I answer the only question in the Originating Summons in favour of the Plaintiff to wit:
"In the interpretation of section 39(1) & (2) of the 1999 Constitution, the National Universities Commission’s act Cap N81 L.F.N 2004: the Richard Open University is not an illegal private university, justifying the action of 1st, 2nd and 3rd Defendants, having answered the question in favour of the Plaintiff. I hereby grant prayers (a) (b) (c) (d) and (f) as prayed on the Originating Summons. Relief (e) is a consequential relief for an Order for exemplary/aggravated damages 1st, 2nd & 3rd Defendants in favour of the Plaintiff."
This is the judgment of the Court:
(a) That in purview of section 39 (1) and (2) of the 1999 Constitution; Richmond Open University established for the dissemination of information, knowledge, ideas and opinion is not an illegal private university.
(b) That the Acts, Declarations by the 1st and 2nd Defendants the Agents of the 3rd Defendant through the National Press particularly Wednesday, April 26, 2006 ‘Daily Independent’ to wit that Richmond Open University. Arochukwu, Abia State is illegal, and to close down the illegal operations of the institution" is a flagrant violation of S.39 (1) & (2) of the 1999 Constitution.
(c) That S.4 and 5 of the National Universities Commission’s Act cap N81, relates to powers and functions of the 1st and 2nd Defendants to advise the president and the Government of the State, through the Ministers, on the creation of new universities and other degree – granting institutions in Nigeria, and has no provision which can legitimately limit or restrict the right of the private individual to establish a university.
(d) That the said acts/declaration by the 1st, 2nd and 3rd Defendants is illegal, arbitrary, unconstitutional, null and void.
(e) Exemplary/aggravated damages in the sum of N5 million against the 1st, 2nd, and 3rd Defendants in favour of the Plaintiffs.
(f) Perpetual injunction restraining the defendants from interfering in the institution, Richmond Open University established for the dissemination of information, knowledge, ideas and opinions. Being a Business Economic Enterprise which the Plaintiffs have right to own and operate under the constitution and the defendants have no power to abolish or close except as provided for under the statute.
The public must know that neither the National Universities Commission nor the other defendants filed any Notice of Appeal against the final decision of the Federal High Court in suit No.FHC/EN/CS/76/2006, delivered on Friday, 14th day of July 2006.

The likes of NUC, Julius Okojie by their unconstitutional acts in flagrant violation of a subsisting Court judgments against NUC, in favour of a law abiding corporate citizen, Richmond Open University is a clear invitation to anarchy and totalitarianism which are antitheses to democracy and constitutional government.

Youths across the six south western states have expressed their readiness and determination to back President Goodluck Jonathan to emerge as the nation’s president in next year’s general elections. The youths under the aegis of Youths Ask for Goodluck (YAG), are already mobilizing their counterparts across the country for Jonathan ahead of the 2011 general elections.

Speaking to Daily Sun in Ibadan, Oyo State, the Chairman of the group, Mr. Ayodele Olusegun, explained that the group was informed by enlightened professional youths who believed that it was high time a youth took over the mantle of leadership in the country.

He revealed that the group was borne out of their patriotic zeal to serve their fatherland, lamenting that over the years, the nation’s political landscape had been in the control of recycled spent forces.

“It is expedient to inform our good people of this country that the group, Youths Ask for Goodluck (YAG), was not borne out of political consideration or desire to earn pecuniary gains. We believe as youths that we must be the torch bearers for our country to move forward.” Olusegun pointed out that the emergence of Jonathan was a divine act and the only way out was for all Nigerians to support him in the onerous task of improving the fortunes of Nigerians.

The YAG boss noted with pride that Jonathan has since his assumption of power, exhibited uncommon patriotic zeal to redeem the image of the country. “As youths, we do not have any other choice than to work in close concert with him to restore hope and happiness in our people. This is the time to move ahead. We must shun any act capable of derailing the country,” he added.

Peoples Democratic Party (PDP) governorship aspirant in Imo State, Chief Brady Chijioke Nwosu, has said that the rotation of political offices is the best for a multi-ethnic nation like Nigeria. In an interview with Daily Sun, Nwosu, while maintaining that it is the turn of the North to produce the President in 2011 as espoused by the founding fathers of the party, noted that it is only through zoning and rotation of political offices that every region will have access to political power at the top

Zoning has been with us
In 1914, it was two regions, the North and South that amalgamated to form Nigeria under Lord Lugard. Before then, in 1908, the West and the East had fused to become Southern protectorate with headquarters in Lagos. At independence, even though there were three regions - East, North and West, the federal seats were shared on the principle of 1914, which only recognized the North and the South. That was the reason why 50 percent of seats at the federal house went to the North while the South, which comprised East and West shared the remaining 50 per cent equally. This principle has been followed and maintained by successive governments. Even during state creation, this principle was upheld.

