December 11, 2023 LP urges INEC to declare 27 Rivers lawmakers’ seats vacant Kogi: INEC dismisses reports of tampering with figures of accredited voters Yakubu …demands fresh elections John Alechenu The Labour Party has joined the clamour for fresh elections to be conducted in Rivers State to fill vacancies allegedly created by the defection of 27 Rivers State lawmakers from the Peoples Democratic Party (PDP) to the All Progressives Congress, (APC), on Monday. This was contained in a statement signed by the Rivers State Chairman of the Labour Party, Hilder Dokubo, which was made available to newsmen in Abuja. She said, “It has come to the attention of the leadership of the Labour Party of the development in the Rivers State House of Assembly where about 27 members of the Assembly were said to have defected from one party to another in disregard to the constitutional provisions. “Section 109. (1) (g) of the Nigeria constitution clearly states that ‘A member of a House of Assembly shall vacate his seat in the House if being a person whose election to the House of Assembly was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected.’ “The above provision of the constitution is very clear about the fate that must befall on those legislators who betrayed the party that sponsored them. “Therefore Labour is calling on the Speaker of the Rivers State House of Assembly to declare vacant the 27 seats of the defected members without delay in line with the laws of the land. “The party is also calling on the Independent National Electoral Commission, INEC to begin the process of conducting a fresh election to fill the vacant spaces. “Labour Party recalls that in 2022, a Federal High Court sitting in Abuja sacked 16 Ebonyi House of Assembly members for defection. “The court held that the movement was in breach of Section 109(1)(g) of the 1999 Constitution as amended which provides that defector legislators are not allowed to retain their seats in the legislature “The same fate befell on 18 members of the Cross River House of Assembly and 2 members of the House of Representatives who were asked to vacate their seats for defecting from their party last year. “The Labour Party can also vividly recall that in 2012, our member representing Akure North/Akure South Federal Constituency defected to another party. “This case lingered until the Supreme Court in 2022 ordered him to immediately vacate his seat following his defection from the Labour Party. “The Court’s unanimous judgement held that the lawmaker who decamped from the Labour Party to another party was constitutionally unfit to retain his seat as a federal lawmaker in the federal House of Representatives. “Though, the case aforementioned was slow in coming but the fact that the apex Court did justice to the matter with a proper interpretation of the law is enough for the political class to be aware that it can no longer take both the electorates and party that sponsored them for elections for a ride. “Labour Party is directly involved in this matter because we know the manipulations and electoral frauds that threw up some of these out-going lawmakers in Rivers State, which unfortunately deprived popular candidates of Labour Party victory in the last election. The Peoples Democratic Party (PDP) has called on the Independent National Electoral Commission (INEC) to conduct fresh elections in the 27 state constituencies in Rivers State where lawmakers recently defected to the All Progressives Congress (APC). In a press statement issued on Monday by Hon. Debo Ologunagba, the party’s National Publicity Secretary, the PDP argued that the defected lawmakers have automatically vacated their seats as stipulated in Section 109 (1) (g) of the Nigerian Constitution, which states that a member of a House of Assembly loses their seat if they join another political party before the expiration of their term. “The seats of the 27 former lawmakers have become vacant by virtue of the provision of the Constitution,” the statement said. “Therefore, we demand that the Speaker of the Rivers State House of Assembly immediately declare these seats vacant and that INEC conduct fresh elections to fill the vacancies.” The PDP also cautioned the former lawmakers against “parading themselves as members of the Rivers State House of Assembly,” warning that doing so “would amount to impersonation with serious criminal consequences.” The party further commended the people of Rivers State for their “steadfastness and loyalty to democracy and rule of law,” especially during this period of political uncertainty.

