Can't Allow The Naira To Float - Osinbajo by BeeBeeOoh(op): 5:50am On Jan 19, 2017
.....Says economic recovery programme to be launched next month

Tobi Soniyi in Abuja and agency report

Vice-President Yemi Osinbajo has the government cannot simply allow the naira to float, but admitted that the Central Bank of Nigeria (CBN) has confidence in floating the local currency.

Speaking at the World Economic Forum (WEF) in Davos, Switzerland yesterday, Osinbajo said the government is in talks with the CBN to fully implement the “free-float” foreign exchange policy, but it cannot put a time on the “logical conclusion” of the talks.

“It is difficult to give a timing about currency movements as you can imagine, but what it is really is that what is the policy that is going to lead to that?” Osinbajo, according to The Cable, asked.

“We already have a foreign exchange policy. Now, that policy, that is the point I have been making all along, that stabilising that policy, ensuring that it works fully, is really what we are trying to get to, in our interactions with the central bank, which of course is independent.
“We are trying to get them to see that you need to implement this policy fully. central bank of course has its own constraints; we have to be careful.

“We simply can’t allow the currency to float; we have to look at all of the market conditions and all of that. But really, the point we are making is that we must create the environment which will help the central bank as well.

“That will come from an increasing supply of dollars from oil exportation. Once we have more dollars, central bank obviously has more confidence in floating the currency.”
Osinbajo also said the government would launch its economic turnaround plan in February 2017, which would span another four years.

“We would formally launch the four-year economic recovery approved plan in mid-February,” he said.

“We’ve already written it out, many parts of it…we are discussing, but it would be formally launched as a document in the middle of February.

“But our 2017 budget is actually based on the economic recovery approved plan. We had strategic implementation plan, which we started with in 2016. The economic recovery approved plan is actually a development of the strategic implementation plan.”

Osinbajo also disclosed that the federal government would tap into Nigeria’s huge pension fund to finance infrastructure in the country.
A statement by his Senior Special Assistant on Media and Publicity, Mr. Laolu Akande, said the vice president made the disclosure at the WEF.

He noted that the President Muhammedu Buhari administration was “committed to investing more in infrastructure,” than in previous times.
Osinbajo disclosed that the government was working on how to tap into Nigeria’s huge pension fund to finance infrastructure in the country.

To do this, he stated that “we have to first derisk” such financing models for infrastructure.”
Osinbajo also declared that investment in people, in their skills and in youths would transform the African continent.

The vice president said empowerment of Nigerians was at the heart of the Social Investment Programmes of the Buhari administration.
He said the programme also had a social welfare component to help the people survive as they were being empowered.

Akande said the vice president participated and spoke in several events yesterday including a packed international Business Interaction Group of investors focused exclusively on Nigeria.
He also spoke at a panel of Building Africa, joined by Rwandan President Paul Kagame, and televised live by the CNBC Africa.

Asked to mention what kind of radical ideas that could advance the African continent, Osinbajo gave the example of the federal government’s Social Investment Programme where he said, for the first time half a trillion naira was being budgeted by the federal government for Social Investment Programmes.

“It is about investment in people, in their skills, in youths, that we have a N500 billion allocation in our budget last year and proposed for this year also,” he explained.

Referring to N-Power scheme’s training component for young graduates, and non graduates in artesanal and industrial middle-level skills, the vice president said it was an investment in education and educating large numbers of people in a short time.

“It is a radical thing to make that kind of serious investment in education,” he added.
He also referred to the planned N100,000 supporting grants to students of higher institutions in Science, Technology, Engineering and Maths, (STEM).

An active engagement with, and encouraging the private sector, he said, was also of a great deal, referring to the example of the 650,000bpd refinery project of the Dangote Group, which is going to be the largest single-line refinery in the world.

He said the Buhari administration was very confident about the recovery of the Nigerian economy,
Osinbajo said: “It is not difficult to get out of where we are if we understand why we are where we are.”

He reminded his audience that the Nigerian economy remained indisputably the biggest in terms of size of the economy.

Speaking at the Buisness Interaction Group attended by several international and local investors and business interests, and hosted by the Nigerian delegation, the vice president said that the newly developed Economic Recovery Growth Plan of the Buhari administration had been specifically designed to take the country out of recession and in the long term, continue to grow the economy.

Politics › Frozen Account: Court Fixes Patience Jonathan's $200m Suit For February 13th by BeeBeeOoh(op): 9:13pm On Jan 18, 2017
A Federal High Court Lagos on Wednesday fixed Feb. 13 to hear a suit by ex-first lady, Patience Jonathan against the EFCC seeking to unfreeze her account.

Also joined in the suit are; Skye Bank Plc, and a former Special Assistant to ex-President Jonathan, Waripama-Owei Dudafa.

