senatordave1: A week to the September 21, 2024, governorship election in Edo State, Senator Francis Alimikhena and Hon Omoregie Ogbeide-Ihama have formally dumped the Peoples Democratic Party (PDP) for the All Progressives Congress (APC).
DAILY POST reports that the duo were in the 8th and 9th National Assembly, respectively.
Alimikhena is the immediate past senator representing Edo North Senatorial District, while Ogbeide-Ihama is also the immediate past representative of Oredo Federal Constituency.
The duo were both received into the party by the National Chairman, Alhaji Abdullahi Umar Ganduje.
Speaking, Senator Francis Alimikhena, who said he was glad to be back in the APC, assured that he would mobilize his followers to vote for the party in the governorship election.
On his part, Ogbeide-Ihama said he had earlier advised his former party, the PDP, against its decision when it brought in Governor Godwin Obaseki in 2020, but they didn’t listen to him.
“In 2020, I advised the PDP against impunity when they brought in Governor Godwin Obaseki through the back door. In 2024, Governor Godwin Obaseki, who came through the back door, went to Lagos to bring Asue Ighodalo through the same back door.
“The man only joined the party in September last year. That impunity must stop.
“All those who supported the impunity, the National Working Committee, they should come with their Voter Cards on Saturday, while those who didn’t face their states and said that the governor must produce his successor should also come on Saturday.
“The governor and I are from the same local government. The results will tell. We did that to him in 2020; we will do it again for Monday Okpebholo in 2024,” he said.
DAILY POST recalls that Francis Alimikhena contested the senate seat with Senator Adams Oshiomhole on the platform of the PDP.

All signs points to pdp resorting to rigging and violence.you can't point APC to any untoward incident .. During the cvr, non pdp faithfuls were stopped from registering in Benin which led to violence. Lp and APC campaign teams have been attacked severally in the speaker's ward. Section 153f(1) of 1999 Constitution empowers INEC to: Organize, undertake and supervise all elections to the offices of the President and Vice-president, the Governor and Deputy Governor of a state, and to the membership of the Senate, the House of Representatives and the House of Assembly of each State of the Federation.
Again, INEC Regulations is backed by law. What the Supreme Court has said is that "where there is a conflict between the Electoral Act & INEC's Regulations", the Electoral Act supercedes and takes pre-eminence.
Whilst the Electoral Act didn't speak about uploading of agents to a dedicated web portal, Section 9(b) of INEC's guidelines did. Aligning Section 43(1) of the EA 2022 and Section 9 of the IR&G shows there is no conflicts whatsoever.
INEC prepared a timetable before elections as they are empowered to. What happens when anyone goes against already prepared schedule. Only the Courts can say otherwise. It is within the powers of the Commission to prepare Timetable and Schedule of Activities for elections.
Let me give you an example, in the past INEC set Primaries perhaps one or two months to the election. But in 2023, they did well in that regard, allowing primaries hold even over 6 months before the elections so that litigations arising from primaries may have been concluded.
This is untrue. There must be dire circumstances for INEC before it can deviate from its own rules. INEC Regulations & Guidelines is backed by law. If it holds no water, then why prepare it in the first place? If INEC continues to change the goalpost at will, then parties will scream bias.
You are referring to section 9a "A Political Party sponsoring a candidate may by notice appoint one person as its Polling Agent for each Polling Unit, one Polling Agent for each Collation Centre and one representative at each point of distribution of electoral materials in the constituency where it is sponsoring candidate(s) for an election. "
Section 9(b) of INEC's Regulations and Guidelines: The notice referred to in 9(a) shall be in writing, signed, addressed, and delivered (or uploaded to a dedicated web portal as the Commission....)
(9c)The notice shall contain the names, addresses and recent passport photographs of the Polling Agents and the respective Polling Units or Collation Centres to which they have been assigned, and shall be submitted or uploaded to the web portal not later than the last day stipulated in the Timetable and Schedule of Activities for the election.
The Supreme Court many times has said the word "shall" indicates mandatory or compulsory as the case may be. -------------------------------------------------------------------------------------------------------- To add to this, let's get to the meat of this issue.
Political Parties were asked to upload the biodata of their agents from July 17-30, 2024. Names, photos, etcetera. Whilst some parties uploaded correctly, others chose to upload emojis, photos of foreigners, even memes, and fictitious names so i don't understand where the legal issue is. Anyone aggrieved can go to Court like I heard a party is doing, trying to get an exparte.
However, I can't fault INEC on this. I wonder why people put emotion and prosecute reality Why did APC not upload their agent at the right time. I was expecting him to state that fact but he said nothing about it |
