Indications emerged at the weekend that the 27-man task force investigating the $2.1billion arms procurement scandal under the former National Security Adviser, NSA, have traced a whopping sum of N1trillion to the accounts allegedly owned by four EX- service chiefs.

The $2.1 billion is an amount budgeted for procurement of arms by the immediate past administration to fight the Boko Haram insurgency in the North East.

A highly placed source at the Economic and Financial Crimes Commission, EFCC, told Nigerian Pilot that the task force investigating the arms deals in conjunction with the financial intelligence unit of the EFCC found about N1trillion of the missing money in the accounts of four former service chiefs. The money was allegedly paid into the military officers’ accounts domiciled in four new generation banks.

The source further said the affected service chiefs would soon be invited to explain all they know about the money found in their bank accounts as well as their involvements in the arms deals.

The former service chiefs were those in the Air Force, Navy and Army.

Apart from the Service chiefs, it was further gathered that more retired and serving military officers are also being investigated by the anti-graft agency and those found culpable would be invited for questioning.

For instance, the source explained that, “The commission has traced N400million to the account of a serving security operative. The shocking discovery was made just before the New Year.

“Efforts are still being made to trace other transactions. The motive is to go after some of these funds that are in private accounts.”
Recently, the EFCC picked up a serving Colonel and a German citizen in connection with the ongoing investigation into arms procured.

Sources said the duo are currently detained in connection with the training of 750 Special Forces in Belarus in 2015.

Another top operative of the commission said the commission had written to the Defence Headquarters and heads of the three services of the Armed Forces for the release of some personnel needed by the anti-graft agency to shed light on their roles in the arms procurement deal.

The Defence Headquarters had repeatedly said the present administration would not tolerate corruption, which it noted had retarded the development of the country.

The Acting Director, Defence Information, Brigadier General Rabe Abubakar, told our correspondent on phone that the military was fully in support of the Federal Government’s campaign against corruption.

In a related development, Nigerian Pilot gathered that the EFCC would next week invite nine prominent northerners, who were mentioned in a letter which a former chairman of the Peoples Democratic Party, PDP Board of Trustees, Chief Tony Anenih, wrote to the anti-graft agency.

Anenih had in the letter explained how he shared N260millio paid into his account by the Office of the National Security Adviser, ONSA during the tenure of Col. Sambo Dasuki (retd.).

He alleged that he gave N63million to a group coordinated by a former Special Assistant to former President Shehu Shagari, Alhaji Tanko Yakassai.

But Yakassai said he only got N53million not N63million from Anenih as alleged and that he used it for official purposes.

Yakassai said, “The amount being bandied about is not what was given to me. It is true Chief Anenih gave the committee of eminent persons, which I headed some funds for our assignment. The money being quoted is not what we received.

“The committee of nine persons, which I led, was given an assignment to reach out to traditional rulers on the need for them to ensure peaceful elections in their domains because there was tension prior to the 2015 general elections.

“We went round 18 states and Abuja where we met two persons in each of the states we visited. We started with the Sultan of Sokoto. We could not meet with traditional rulers in Gombe because on the day of our visit, Boko Haram attacked the town and there were reports that they were targeting the Government House, where we were at that time.

“The money the committee received was for logistics, such as transport and accommodation. We wrote a report after our assignment, which started on January 14 and ended on February 15, 2015; the records are there.”

The elder statesman said he was prepared to defend the activities of the committee when required to do so, stressing that the committee performed its assignment creditably and transparently.

Efforts to get response from the EFCC did not succeed as at the time of filling this report as calls to the mobile phone of its spokesman, Wilson Uwujaren was not picked.

The commission is also seeking to verify whether or not the vehicles were bought and under what diplomatic or bilateral security cooperation.

It was gathered that it would require finding out from the Republic of Niger if there was such assistance from Nigeria.

The agency plans to quiz a number more public figures including Minister of Finance in the Jonathan administration, Dr. Ngozi Okonjo-Iweala, some ex-Service Chiefs and serving military officers in connection with the $2.1billion arms deal.

Some suspects may be taken into custody in the process,sources hinted yesterday.
The EFCC,it was gathered, is through with the first phase of the probe of the arms deals which led to the arraignment of ex-National Security Adviser Sambo Dasuki and 10 others.

The interrogation of the likes of Dasuki and the others now facing trial or about to be arraigned seems to have convinced the agency of diging deper than originally planned.

A top source said: “We are beginning the second phase of the ongoing investigation of the $2.1b arms deals on Monday. From the preliminary findings, the scandal is mind-boggling.

“We are going to question more high-profile serving and former public officers, including a former Minister of Finance, Dr. Ngozi Okonjo-Iweala on the release of some funds.

“We want the ex-Minister to shed more light on how about $322million was disbursed to the Office of the National Security Adviser(ONSA).

“Some serving and former military chiefs will have to respond to issues which we have already isolated for clarification.”

The source said investigators have already obtained the list of military equipment which were bought and the inventory by the Armed Forces.

“This explains why some serving and former military chiefs will need to come and assist our investigators,”he said.

“Some of the companies which supplied these equipment have been contacted too.”

On the purchase of security vehicles for Niger Republic,the EFCC is said to have established that the money by ONSA on the purchase of vehicles for Niger Republic was withdrawn from the ONSA account in two installments of €1, 401,869 and €2,252,252.25,

The commission is keen to confirm whether or not the vehicles were bought and under what diplomatic or bilateral security cooperation.

It was gathered that it would require finding out from the Republic of Niger if there was such assistance from Nigeria.

The International Corruption Unit (ICU) of NCA on October 2 arrested Diezani and four others.

The identities of the remaining four suspects are yet to be unveiled.

But all the suspects are being investigated for alleged bribery and money laundering.

