Michigan supreme court rules that Trump will stay on state ballot
Ex-president can participate in state primary despite accusations of insurrection stemming from the January 6 Capitol attack

Donald Trump will remain on Michigan’s state ballot after a ruling from the Michigan supreme court on Wednesday, which upheld a lower court order.

The move sets the stage for the former president to participate in the Michigan primary despite accusations that he led an insurrection against the United States.

The court’s decision not to move forward with a case against Trump sets the court in sharp contrast to the Colorado supreme court, which recently ruled to strip Trump from its state primary ballot because of his role in the January 6 riot at the US Capitol.

In Michigan, as in Colorado, the challengers have invoked section 3 of the US constitution’s 14th amendment, which broadly blocks people from holding government office if they “have engaged in insurrection or rebellion” against the US constitution having previously sworn an oath to uphold it. Legal experts are divided on whether this provision, written against the backdrop of the US civil war, applies to the office of the president. There are also questions as to whether Trump’s actions around January 6 legally constitute “insurrection or rebellion”.

Colorado’s decision is currently paused. More than a dozen states have similar litigation in the works, according to a database maintained by Lawfare, which covers national security issues.

The Michigan supreme court justices did not give a reasoning for their decision.

“We are not persuaded that the questions presented should be reviewed by this court,” the justices wrote in an unsigned, one-paragraph order.

However, in a dissent in which she largely agreed with the court’s order, Justice Elizabeth Welch said that procedural differences may make the difference in Colorado and Michigan’s election laws. The challengers in the case, she added, may “renew their legal efforts as to the Michigan general election later in 2024 should Trump become the Republican nominee for President of the United States or seek such office as an independent candidate”.

Free Speech for the People, the group that brought the lawsuit, stressed that the Michigan supreme court’s decision was made on procedural grounds.

“We are disappointed by the Michigan supreme court’s decision,” said Ron Fein, legal director of Free Speech For People, an attorney for the plaintiffs, said in a statement. But, Fein added: “The decision isn’t binding on any court outside Michigan and we continue our current and planned legal actions in other states to enforce Section 3 of the Fourteenth Amendment against Donald Trump.”

Michigan is expected to be a battleground state in the 2024 US presidential election. Its primary is set for 27 February 2024.

Trump celebrated the order on the social media platform Truth Social.

“The Michigan Supreme Court has strongly and rightfully denied the Desperate Democrat attempt to take the leading Candidate in the 2024 Presidential Election, me, off the ballot in the Great State of Michigan,” Trump wrote. “We have to save our Country from decline and the Radical Left. Make America Great Again!”

For years, Pornhub hosted adult videos featuring women who were coerced into performing sex acts on camera by a production company, the website’s owner acknowledged in an agreement with federal prosecutors this week.

Aylo, Pornhub’s parent company, will pay a $1.8 million fine and compensate the sex trafficking victims as part of a deferred prosecution agreement. The company pleaded not guilty to the government’s charge of engaging in unlawful monetary transactions involving sex trafficking proceeds, although it acknowledged the illegal material was posted on its site and said it regrets that fact.

The government did not accuse Aylo itself of violating any federal sex trafficking laws, but said the company should have known it was doing business with a group that was engaging in sex trafficking. As part of its agreement, Aylo will also be subject to monitoring for three years, and the charges against the company would be dropped if it complies with its agreement.

From 2017 through 2019, a production company paid Aylo to stream its pornography that Aylo knew included videos featuring women who did not give their consent for the content to be posted online, according to Aylo’s admission and court documents. In 2016, Aylo began receiving takedown requests from women who appeared in the videos, telling Aylo they were lied to. And Aylo became aware of a federal lawsuit against the production company in 2017, court documents show.

But Aylo didn’t follow through with all the takedown requests, nor did it attempt to independently verify that the women consented to have the videos appear on the internet, prosecutors said. Even after Aylo took the production company’s videos off Pornhub in 2019, some of the same videos were reposted by other users and remained online, according to court documents.

In a statement, Aylo, which is under new management since the alleged incidents occurred, said it “deeply regrets” that Pornhub hosted the content.

“We were troubled to learn that a production company used criminal means to produce its content and submitted consent documentation that we now know was obtained by fraud and coercion,” the company said in its statement. “We must be vigilant to stop those seeking to use our platforms illegally, and to respond to ever changing threats and challenges.”

Breon Peace, US Attorney for the Eastern District of New York, said in a statement the deferred prosecution agreement holds “the parent company of Pornhub.com accountable for its role in hosting videos.”


The FBI also said the company should have acted more quickly to remove the videos.

“Motivated by profit, Aylo Holdings knowingly enriched itself by turning a blind eye to the concerns of victims who communicated to the company that they were deceived and coerced into participating in illicit sexual activity,” said FBI Assistant Director-in-Charge James Smith in a statement.

Aylo’s new compliance director Solomon Friedman told CNN the company does not acknowledge any criminal liability. But he said the company now has measures in place to ensure a similar incident never happens again. According to its website, Aylo operates several other sites with names such as Mofos, YouPorn and MyDirtyHobby. The Canada-based Aylo is owned by a Canada-based private equity firm called Ethical Capital Partners.

“We have zero tolerance for illegal material and the agreement demonstrates that we take our responsibilities very seriously,” Friedman said Thursday in a statement.

24-year-old housewife stabs man to death in Kano, claims he attempted to stop her from committing suicide

The Kano State Police Command has arrested a 24-year-old housewife, Hafsat Surajo, for stabbing one Nafiu Hafiz, to death at Unguwa Uku in Tauranin Local Government Area of the state.

Spokesperson of the command, SP Abdullahi Haruna Kiyawa, who confirmed the incident in a statement on Friday, December 22, 2023, said Hafsat confessed that she stabbed the deceased on several parts of his body with a knife while he was preventing her from committing suicide.

The PPRO further disclosed that the woman’s husband, Dayyabu Abdullahi, and their gateman, Mallam Adam, were arrested for packaging and concealing the dead body.

“On 21/12/2023 at about 0700hrs, report was received from one Hafizu Salisu of Bauchi Metropolis of Bauchi State that he received a phone call from one Dayyabu Abdullahi ‘m’ of Unguwa Uku Quarters Kano that his brother one Nafi’u Hafiz, aged 38 years, is dead and that they should come and convey the corpse for burial,” the statement read.

“When they arrived at the residence at Unguwa Uku Quarters Kano, they discovered several injuries on different parts of the lifeless body suspected to be knife stabs.

“The Commissioner of Police, CP Mohammed Usaini Gumel, FIPMA, psc directed the Divisional Police Officer, Zaria Road Division, SP Abubakar Chika Zaki, to lead a team of detectives to the Scene and to conduct a preliminary investigation.

“Upon arrival at the crime scene by detectives, the motionless body was removed from the scene and rushed to Aminu Kano Teaching Hospital where a Medical Doctor certified the body dead.

“Further investigation led to the arrest of Hasfat Surajo, aged 24 years, a female housewife of the residence where the deceased lived.

“Further investigation at the Command’s Criminal Investigation Department, obtained a confession by Hafsat who admitted that she singlehandedly committed the act by stabbing the deceased on several parts of his body with a knife while he was preventing her from committing suicide.

“Her husband, Dayyabu Abdullahi, aged 38 years, ‘m’, of the same address, and their gateman Mallam Adam, aged 65 years were arrested for packaging and concealing the dead body and cover.

“Meanwhile, through discreet investigation, the knife was recovered with a blood stain used resulting from committing the crime. The suspect will be charged to Court after the completion of the investigation