Recall the CG had on Thursday, responding to a question from Oshiomhole during a joint hearing of the national assembly committee on interior, stated that the the total number of inmates in 2023 is 81,354 nationwide while 53,352 are awaiting trial, and that each inmate are fed with N750 daily and they are fed three times daily (N250 for each meal), while there are 900 security dogs and to feed a dog each day is about N800. This statement has raised so much dust from different persons, including Oshiomhole, the senate committee chairman. In a statement signed and made available to newsmen today, the executive director, Amb. Kanjal Awal, the group disclosed that within its own discretion, the statement made by the CG, was taken out of malicious context for media clickbaits and to discredit the excellent service of the leadership of the NCoS. It reads: ” As concerned citizens of this great nation, issues of national interest should be treated and addressed accordingly and appropriately free from bias. We have read and checked the statement of the Comptroller-General, Nigeria Correctional Service, Haliru Nababa, and we do not get the noise and eyebrows it has raised so far. “The statement, “We feed each inmate with N750 daily, and they are fed three times daily (N250 for each meal). I just left Transcorp Hotel Abuja after my news analysis at Arise News TV. As I stepped to the lobby of the hotel, I saw a bevy of pretty young girls in their early 20s crowded in a corner. There were all skimpily dressed as if there were commercial sex workers. The time was 10.30pm. One of them rushed to greet me. “Good evening sir”. She was one of my students. I recognized her clearly because she had a slight disability and I paid attention to make sure she followed the coursework. I was shocked. I recognized three of those hotly dressed pretty young girls as fresh graduates of my department. What are they all coming to do at this kind of Hotel at this hour and dressed in this manner? Of course, I think I know what it is. A Nigerian politician or man of means have arranged them for his pleasure and those of his friends and acquaintances. Everyday, our girls are disoriented by these politicians who have neither shame nor conscience because they have access to power and money. We pride ourselves that we have a large youth population and that is a huge asset. But the truth is that we have a large hardware. The software is highly corrupted. Why do we intend to organize these adolescents into the life of immorality? This reminds me of the experience I had as a special adviser to senate president. Once we went to open a new government house built by a Governor in one of the southeast states. The Governor arranged a special reception for us. When we got to the venue of the so-called reception, I was shocked. Tens of very young girls sourced from the nearby university – between 17-22 years- were already dancing with top government officials. I screamed and accosted the majority leader of the State House of Assembly. He boldly answered “Man Sammy, these adolescents are our counterparts”. Wow. What? I requested to be taken back to the hotel. That was the end of the reception for me. I couldn’t believe that someone will arrange first year students for an entourage that has the Senate President and the Chairman of the Senate Committee on Education. We are finished. These politicians have done more harms than you can imagine. They have destroyed the economy. They have destroyed infrastructure. They have also destroyed the morality and the viability of our human capital. How can such young girls who are debased that early rise up to be moral champions of tomorrow? How? One, a 13-year-old girl at the time, was convicted of making false accusations. Five others, who had been aged between 14 and 15, were found guilty of criminal conspiracy with intent to cause violence. Paty, a 47-year-old history teacher, was stabbed and then decapitated near his secondary school in the Paris suburb of Conflans-Sainte-Honorine, by Abdoullakh Anzorov, a radicalised 18-year-old who arrived in France aged six with his Chechen parents and had been granted asylum. Anzorov, who was later shot dead at the scene by police, killed Paty after messages spread on social media that the teacher had shown his class cartoons of the prophet Muhammad from the satirical magazine Charlie Hebdo. Paty had used the magazine as part of an ethics class to discuss free speech laws in France. Weeks before the class, Charlie Hebdo had republished the cartoons. The magazine had first published the images in 2012. In 2015 radicalised gunmen stormed its Paris office, killing 11 people inside, and a police officer outside, in coordinated terrorist attacks which also resulted in a second police officer being killed and four hostages murdered at a kosher supermarket. The girl, who had been seen as central to the events, was found guilty of making false accusations and slanderous comments. She was handed an 18-month suspended prison sentence. She had wrongly said that Paty had asked Muslim students to identify themselves and leave the classroom before he showed the cartoons. She later told investigators she was not in the classroom that day. Paty had not asked children to leave but said they could turn away if they felt they would be offended by the cartoons shown. Five of the teenagers on trial, who were aged between 14 and 15 at the time of Paty’s murder, were found guilty of criminal conspiracy with intent to cause violence. They were found guilty of having helped point out Paty to Anzorov when he asked who the teacher was. They said they never thought it would lead to his murder. Four were given suspended sentences. One of them, who had initially shown Anzorov who Paty was, was sentenced to six months in prison, which should be possible to serve under electronic surveillance. Those handed suspended sentences were required to stay in school or jobs during the duration of their suspended terms with regular medical checkups. They left the courtroom without speaking. The teenagers were tried behind closed doors in juvenile court, without the media present. Eight adults will face a different trial next year at a special criminal court in the case, including the 13-year-old girl’s father, who is accused of having posted videos on social media that called for mobilisation against the teacher, as well as an activist who is accused of helping him disseminate messages naming Paty. At the start, Virginie Le Roy, a lawyer representing Paty’s parents and one of his sisters, had said the Paty family saw the trial of the teenagers as crucial. “The role of the minors was fundamental in the sequence of events that led to his assassination,” Le Roy had told AFP