During the Second Republic, the five and later six political parties enshrined the unwritten agreement of the principle of North and South for power rotation. The ruling National Party of Nigeria (NPN) recognized North and South as the parameter for power rotation, which would have led to power shifting to South after the termination of Alhaji Shehu Shagari’s tenure in 1987 had the military not struck to truncate the civilian government then.

It was during the constitutional conference set up by late the General Sani Abacha that the idea of six zones came into focus. Of these six zones, three are in the North and the other three are in the South. When the present ruling PDP was formed in 1998 by politicians from various zones, they agreed that for equity to be institutionalized in the polity generally, power should rotate between North and South with South taking the first slot of eight years (1999 - 2007) and thereafter the North. No groups, persons or zones objected to this. After the unfortunate death of former President Umaru Yar’Adua from North and the eventual ascension of Goodluck Jonathan, his deputy, to presidency, this principle that has held us together is about to be cast overboard as politicians currying favour of the president now see truth as anathema and are speaking from both sides of their mouths against the rotation principle in the party.

Jonathan is a beneficiary of zoning
President Jonathan is a beneficiary of the same zoning of political office he now wants to do away with. He should be humble and grateful enough to God that has brought him so far without shedding much sweat. Jonathan should avoid the hangers-on that want to drag him to run in 2011. This will be taking his good luck too far, thereby destroying the present order, which in the long run will generate bad blood.

Whether we like it or not, in a multi-ethnic nation like ours with low literacy level and where citizens have much attachment to place of origin, ethnicity and religion will for a long time be determinant factors in deciding our political leaders. Is it possible to elect both president and vice of the same religion from the same zone irrespective of their competence? The answer is no, which is why ethnicity is an issue. We should respect the rotation principle and ensure that only the most competent from the zone whose turn it is to produce the presidency occupies such office. Every zone at any time has credible people to run for the highest office in the land.

The fear of Jonathan running for 2011
After his first term that ends in 2015, he would go for second term since the constitution allows him and would end up in 2019. That means he must have ruled for nine years making him the longest civilian president. Since it is now survival of the fittest, if power eventually goes to the North, it will be difficult for another zone to get it again because, the North is monolithic unlike the South. There is the advantage of population for the North, which has more local governments, wards, states, and more members in the National Assembly. So if 20 years after 2019 and the North are still holding to power, the cry by the South against northern domination should not arise. We should remember that it was the seed that was sown in 2011 that the South will be reaping.

This is the best time to avoid the hue and cry of northern domination of political power in future by the South. We should remember that in 1999, the SouthWest rejected Obasanjo and didn’t vote for him but with the northern votes he won without the support of his people. That tells the strength of the north.

Jonathan 2011 is no threat to IBB
Even though it is assumed that Jonathan is running in 2011, he can’t hinder IBB’s ambition. The President has not contested any election before. He has no political structure. It will be unfortunate that the first time he would be contesting election that he would fail. If I were Jonathan, I will resist the temptations and quit while the ovation is loudest. If there is a level playing field as he is canvassing through the electoral reforms, the President will lose in his contest against IBB. The former military President has much advantage over him. IBB is bridge-builder and does not have boundary. He is easily accessible with immeasurable goodwill. Apart from his military and security knowledge, he has good interpersonal memory and cognizance and wealth of experience from the past.

I want to reposition Imo State
Imo State is experiencing the biblical Ichabod. The glory has left the state. It is my desire to bring the lost glory of the state. I am coming to restore hope in place of despair and gnashing of teeth. The governor Ikedi Ohakim has tried his best in the state.

With me, Imo people will experience a new lease of life. All that make life meaningful will be provided. The expectation is so great on the people as they will have their destinies fulfilled.

A full-scale war was on Wednesday declared against the Speaker, House of Representatives, Dimeji Bankole, as a group of lawmakers issued him a seven-day ultimatum to resign or be disgraced out of office. But in a swift reaction to the ultimatum, spokesman of the House, Sunday Eseme Eyiboh, described the activities of the group as a swan song from an orchestra of perspectives, which the public must ignore.

