Politics › Re: Appeal Court Reserves Judgment On Ikpeazu’s Sack by eagleeye2: 2:49am On Aug 10, 2016
Xtopherprince:
Reserve Judgement is a legal term not too many people are familiar with, below is all you need to know about this term.

Q : What does it mean that the court has reserved its judgment?
A : When a court reserves the judgment, it means the matter has been kept in abeyance for a while. This is done after all
the parties have completed their arguments and all the written submissions have been filed in the court.

Q: Why do judges reserve a judgment?
A : The judges reserve a judgment so they can write a judgment. One must understand that a judgment is not a single page order of few lines, the judgment contains the summery of arguments of
both the parties, the law of the land, previous judgments on the issue, conclusion and the reasons for arriving on that conclusion. Judges need time to refresh in their memory, the arguments of
each party, do research by reading previous judgments and judgments on similar issues
in other countries and finally think about the reasons for arriving on a particular conclusion. This entire excersise is very laborious and time consuming.

Q : What is the normal timeframe in which a judgment should ideally be delivered?
A : There is no fixed timeframe for the judges to write judgments but six months is considered to be a reasonable time for passing a judgment. If a judge keeps a
judgment reserved for more than six months, any of the party can mention to the Chief Justice about this.

Q : What happens to a reserved judgment if the judge retires?
A : If anything like this happens, the new bench will hear the matter afreash. A judge can not sign/pronounce a judgment after
he retires.

Q : Is it necessary for a judge to reserve judgment in every case?
A : No! Its not at all necessary for a judge to reserved judgment in all the cases. Generally the court reserved judgments in cases of
extreme public importance, cases which will have greater impact on the polity of Nigeria, cases in whcih the courts are laying down
some new law etc. In many cases, judges deliver the same day the arguments are complete.
Thanks

How can different state Government owe workers 3,4,5,6 months salary and you expect the civil servant not to find a way to survive?
.
on NL we laud Buhari and APC, clap for Fayose and PDP, but we never stop to ask if their fighting and policies are for the common manhuh
.
Men I use to believe in not asking for bribe and kickbacks, but now if you give me I will collect.

The most annoying thing about people like the OP, is that they will never want to follow the due process.

Could it be because he doesn't Trust the quality of Education being given in Nigeria....

you are right about "political head" but even ministers and commissioners have their tax deducted @ source.......infact most public and private employers serve as agents to tax authorities..........its only business men who pay their tax by themselves
My brother, I wouldn't know that, unless I question some past commissioner I know.
But, Ogah and his lawyers wouldn't be in court if they think there was no case. I just feel for Ikpeazu.

MadamExcellency:
Actually that is what Okezie is claiming happened but the suspicion arises from the haste the document was compiled and reproduced coupled with mistakes on the said clearance certificate signifying certain exception to the rules.

Notwithstanding, I believe the document is not Okezie's business to defend rather the onus lies on the issuing State agency to either defend, set aside or disprove.
MadamExcellency,
If I were asked to provide my tax clearance or show evidence of tax payment, all I have to do is to write my ministry and they will search out the relevant document for tax.
There is something that's actually not clear in this case. No lawyer will make the mistake of going to court over tax evasion when it concerns a Career civil servant.

I think a commissioner is the head of a department followed maybe by the HOD and then perm second (I stand to be corrected) and ASEPA as it stands is under the ministry of environment...........Asepa staff pay their tax at the source just like any other civil servant
A commissioner is the "political" head of the ministry. The Permanent Secretary is the actual career civil servant who heads the ministry. And can last longer on the seat more than any commissioner.
If Dr Ikpeazu was a career Civil servant and not appointed to head the ASEPA, believe me the issue of tax evasion would not have come up.
Please make your findings.

sir if he was not a civil servant under Abia state environmental protection agency (aba zone) what was he a military servant? business man?, please tell me, I might learn one or two
I believe he was a public servant, just like a Commissioner. Thank you.
Modified.
If Dr Ikpeazu was a Civil servant as you have claimed the issue of non payment of tax won't even have come up in the first place. Because as you rightly stated, it will be deducted at source.
All he would have done is to petition the relevant ministry or organization to provide his tax clearance receipts.

if you don't know that civil servants have their taxes deducted @ source then.
Sorry to interrupt your argument. Dr Ikpeazu, as ASEPA deputy boss (or boss) was not a Civil servant and his tax couldn't have been deducted at source, I believe this to be the case.

If you do that........he will ruin the bank, cause job losses and kill the branch even with his acclaimed integrity. But if he employs his integrity in mediating in the village land disputes, settling of couple's fight and equitable distribution of community lands to farmers at farming seasons, he will remain a champion. It takes more than just integrity to run over 500 billion dollar economy (the integrity is even now in question sef.)
