Well, if politics has thought us anything, it is that change is constant. The republicans will leave the democrats little choice but to do this and if the democrats do make this massive change, it is certain that every election will now have massive stakes, one that ties directly to the Supreme Court appointments. Mitch himself changed a long standing tradition by refusing to even hold a nomination confirmation hearing of a Supreme Court nominee by the sitting president. If he and his cohorts would do that 10 full months before an election, why on earth, would they reverse this trend just 4 years later with just 45 days to the elections?
Furthermore, on the question of the electoral college numbers, that is not just a tradition but a constitutional law. States electoral college numbers are directly proportional to that state's population determined via the census. State's cannot do anything about that.

You both still don't get my point. The number of Supreme Court justices being only 9 is not a constitutional law but simply a tradition. One that can simply be altered by congress. As a matter of fact, there were once 10 Supreme Court justices in the 1800's. If the republicans ditch their honor and pick a conservative justice to replace RBJ, nothing will stop the democrats from increasing adding at least two Supreme Court justices to the bench to make it 11 once they regain the majority

The President makes the nomination. You can’t confirm someone not nominated by the President.
And he can only make a nomination if a justice dies or resigns.
No matter the majority a Republican President would just keep on nominating conservatives until one is confirmed and a Democrat would keep on nominating liberals until one is confirmed.
So a majority is not as significant as you would think.
I know that the president makes the nominations. I'm saying that if the democrats win both the presidency and the majority on both houses, they can increase the number of supreme court justices from only 9. the last president who attempted this was FDR. If moscow mitch succeeds in making it a 6-3 conservative court, democrats will have little choice but to increase the number of supreme court justices when they win the majority.

Mitch McConnell already said he is going to confirm anyone Trump nominates even though he was against Obamas nominee when Justice Scalia died in February 2016 Republicans only need a simple majority to confirm the next judge.

They will definitely try to push a nomination through before the election.........just in case Trump loses. That would be crazy cos it would mean Trump would have appointed 3 justices in 4 years.
If the republicans do this now, nothing will stop the democrats from flooding the supreme court benches when they win the majority. That will be the only way forward for them.
