Politics › Immunity Can't Stop Fayose's Prosecution- Aisha Buhari by BeeBeeOoh(op): 5:15am On Jul 28, 2016 |
The wife of the president, Hajia Aisha Buhari, has said that Governor Ayodele Fayose of Ekiti State cannot hide under the cover of immunity to avoid prosecution from several alleged criminal offences. Her position is contained in her statement of claims filed before an FCT High Court in the defamation suit challenging Governor Fayose’s allegation linking her with the Harliburton bribery scandal in the United States. Fayose’s counsel, Mike Ozekhome (SAN), had in a reply to Mrs Buhari’s pre-action notice on July 8, stated that under Section 308 of the 1999 Constitution, no civil or criminal action may be brought against the governor while in office, advising her to wait till 2018. But in the statement filed by her counsel, Ismaila Alasa and Mary Ekpere Eta, the president’s wife cited criminal charges on the murder of one Tunde Omojola, diversion of N1.2bn state funds in 2004 and the invasion of the Ekiti High Court with thugs who allegedly beat up a judge in 2014 as some of the governor’s ‘indiscretions’. “The first defendant (Fayose) is a well-known coward who is scared of facing the consequences of his numerous indiscretions and sheer acts of criminality by timidly hiding under the cloak of immunity to want to evade prosecution,” she averred. Meanwhile, Justice Olukayode Adeniyi has approved the service of the court papers to Fayose and his two aides- his chief press secretary, Idowu Adelusi and his special adviser on New Media, Lere Olayinka at the Government House, Ado Ekiti as the legal dispute proceeded in the week. The judge directed service of the processes on the defendants by DHL courier service and publication in an online media platform. Aisha Buhari, who has lined up 205 witnesses against Fayose, is seeking N5bn as damages over the statements. Fayose had in a media session on June 20, alleged that one Aisha Buhari, who allegedly transferred $170, 000 to USA congressman, William Jefferson, who was convicted in November 2009 over the bribery scandal, was the president’s wife. Full hearing is expected to commence after the court’s vacation. http://www.dailytrust.com.ng/2016/07/immunity-cant-stop-fayoses-prosecution-mrs-buhari/

Politics › Ogah & Ikpeazu: Calming The Abia State Storms by BeeBeeOoh(op): 4:18am On Jul 28, 2016 |
Respite came the way of the Abia State gubernatorial logjam on Tuesday July 26, 2016, when the Justice Morenike Ogunwumiju-led five-man panel of the Appeal Court sitting in Abuja, ordered all parties involved in the power tussle to “remain as they were” before the case was brought to the court.
Though the Judge clarified that this order was not to be misconstrued as a stay of execution of the judgement pronounced by Justice Okon Abang of the Abuja High Court ordering Dr Uche Ogah, a contestant to the post to be immediately sworn in, it allows Governor Okezie Ikpeazu to remain in office (for the meantime) thus foreclosing a power vacuum in the state.
This governorship debacle remains a major litmus test for the judiciary and indeed the nation’s fledgling democracy. On Monday June 27, 2016, Justice Abang had sacked Ikpeazu as Abia Governor and given a consequential order to the Independent National Electoral Commission (INEC) to issue a fresh Certificate of Return to Ogah to be sworn-in as Governor.
Ogah came second in the December 8, 2014 Peoples’ Democratic Party (PDP) governorship primaries. He alleged that Ikpeazu forged the tax clearance certificate and failed to file same for 2011, 2012 and 2013. Ogah, through his team of lawyers further alleged that all the payments Ikpeazu made before the PDP 2014 primaries were done in one day, a Saturday. The court ruled in favour of the plaintiff and declared the defendant ineligible to contest the 2015 governorship election.
Intense legal and political fireworks have flown from both camps since the judgment was delivered. Two other court pronouncements came from Abia and Imo States after that of Abuja. The political space in Abia is suffused with tension as the contenders lay claim to the Governor’s seat. The situation which Abia State finds itself would have been avoided if due diligence was observed in the build-up to the PDP governorship primaries in 2014. This logjam which brought governance to a standstill compounded situations in the state. Abia is among the 27 States which are unable to pay workers’ salaries.
Now that the Court of Appeal has waded into the issue, the parties to this dispute must refrain from further actions that could thwart the course of justice. They must be patient until all the legal processes are exhausted and a final decision made. We call on the Attorney General of the Federation, President of the Court of Appeal and the Chief Justice of Nigeria to ensure that the case is given accelerated hearing.
We also urge the National Judicial Council (NJC) to take appropriate measures against judges who fail to take judicial notice of judgments and rulings of courts of co-ordinate jurisdiction. http://www.vanguardngr.com/2016/07/calming-abia-state-storms/Lalasticlala, Mynd44 |

My only joy is that we are in this altogether, both the people who voted for change & those who didn't. But, to an extent I thank the almighty God for making Buhari the winner because if he had not won; some people would have told us how Buhari would have made Nigeria an eldorado..
e.g: 1. That PMS would have been N28 per litre by now.
2. Bag of rice would have been M2350 by now. etc But, reverse is the case.

