I have a tenant i want eject from my flat in Lagos after seving all the notices ( 6months, 7days). I want to commence the court proceedings. How much does it typically cost to go through the court to eject a tenant? I heard the court to hear the case is a function of the amount paid as rent. The tenants rent is N450k per annum.

I want to know why a court still give a tenant who has been served with the required notices some additional time to move out. What is the use of the notices served by the Landlord?
@Electroweb. The NOTICE to quit issued by landlord is not as effective as court judgement. Tenants may refuse to honor quit notice from his landlord but if he dare exceed judge pronouncement to vacate the apartment he occupied, he/she will be forcefully ejected by bailiff.

*Run it like a business.

Whether you are a full time landlord or this is
just a side, part-time business, have systems in place and follow them!
For example, it’s OK to be nice to your tenants, but if they get behind,
start the eviction process.You are a business owner so act like one!

*Aggressively

Screen your prospective tenants. I have found that most people talk a good
talk and it can be difficult to tell if they are telling the truth. Run
credit, check their references and talk to their landlord. Past history is
an indication of how they will pay you and treat your house.
*Treat your tenants well.
A good, well paying tenant will hopefully stay for years
and will think twice about leaving you if you treat them well. What do I
mean by that? Fix maintenance issues promptly, check in periodically and
make sure things are going well, send a Christmas card, etc. It doesn’t
take a lot to make them feel appreciated.

*Know when to get help.

Let’s say you have a tenant not paying rent and you are not exactly sure how to
start the eviction process, you need to find someone who can advise you. No
one knows everything and this is just one example of when you might need
to consult an expert.

I used to be too timid to ask these kinds of questions. It was easier to say “Ok” and not ask any questions. Unfortunately, I run across many landlords who just don’t want to “confront” the tenant or make him mad or don’t feel right asking those questions.

Remember, this is YOUR house! By not asking questions and making your tenant answer to you, allows the tenant to run your business instead of the other way around. Do not change the way you do business just because your tenant can’t or won’t follow your rules! Get rid of that tenant and find another one who will follow your rules. There is just no reason to keep a tenant that never pays on time. It’s bad for your bottom line.

Many times they will ask if you can waive the late fees this time. You will have to decide what your policy is on this and I have heard lots of different opinions on this subject. Once a tenant has been with us for a year, we will waive late fees once a year but we note it in Quick Books so that we can keep track.

We do not waive late fees during the first year, because if you don’t train them from the start, you will have tenants that never pay on time.

I was talking to a landlord the other day with a problem tenant. The woman moved into the rental house in January 2012 and has paid late every single year. This tenant is not very nice and has a new excuse every single time. The landlord felt bad for the tenant at first but that changed as time went on. The landlord didn’t charge late fees until the January 2016, rent was late and when she added them to the bill the tenant threw a fit! She asked me what I thought I should do.

I asked her if she wanted to try and work with the tenant and keep her or if she just wanted to get her out and start over. She was sick of dealing with her and just wanted to get her out. My advice to her was to follow her lease which spelled out how to deal with this situation.

The first step in this instance is to send the 7 day warning to recover possession letter through your agent/solicitor.

Many times a tenant that has been difficult will see that you mean business, that you are willing to get them out of the house and they will straighten up. This has happened to me and the tenant ended up paying on time and being a good tenant. Other times, the tenant doesn’t have any intention of paying on time and needs to go. Only you can decide if you want to work with this tenant or not. If you don’t just follow the process and the tenant will either move out or you can set him out.

If the tenant refused to honor or fail to come up with his/her rent payment, ask your agent to issue him summon to court.

At this junction most tenants usually avoid court appearance and leave the house
on or before the expiration of the NOTICE.
However, if the tenant proof to be stubborn, initiate ejection proceedings against him and send him packing through court judgement.

Keep in mind that if you accept any money from the tenant during this process, you have to start over! If you want the tenant gone, do not accept any money.

Know the laws of the land or you will end up in trouble and with a tenant still living in your house that is not paying rent.

Dealing with problem tenants is part of ou job. It is never fun but if you have a policy in place for dealing with them, it does make your job easier.

VACANT POSSESSION ‘HOW TO EVICT TENANTS


You would rarely find houses for sale that are vacant. In reality,a lot of home buyers expect this and area often disappointed to find most properties for sale are tenanted.

