Good Evening Fergie001.. .. Something is still not feeling so right about the INEC’s “Regulations and Guidelines”. Please put me through on this.. I am of the Opinion that the INEC should totally expunge Clause-48(c) and Clause-93 from their INEC’s “Regulations and Guidelines for the Conduct of Election - 2022”. These clauses are totally contradicting the Section:64(6a,6b,6c,6d) of the Electoral-Act-2022 which had already solved the same problem which these clauses are supposed to be solving in another way. The Electoral-Act-2022 didn't in any place mention that the collation of any of the missing lower-level results (whether Polling-unit Results or Collated Results) should be done with the Police Copies or with the Party-Agents Copies. The Electoral-Act-2022 made it sacrosanct that wherever the BVAS wasn't used, then it is assumed that no elections took place at that polling-unit. And if the hard-copy of the polling-unit results are missing, then the results inside the BVAS (as directly transmitted) can be used for collation, and if there are no results inside the BVAS, THEN THERE WON'T BE OTHER FURTHER ALTERNATIVES.. The Clause-48(c) and Clause-93 of the INEC’s “Regulations and Guidelines for the Conduct of Election - 2022” ended up invalidating the COMPULSORY and MANDATORY use of the BVAS -- as described inside the Electoral-Act-2022. I wonder why the INEC’s “Regulations and Guidelines for the Conduct of Election - 2022” had to try to solve the same situation in a way that contradicts the “Electoral-Act-2022”. Is there a way to Get the INEC to quickly remove those two HARMFUL CLAUSES from their INEC’s “Regulations and Guidelines for the Conduct of Election - 2022” 1 Share

And then again.. Now,, I need you to show me where it was suggested in the section you quoted (or in any of the Nigerian Laws -- for that matter) that “Polling-Unit Results” can be treated the same way as “Collated Results”. .. The section you are quoting clearly mentioned “Collated Results” without mentioning “Polling-Unit Results”.. And if no part of the law equated the two results,, why would anybody come outside the law and equate the two of them? |