The EFCC source, who is actively involved in the ongoing investigation, said: “We have been collaborating with NCA on Diezani’s case which has reached an appreciable level.

“We have the details of others arrested with Diezani but we will not disclose until the matter gets to a convenient bend.

“So far, we have been comparing notes with NCA on a faster note in terms of tracking a few transactions and documents. There is no hiding place for the ex-Minister and her alleged accomplices.

“By the time the trial begins, the NCA and EFCC would have established a solid case against the ex-Minister and other suspects.”

In an article that has gone viral around the world, titled ‘Nigerian President Muhammadu Buhari Dupes the US’, Bruce Fein criticized Nigeria’s leader for “uttering time-worn democracy vows” during his visit to the US, where he promised “to combat graft with procedures that would be “fair, just, and scrupulously follow due process and the rule of law, as enshrined in or constitution.”

It said, “After celebrating fairness, due process, and the rule of law last July to win the goodwill of the United States, Mr. Buhari returned to Nigeria to mock all three in a vendetta against Dasuki, the immediate past National Security Adviser.

“He placed Mr. Dasuki under house arrest. He confiscated his passport. He charged him with firearms and money laundering violations. He sought a secret trial to prevent independent scrutiny.

“He opposed Mr. Dasuki’s pretrial application to the Federal High Court sitting in Abuja for permission to receive urgent medical treatment for cancer in London, but it was nonetheless granted.

“Justice Adeniyi Ademola explained that an accused is presumed innocent before trial, and that a citizen’s health is paramount before the law. Mr. Buhari was ordered to release Mr. Dasuki’s international passport.

“Mr. Buhari defied the order. He put Mr. Dasuki’s house under siege, a microcosm of the Bosnian Serb siege of Sarajevo. Mr. Dasuki returned to court. Justice Ademola reaffirmed his order, asserting “My own orders will not be flouted.”

“Mr. Buhari has not yet budged. As a military dictator in 1985, he similarly seized the international passport of Chief Obafemi Awolowo to thwart his travel for medical treatment, which caused his death in 1987. The more things change, the more they stay the same.”

Calling Dasuki’s situation an “ongoing persecution,” Fein noted disparagingly that “Members of Nigeria’s National Assembly and Senate have been reduced to playing the roles of extras in cinematic extravaganzas.”

Recalling some of the low points of the Buhari military regime in the ‘80s, the publication said the era “was earmarked by chilling human rights abuses,” which it said included, “draconian edicts, exemplified by Decree 20 under which the judicial murders of Nigerian citizens Lawal Ojuolape, Bernard Ogedengbe, and Bartholomew Owoh were authorized.”

It noted that Ogedengbe was executed for a crime that did not carry the death penalty at the time it was committed in violation of the universal revulsion of EXpost facto laws.

Quoting Nobel Prize laureate Wole Soyinka, the article said “these crimes were executed in defiance of pleas from virtually every sector of Nigeria and the international community—a grisly precedent for subsequent dictator Sani Abacha’s hanging of Ogoni activist Ken Saro-Wiwa in contempt of international opinion.”

It further noted that Buhari’s brutal military dictatorship was overthrown in 1985, adding, “Mr. Dasuki played a key role. Dictators do not forget. Fast forward to today.”

According to Fein, “if Mr. Buhari flouts Justice Ademola’s order with impunity, judicial independence will be fatally compromised and Nigeria’s embryonic democratic dispensation will be stillborn.”

“The judiciary is the only branch capable of checking limitless executive power—the bane of Africa.”

Fein such actions could work against peaceful transfer of political power on the continent as incumbents would be afraid of being persecuted by their successors.

“President Goodluck Jonathan’s administration accepted a peaceful transfer of power to President Buhari, a laudable landmark in African politics.

The CCT is an inferior court to the Federal High Court. The CJN will soon make a reinstatement of the law and the CCT will be called to order in order for the judiciary not to be upturned over this issue.

Agbakoba: The Code of Conduct Bureau is Not a Superior Court…
Former President of the Nigeria Bar Association, Chief Olisa Agbakoba has said the CCT was wrong to say that it was a court of equal jurisdiction with the Federal High Court.


“There are two kinds of courts in Nigeria, superior and inferior. All the superior courts are defined in Section 6 of the constitution; it does not include the Code of Conduct Bureau, it does not include the National Industrial court,” Agbakoba said.


According to him, “The Code of Conduct Bureau is not a superior court; it is an inferior court and because it is an inferior court, it is amenable to the judicial review jurisdiction of a superior court of record like the Federal High Court.”


The Federal High Court, he said had power to review the judicial work of the Code of Conduct Bureau because it is an inferior court.
Also reacting, Ebun Adegboruwa described the Tribunal’s action as an assault on rule of law. “What the Code of Conduct Tribunal did in spite of the order of the High Court amounts to judicial abuse of the due process of the rule of law and amounts to judicial rascality on the part of the serving judge of Code of Conduct Tribunal.”


Adegboruwa said the Tribunal was under the supervisory jurisdiction of the High Court, adding that the option left for the Tribunal was to approach the court that gave the order to either challenge it or vacate it.


He said, “It will amount to total anarchy for the parties affected by an order to decide whether or not to obey the order. So, to that extent, the bench warrant issued against the Senate President is ultra vires, it has no place in law and cannot be enforced, because if the order of the High Court to the tribunal was not enforced also the bench warrant of the tribunal to the Senate President cannot be enforced. In exercising its power to make appointments or to exercise disciplinary control over persons, the code of conduct bureau shall NOT be subjected to any other authority or persons." That is what the Law of the Land says.
And I think its interpretation is simple enough to understand.
Be it superior or inferior, they are authorities and the CCT shall not be subjected to them in its handlings.