Therefore, no sooner is the sale concluded,that the buyer is already telling the tenant to move out within a month or two!
Now such moves if they are not made with proper education from the legal point of view could end up in disaster. It is often said that “the law is on the side of the tenant.” Whether this is true or not, certain technicalities and points have to be observed before giving notice to a tenant to vacate an apartment.
The position of the law is that you inherit the tenants with the house. What this means is that all the tenants’ rights and obligations to the landlord remain the same wheather there is a new landlord or not.
You need to act like an informed person so you can get the tenant to move in the shortest possible time.
Find out their tenancy anniversary or terminal date. This presumes a tenancy period e.g 1st January,1996 -31st December, 1996 (Yearly tenant). The terminal date is 31st December, 1996.
Study a copy of the tenancy agreed period, of notice to terminal or quit, 3 months? 6 months?
Generally, tenancies require the following notice, depending on location (could vary from state to state) and mode of payment.
1. Monthly payments – 1 months notice
2. 3-monthly payments – 3 months notice
3. 6- monthly payment – 3 months notice
4. One year payment – 6 months notice. ( sometimes 3 months by mutual agreement)
Invite all the tenants to a meeting and inform them that you need the house for your personal use and agree on time to move within reasonable limit. This is a gentleman’s agreement and should be in writing. You may, however, not have the cooperation of all the tenants like you envisaged, and you may need to resort to legal steps to get a tenant to leave.
Steps to Take.

Instruct your solicitor/realtor to issue a quit notice, giving the required period of notice which must be observed to give validity to the notice. If the notice is shorter than the required period, it could be set aside and that could mean your waiting until next year’s tenancy anniversary.

After issuing a proper notice, the tenant may remain until the notice lapses for several reasons. The High Court processes lead to several adjournments, thus wasting valuable time. Once judgement has been delivered usually giving the tenant one more month within which to move.

-what follows is vacant possession as court baliffs, policemen and other law enforcers cooperate to forcefully eject such tenants.
Lastly, some other people resort to unorthodox (and therefore, illegal) methods to eject the tenant. The aim being to make life uncomfortable for the tenant, of which may include some of the following:
-disconnecting electricity
-using heaps of sand or gravel to block off the entrance gate.
-removing windows and doors and even part of the roof .
-begin repairs while tenants are still in place.
Even though these method may prove effective in the short term, they could boomerang if the tenant successfully proves its illegality and deliberately prolong settlement of the matter.
These methods are not recommended and could lead to disastrous law suits against the landlord.

DON'TS in the process of buying a house/land

1, Don't relate to estate agent without visiting his office and finding out that he is well established.
2, Don't just believe the information you are given on a house you want to buy without verifying the truth.
3, Always ensure that the tenants/occupants of the house you are buying know and identify with the landlord who is selling to you.
4, Don't fail to ensure that you are introduced as the new landlord or owner.
5, Never make any part payment or whole sum under pressure. Make sure you have introduced an independent solicitor who has verified documents as genuine and safe.
6, Don't ever pay money without taking a proper reciept, including details of what the money was paid for.
7, Don't believe anyone who wants a secret sale saying it is just the two of you. Oftentimes, there are hidden factors.
8, Don't allow yourself to be guided by friends or family relations to one single estate agent alone not allowing you to see and make fair judgement of various properties on the market. Sometimes, you might be walking into a carefully contrived plan to hike the prices for personal gratification.
9, Don't pay professional fees or commission in advance except where certain direct cost come in like title search, investigation of the house, photography, etc. Percentage fees are only earned after job is done.
10, Don't pay the landlord (vendor) the full sum for the house if an amounts is owing to the bank. Always pay such sums directly to the bank and the balance to the landlord on mutual agreement.
11, Don't fail to change document on the house to your name soon after paying for the property, that is, perfection of title by obtaining governor consent or certificate of occupancy.
12, Don't purchase land based on ordinary land agreements without some form of title registration whether through the original landowning family or their children without first checking details at the town planning and lands ministry and probably taking possession. Even with this go with legal representation.
13, Don't pay large unreceipted sums to government officials whether political or career civil servants, on the promise of a G.R.A. plot. Seek legal advice before making your move.
14, Don't neglect to develop your plot in a government estate or G.R.A. within two years of the land allocation. Also pay ground rents yearly and consistently so your title will not be revoked.
15, Don't fail to check update of payment of electricity (PHCN) bills, water supply bills and perhaps tenement rates before purchasing a property.
16, You or your attorney (to represent you) must be present with the vendor (landlord) in the presence of witnesses the document signing ceremony.

My advice is that always follow due process, conduct back ground check of the vendor, the original family that owns and have the right to sell. If you do not have the lump sum to buy, employ service of an experienced lawyer that will draft MOU btw you and the vendor behit an individual or a Family, that is.if you are making payments twice or more and make sure you adhere to the COVENANT. By extension, go to appropriate government agency, such as lands registry to verify if the land you intend to purchase is not under acquisition.
