Lexusgs430: Lexusgus430 I haven't paid yet. My question is I bought ticket to go back home in August before the appeal decision came. My ticket is unfundable. Is there a time scale on when they call u to submit ur passport after appeal allow. If he take it now they might issue it earlier and the 30 days will be over. So was thinking of him submitting it on 17th July?? Will that cause any issues? Thanks |

Hi Lexusgus430, Justwise Update regarding our appeal. Thanks be to God for all He has done. So Hubby received email today from them saying the decision has been overturned. He should pay the NHIS and submit his passport and TB test to the visa centre. The issue now is, I didn't get a refund of the NHIS up to now. Is there anyway or number I can get hold of them? We have the reference number and the email we recieved to acknowledge the payment. Thank you 2 Likes |

Lexusgs430: The judge was calm and she had a smiley face. My barrister said it was good and looking at the way he see things, the judge will allow the appeal but I should pray. |

Hello Lexusgs430, Justwise and everyone Just to update you on my appeal and those waiting for hearing. So my hearing was this morning. There was a representative from the home office (young guy and )my barrister and the Judge was female. Before the judge started the hearing, she said the refusal was based on relationship is not genuine and the case for hearing today should be based on that. Questions asked by my barrister 1. Did you sign the witness statement and do u want it to be used as evidence? 2. What date did u meet your spouse and why is the date significant in your life? 3. How often do u communicate with your husband? 4. What means do u communicate? Home office representative question 1. Does your husband work? 2. Why do u send him money? 3. Have u been back home since you got married? 4 . How many times and which month and year? 5. Did u go back home before u got married? 6. How many kids do u have? 7. Do u have kids with your husband? 8. The pics you submitted were they taken on different trips or one occasion? The Judge turn to ask me questions but she said she has nothing to ask me So the home office representative and my barrister had to now argue on the case why the appeal should be allowed or not. The HO representative said mean going back home twice since we got married doesn't really mean I go there to see my husband and also although I have provided means and evidents of all communication doesn't mean is him I communicate with. He also said although there several pics taken doesn't mean I took them on different trips. That's all his argument but my barrister really argued a lot using different acts and references to some cases. Also my daughter wrote a letter to attach to the documents and that one too was raised by my barrister. He really argued very well and the HO guy was sitting looking at him. The judge then said she has to go through all my bundle as it a huge one(537) pages in all nicely labelled. We will hear from her in weeks. So expects in the house what do u think the outcome will be? I have faith and my barrister also said I did well by answering the questions truthfully and nicely. Any idea? Thanks |

Hi everyone Please am gathering my documents for the appeal hearing.Am a bit confuse regarding my payslips although Hubby's refusal was based on not enough communication printout and I didn't add my travel stamps and also not enough pictures but we sent over 50. My question is, it is ok to send printout of my payslip or I have to get the original one as my lawyer says is just for the court so the print out is ok but I want to know if is true. As Lexusgs430 adviced am sending all documents like new application. Thanks |

Thanks so much Luxuags430 and Stillwaiting. The lawyer didn't let me send all the pictures during the initial appeal cus she said it can be lost through the post. I will give them everything as you said like my last oxygen. This lawyers sometimes mmmmm? I wish I knew this site before my initial application. Is for my husband and the wait has been stressful. Please do I need to submit payslip although they didn't say anything about my financial part. Thank you |

Also I printed 2months of whatsapp chat due to phone damage and 6 months call printout from lycamobile. Good morning everyone Please when you write a letter to your MP regarding an appeal, do they write to the tribunal or the home office? I contacted my MP regarding my husband's appeal as we were told they really busy and we can't hearing date this year unless next year, meaning it will take over a year. My MP got back to me saying he has contacted the tribunal and they said they will get back to him by 8 weeks. Has anyone done this before and how long did it take? What was the outcome? Thanks everyone will wait for the hearing date. @ tenderule My husband got his decision email without IHS refund but was refused. We haven't got the refund till now since October 2015.We appeal and waiting for a hearing date. |

The IA10 (Notice of Pending Appeal) was sent to the Appellant, Representative (if applicable) and Respondent on the 01/12/2016. This notice is for your information only as it is for the Embassy to action. We can confirm that we have received the respondent bundle. No further action is required from you at this stage. Please quote your Tribunal Appeal Number in all correspondence when contacting us, as we may not be able to assist you without it. **Please note that a Sponsor is only entitled to receive the Notice of Hearing. bankyg04: Hi Banky Our 15weeks ended yesterday and up till now, we haven't heard anything. I called the appeal court but they told me they haven't heard anything from them. My hubby was also refused based on communication printout not enough. I heard they have backlog but will update you if anything comes up and pls try to also update me as well. Thanks |

Congratulations to everyone who has been granted their spouse visa. Those of us waiting we celebrate with you all and pray we also share the good news very soon. Appeals take ages and sometimes is better to reapply. We got refused in October and did appeal same month. The court wrote to us in December and gave us 15 weeks which ends coming Tuesday. Am praying we hear good news in Jesus name cus the waiting is killing. Still no refund of NHIS. 1 Like |

@ Jeljay The NIHS can only be refunded if you will not be given the visa at all. My hubby was refused in October 2015 but we were not refunded the money as he was given an appeal. If you go on their website, it explains it there. It was a minor issue about chats print out not enough, pictures and travel stamps. We have appealed and waiting. The VAF doesn't say refused or granted. We had email with VAF but was refused. Does anyone know roughly when the ECO response to the court during an appeal. We received a letter from the tribunal saying they have written and send our documents to the ECO and they have until 15th March to let us know the outcome. If they will overturn the decision or we go to court. Has anyone gone through this process before and how long does it take to hear from them? Thank you |

@ Jangolo I will advice you to print more of the whatsapp chat if you got them. My hubby applied in July this year and we thought it was too much so we printed just two months of the chat, added money transfer receipt and printed the calls we made to each other. He was refused cus they said the chat wasn't enough so the relationship is not genuine. I posted the refusal letter on my page so you can go through. It was just minor things so we have appealed. And with the questions It depends on the person interviewing you. All the questions here came but the funny question he asked my hubby was: Has he had body contact with me before? When was the last time? Hahahaha |