Others include Pluto Property and Investment Company Ltd, Seagate Property Development and Investment Company Ltd, Transocean Property and Investment Company Ltd and Globus Integrarted Service Ltd.

The ex-first lady is demanding the sum of $200m from the commission as damages for infringing on her rights.

She also prayed the court to issue an order discharging the freezing order, as well as restrain the EFCC and its agents from further placing a freezing order on the said accounts.

At the resumed hearing of the case on Wednesday, Jonathan’s lawyers, Chief Ifedayo Adedipe (SAN), sought for an adjournment to enable him serve his client’s amended claims on the companies.

He added that other defendants had been served with copies of the processes, while they have also served their counter-affidavits on the plaintiff.

In the absence of any objection from the EFCC’s counsel, the matter was eventually adjourned to Feb. 13 for further hearing.

In an affidavit in support of Jonathan’s suit and deposed to by one Sammie Somiari, he avers that on March 22, 2010, she (Jonathan) had opened five different accounts with Skye Bank, with the aid of one Damola Bolodeoku and Dipo Oshodi.

He averred that the account mandate forms were duly completed and signed by her.

Somiari stated that Jonathan subsequently discovered that apart from one of the accounts that bore her name, the other four accounts were opened in the name of four companies which belonged to Dudafa.

He also averred that she observed that the ATM cards of the said accounts were issued in the names of the companies, adding that she complained to Dudafa, who promised to effect the necessary changes.

He said Dipo Oshodi also promised to effect the necessary changes.

According to Somiari, Jonathan is not a director, shareholder or participant in these companies and the funds in the said accounts are solely owned and operated by her.

“Dudafa does not own any part of the funds in the said accounts’’.

According to the deponent, the Skye Bank official, (Oshodi) did not affect the instructions of the plaintiff to change the name of the said accounts to her name, in spite of repeated request.

He averred that notwithstanding the refusal of the bank to effect the necessary changes, she had been using the said ATM cards without any interference.

The deponent averred that sometimes in July, Jonathan discovered that the ATM cards were not functioning, and immediately contacted the bank which informed her that a “No debit/freezing order’’ have been placed on the accounts.

He also averred that on further enquiry, the bank informed her that the accounts were frozen on the directive of EFCC as a result of ongoing investigation in relation to Dudafa.

Jonathan, therefore, contends that she was never arrested or invited by EFCC prior to the freezing order placed on the accounts.

She further contends that the freezing order on her funds by the directive of EFCC without an order of the court is unlawful and illegal.

Consequently, Jonathan is also seeking an order of court, directing the unfreezing of her account forthwith. She also wants an order restraining the EFCC from taking further steps in relation to the said accounts pending the determination of the suit.

Politics › We Will Use Pension Funds For Infrastructure - FG.. by BeeBeeOoh(op): 9:05pm On Jan 18, 2017
The Federal Government is working on "how to tap into the huge pension fund to finance infrastructure in the country," Vice President Yemi Osinbajo disclosed at the World Economic Forum holding in Davos, Switzerland on Wednesday.

His Senior Special Assistant on Media and Publicity, Laolu Akande, in a statement, quoted him as saying "To do this, we have to first de-risk such financing models for infrastructure."

Osinbajo cited President Muhammadu Buhari's administration's Social Investment Programme as a radical idea that could advance the African continent.

He told the panel that beyond welfare of Nigerians, their empowerment was at the heart of the N500 billion Social Investment Programme.

"It is about investment in people, in their skills, in youths, that we have a N500bn allocation in our budget last year and proposed for this year also. It is an investment in education and educating large numbers of people in a short time. It's a radical thing to make that kind of serious investment in education," he stated.

He cited the N-Power scheme's training component for young graduates and non-graduates in artesian and industrial middle-level skills as well as the planned N100,000 grants to students of higher institutions in Science, Technology, Engineering and Mathematics.

Speaking at the panel of “Building Africa” where he was joined by Rwandan President Paul Kagame, Osinbajo said the Federal Government "is committed to investing more in infrastructure than in previous times by ensuring that 30 percent of the budget goes into capital expenditure."

The vice president, who said an active engagement with the private sector was also of a great deal, cited the Dangote Group's 650,000bpd refinery project.

Osinbajo, who said the government was confident about the recovery of the economy, was also quoted as asserting that the Nigeria's economy remained the biggest on the continent.

"It is not difficult to get out of where we are, if we understand why we are where we are. The Nigerian economy remains indisputably the biggest in terms of size of the economy," he said

At the Business Interaction Group attended by several international investors and business interests hosted by the Nigerian delegation, Osinbajo said the newly developed Economic Recovery Growth Plan of the Federal Government was designed to take nation out of recession and continue to grow the economy.

The vice president also stated that the planning of the 2017 budget was based on the Economic Recovery Growth Plan which, according to him, will be formally launched next month.