Politics › Military Action In Niger Delta: Guard Your Utterances, MEND Cautions Buratai by BeeBeeOoh(op): 9:28pm On Jul 26, 2016 |
Nigeria's Chief of Army Staff, Lt-Col. Tukur Buratai, has come under fire for threatening the use of force in the oil-rich Niger Delta region, if dialogue moves with militant groups to stop the bombings of oil installations in the region fail.
The Movement for the Emancipation of the Niger Delta, MEND, which criticised Buratai, said the threat was “insensitive and provocative.” Recall that Buratai had yesterday, in Port Harcourt, the Rivers state capital warned that the government will use force if efforts at talks with militants in the region Fail .
Meanwhile, MEND in a statement by its spokeman, Jomo Gbomo said: “MEND hereby makes it clear that General Buratai’s statement is insensitive, provocative, unprofessional and prejudicial to the fair outcome of the ongoing preliminary talks regarding the Niger Delta crisis between representatives of oil companies and security agencies, on the one hand; and the Movement for the Emancipation of the Niger Delta (MEND), on the other hand.
“We therefore warn the Chief of Army Staff to guard his utterances, refrain from making political and inflammatory statements and stick to his primary responsibility.
“We use this medium to appeal to the good people of the Niger Delta to remain patient with the administration of President Muhammadu Buhari and keep hope alive as MEND and the Aaron Team 2 Dialogue, Peace and Development Initiative led by Mr. Odein Ajumogobia, and HRH King Alfred Papapreye Diette-Spiff are working assiduously to secure sustainable concessions for the region from the Government.
“While MEND have already kick-started the dialogue process with the ongoing preliminary talks, the Aaron Team, made up of distinguished and accomplished personalities from the region, are waiting on the sidelines to conclude the dialogue process.” http://www.vanguardngr.com/2016/07/Military-actions-niger-delta-guard-your-utterances-mend-cautions-buratai/ Lalasticlala, Mynd44

Politics › Documents Trace The Whereabout Of Missing $7.8bn NLNG Dividends - TheCable by BeeBeeOoh(op): 10:38am On Jul 26, 2016 |
TheCable has seen documents indicating the trail of the “missing” dividends paid by the Nigeria Liquefied Natural Gas (NLNG) to the Nigeria National Petroleum Corporation (NNPC) between 2005 and 2013.
The Economic and Financial Crimes Commission (EFCC) and the senate are currently investigating the findings of the 2013 audit report of the Nigeria Extractive Industries Transparency Initiative (NEITI) which raised the issue. NEITI had said the NNPC, which holds 49% equity in NLNG on behalf of the government, did not remit a total of $12.9bn to the federation account during the period.
In its reaction, the NNPC said a part of the dividends was reinvested on behalf of the federal government and the rest is now in the treasury single account (TSA).
However, TheCable has seen letters exchanged by former President Goodluck Jonathan and Diezani Alison-Madueke, the former minister of petroleum resources on $7.85 billion out of the dividends. Sources at the ministry of petroleum resources showed TheCable the letters that were written between March and May 2011.
A letter dated March 30, 2011 and seen by TheCable showed that Alison-Madueke sought the authority of the president to use $7.85 billion of the dividends to fund NNPC’s contribution to the 10 million tons per annum Brass Liquefied Natural Gas (LNG) project. The request was granted on May 13, 2011 via a reply written by Matt Aikhionbare, who was Jonathan’s senior special assistant on administration.
EQUITY CONTRIBUTION
Alison-Madueke’s letter highlighted the importance of the Brass LNG to the economy. She said the NNPC needed to pay its equity contribution to the $16 billion project and sought the approval of the president. With NNPC holding 49% of the equity, the amount came to $7.85 billion.
The letter was silent on how much dividends were paid into NNPC’s coffers, but the NEITI said NLNG paid $12.9 billion to the corporation over the eight-year period. Jonathan approved the request and directed that the $7.85 billion be sourced primarily from the dividend account.
There are still questions over the eventual destination of the payment as the Brass LNG project has since stalled, with the final investment decision (FID) hanging – partly because of funding issues. EFCC is working on the possibility that the $7.85 billion might not have gone to Brass LNG.
KEY CHALLENGES
The project, to be located on Brass Island in Bayelsa State, next to the Agip oil terminal, was conceived in 2001 as a two-train plant of 10mtpa, with provisions for expansion. In her letter, Alison-Madueke said the project was contending with two key challenges of gas supply and financing. Controversies remain over NNPC’s claims that part of the money was invested on behalf of the federal government.
There is a legal lacuna on who owns NNPC’s 49% equity – is the federal government or the Federal Republic of Nigeria? NEITI, in its report, queried the expenditure of dividends without appropriation by the national assembly – that is if the money belong to the federal federal government.
However, if the money belongs to the federation, NNPC’s claim that it paid another part to TSA raises questions over whether the money should not have been paid to the consolidated federation account as revenue to the three tiers of government. https://www.thecable.ng/exclusive-documents-trace-whereabouts-missing-7-8bn-nlng-dividends