Politics › We Have Evidence Justice Ngwuta Corruptly Enriched Himself - FG by BeeBeeOoh(op): 11:57am On Jan 18, 2017
The Federal Government said on Wednesday before a Federal High Court in Abuja that it had the evidence to prove its case of corrupt enrichment against a Justice Sylvester Ngwuta of the Supreme Court.

Lead prosecuting counsel, Mr. Charles Adeogun-Philips, said this in his opening remarks before calling the first prosecution witness on Wednesday.

The Federal Government is prosecuting Ngwuta on 16 counts, including money laundering and others relating to fraudulent obtaining of multiple passports.

Justice Ngwuta was among judges whose houses were raided by the operatives of the Department of State Service on October 7, 2016.

The security agency said it recovered large sums of money from Ngwuta’s house during the raid.

In his opening speech on Wednesday, the prosecutor said the case filed against the Justice of the Supreme Court “chronicles corrupt enrichment, violations of the money laundering laws of our land, passport fraud, and an attempt to obstruct justice by a judicial officer”.

Adeogun-Philips said, Justice Sylvester Ngwuta, “controlled” over N500m between January and October 2016 when his total legitimate earnings, including his allowances, for the year was only about N24m.

He alleged that, from the N500m, the apex court justice transferred dollar equivalent of N313m cash in $100 bills to a building contractor within the period of nine months spanning between January and September, 2016, to “develop several landed properties” for him.

He explained that earlier in 2015, the defendant, within a period of one month, made various cash payments totalling $180,000 to the building contractor.

He also alleged that during the raid on the defendant’s Abuja house by the operatives of the Department of State Service on October 7, 2016, total sums of N38.358m, $319,596 and £25,915 were found in his possession.

He said the Justice of the apex court has no satisfactory explanation for the huge sums of money he was found to have controlled within the year as it is in excess of his legitimate earning.

The trial judge, Justice John Tsoho, has accepted written copy of Adeogun-Philips’ opening speech.

The prosecution is about to call its first witness as of the time of filing this report.

Crime › EFCC Seizes N948m Aircraft Linked To Ex-governor - The Nation by BeeBeeOoh(op): 12:28am On Jan 18, 2017
The Economic and Financial Crimes Commission (EFCC) has impounded a N948million aircraft allegedly linked with a former governor of Borno State who is under investigation.
The aircraft was seized on Monday at the Maiduguri International Airport.

Anti-graft agencies have also placed two other private jets under surveillance at the Nnamdi Azikiwe International Airport in Abuja.

The grounding of the three aircraft is part of the ongoing investigation which traced some looted funds by some former political office holders to the purchase of private jets.

It was learnt that a Dornier aircraft 328 linked with the former governor had been earlier impounded, but it resumed operations without EFCC’s clearance.
Upon sighting the aircraft in Maiduguri on Monday, after months of watch-listing, EFCC detectives swooped on the crew and seized it.

The plane is marked N805PG and 5NBMH. It allegedly belongs to Skybird Air.
Detectives have interrogated the suspected beneficial owner of the jet, Mr. Samuel Ayodele, the Managing Director of Skybird.

A “beneficial owner” is a legal term where specific property rights (“use and title”) in equity belong to a person even though the legal title of the property belongs to another person.

An EFCC source, who spoke in confidence with our correspondent, said: “We impounded the Dornier 328 on Monday following suspicion in the manner in which it was acquired.

“Our detectives are working on clues that the aircraft belongs to a former governor of Borno State but it is being used by a front. We are already looking into relevant records; we want to establish who actually owns it.

“We are tracking how and when the aircraft was bought, where it was purchased, the mode of payment and the sources of funds. This is definitely an international transaction; it is easier to trace the inflows and outflows from any account.”

“There are also some petitions containing allegations against the former governor concerning the aircraft and some public funds. If the aircraft cannot be identified with the ex-governor, the EFCC will release it to the beneficial owner.”

Ayodele is said to have told detectives that the aircraft was originally with the defunct IRS Airlines, which bought it with a loan of about N948million from a bank.

The source quoted Ayodele as saying: “I bought the liability from the bank and took over the aircraft because IRS was not able to pay back the loan.
“It is a clean business. Since I graduated from school, I have been working in the aviation sector.”

According to Wikipedia, “The Dornier 328 is a turboprop-powered commuter airliner, initially produced by Dornier Luftfahrt GmbH, which was acquired in 1996 by Fairchild Aircraft.”

Two other jets, suspected to belong to some former political office holders, have been placed on surveillance at the Nnamdi Azikiwe International Airport.

“The movement of the jets is presently restricted until the conclusion of our ongoing probe. All relevant agencies in the aviation industry are collaborating with us on these two jets. We are working on information made available to EFCC that they were bought with looted funds,” a source said.

On the identities of the owners of the jets, the source said they would not be disclosed until the EFCC has made substantial progress in their investigation.

Sections 28 and 34 of the EFCC (Establishment Act) 2004 and Section 13(1) of the Federal High Court Act, 2004 empower the anti-graft agency to invoke Interim Assets Forfeiture Clause on any serving or former public officer or any Nigerian under probe.

“Section 28 of the EFCC Act reads: ‘Where a person is arrested for an offence under this Act, the Commission shall immediately trace and attach all the assets and properties of the person acquired as a result of such economic or financial crime and shall thereafter cause to be obtained an interim attachment order from the Court.’

Section 13 of the Federal High Court Act reads in part: “The Court may grant an injunction or appoint a receiver by an interlocutory order in all cases in which it appears to the Court to be just or convenient so to do.
(2) “Any such order may be made either unconditionally or on such terms and conditions as the Court thinks just.”

Politics › Nigeria's Effort To Secure International Loans Hit Deadlock - Daily Trust by BeeBeeOoh(op): 12:17am On Jan 18, 2017
• Govt has not submitted reform plans to World Bank - Sources

• Lender has not been able to consider a loan yet - Sources

• AfDB holds back second tranche of $1 bln loan - bank chief

• Nigeria seeks to drag itself out of first recession in 25 yrs

Nigeria's efforts to secure funds from international lenders to help haul it out of recession have stalled because it has not submitted the required economic reform plans, according to one of the banks and sources close to the matter.

The government has been in loan talks with the World Bank for a year. It had told the lender it would present its proposed reforms to make the economy more resilient and attractive to investment by the end of December, according to Western diplomats and a Nigerian official who declined to be named as they are not authorised to speak publicly.

But this has not happened and as a result of the delay, which the government has not explained, the Washington-based bank has not been able to consider a loan yet, the sources said.

Nigerian finance minister Kemi Adeosun and the World Bank declined to comment.

The African Development Bank (AfDB), meanwhile, is holding back the second tranche of a $1 billion loan for Nigeria, AfDB president Akinwumi Adesina told Reuters on the sidelines of the World Economic Forum in Davos, Switzerland.

"We are waiting for the economic policy recovery programme and the policy framework for that," said Adesina, without specifying when the AfDB had expected to receive the reform plans.

Nigeria has said it is seeking to borrow $4 billion in total from the World Bank and other foreign institutions and $1 billion through Eurobonds to plug a yawning budget deficit and fund badly needed infrastructure projects.

The country, which relies on oil revenue for most of its income, has been hit hard by the sharp fall in crude prices since 2014 and is struggling to drag itself out of its first recession in 25 years.

It is unclear why the government has not submitted reform plans to the international lenders. The funding deadlock could throw into doubt badly needed infrastructure projects planned for this year, including new roads and improvements to power infrastructure.

The failure to secure the funds, and to present a reform programme, could also deter some investors from Nigeria's planned $1 billion Eurobonds sale in March.

A Nigerian financial source said the government was working with a consultancy on putting together a package of proposed reforms. The source, who declined to be named as the matter is confidential, did not elaborate.

RECORD BUDGET

Nigeria needs money to help plug a budget deficit of 2.2 trillion naira ($7 billion) for 2016 and to help fund a record budget of 7.3 trillion naira for 2017 which is aimed at stimulating the economy.

It has been holding talks with various institutions and China over the last year to borrow funds but apart from a $1 billion loan from the African Development Bank, at a rate of 1.2 percent, nothing has been made public.

The Abidjan-based AfDB has paid out an initial $600 million in November but is awaiting the economic reform proposals before it disburses the rest of the money.

It is unclear how much money Nigeria is seeking from the World Bank, or whether the lender was pushing for any specific economic reforms from the government.

The diplomatic sources, however, said the bank wanted to see how Nigeria planned to lower its dependence on oil revenues and boost investment, which has been hit by a high official exchange rate for the naira currency.

Nigeria's central bank, backed by President Muhammadu Buhari, has kept the naira rate to the dollar at 40 percent above the unofficial - or parallel - market rate, which has dried up dollar supplies on official channels.

The policy has also made investors reluctant to commit new projects as they expect the central bank will have to devalue the naira eventually as oil production has been hit by an insurgency in the Niger Delta oil hub.

The central bank has also imposed hard currency curbs making impossible the import of almost 700 goods, which has forced dozens of plants to close running out of spare parts.

Adesina told Reuters on Tuesday that the currency rate problem needed to be addressed by the government in its reform programme, which he said the AfDB was coordinating with the World Bank.

"We are being clear that the quantitative restriction in terms of access to FX is what's creating huge gap between parallel market rates and official rates," he added. ($1 = 314.5000 naira). (REUTERS)