In an unsigned statement, Eyiboh said; “The attention of the leadership of the House of Representatives has been drawn to the activities of some self-styled ‘progressives’ in the House, who misled the perceptive public with their proverbial ‘ostrich display’ of selfish tendencies in the guise of public interest.

“Their activities could best be a swan song from an orchestra, but they are advised to avail themselves with the allowances of House rules and extant provisions of the relevant statues. “The present leadership is a creature and creation of the generality of the House and the prevalent synergy culminating in the successful Constitution review vindicates the acceptability of the leadership,” he said.

Armed with a bundle of alleged ‘incriminating’ documents, Mr Dino Melaye, who addressed the Press on behalf of a group of members, accused the Speaker of corruption, tyranny and causing rifts between the House and the executive through unguided statements. Dino had earlier promised to make the House ungovernable when it resumes from a two-week recess on June 22, at a time when allegations were made that the life of the Speaker and his aides were under threat.

Bankole had been having a running battle with some lawmakers, which climaxed in an open confrontation with a member, Mr Independence Ogunewe at the lobby of the chamber before the House went on recess.
The group vowed to open a can of worms if the Speaker failed to heed the advice to quit office at the expiration of the ultimatum. Dino was accompanied to the briefing by Mr Ehioge West-Idahosa [PDP] Edo state, Bitrus Kase [PDP] Plateau, Austin Nwachukwu [PDP] Imo, Asita Honourable [PDP] Rivers, George Daika[PDP] Plateau, Anas Adamu [PDP] Jigawa, Ralph Okeke [PDP]Anambra, Darlington Okereke [PDP] Ebonyi state, Solomon Ahwinahwi [PDP] Delta and Ogunewe, [PDP] Imo.

Chronicling the ‘sins’ of Bankole, Dino said that as progressives in the House, the call on the Speaker to resign honourably was to restore the dignity of the lower Chamber of the National Assembly. “Our call is a clarion call to right the wrongs of legislative businesses and condemn the bad leadership in the House of Representatives and the negative image.

“We are here this afternoon to unequivocally say without fear or favour, that the House of Representatives you read about in 1999, the House of Representatives that West-Idahosa was a member of the House in 2000; the House of Representatives with its sterling qualities exhibited during Na’Abba; the House of Representatives that was labouriously built by Masari is not the same with what we have today,” Dino said.

He stated that the House used to be pacesetters of legislative practice in the country, but had been overtaken because of ineptitude of leadership, adding that not only that public perception had declined, the House, according to the group, had lost its positive reputation. “ We hereby, in strong terms call on Bankole to resign immediately as the Speaker of the House of Representatives within seven days. We are asking him to resign for the following reasons: Corruption in leadership; because of his leadership style, which today is responsible for the rift, disagreement and disharmony between the two brothers in the National Assembly, the Senate and the Representatives. The relationship between the two chambers has never been this bad.

“ We are also asking him to resign because of his highhandedness, disrespect for members; frequent breach of the rules of the House, his sweeping and unsubstantiated comments capable of causing disaffection among the various arms of government. “For example, when the Speaker openly accused civil servants of gross corruption, and the then Head of Service, Amma Pepple wrote an official letter to the Speaker and challenged him to substantiate his claims, and the Speaker till date is yet to respond.

“ This is bringing the reputation, the integrity and the name of the House into disrepute.
“And I want to say that, failure to comply with our call in the interest of Nigeria and Nigerians, especially the masses of this country, this group has overwhelming evidence, information and they are incriminating records that we will publish and give to you, the media, and assure you in seven days.”

Dino assured that the group would send the documents to appropriate agencies of government such as the Economic and Financial Crimes Commission (EFCC), the Independent Corrupt Practices and other Related Offences Commission (ICPC), the National Security Adviser (NSA), the State Security Services (SSS) and the political head office of the Speaker’s party.

“This is no child’s play. We have resolved to clean our House. We have resolved and are determined that he who comes to equity must come with clean hands. And we have resolved that the evidence will be given to each of you.
“And we are ready to defend it anywhere and anytime. This is not a secret presentation. We are very, very sure of facts that these documents are incontrovertible and we know that in the normal leadership style of Bankole, they will tell you that these documents are fake. Our challenge is that by the time we present them to you, after our ultimatum, we will tell them that anything that has fake, must have original.

Shedding more light on the fight against the Speaker, West-Idahosa, who was part of the team that wrote the House Rules in 1999, described the reign of Bankole as a misfortune. “We have never had it so bad. We have never had such a legislative tyranny as we do have now. We have never in this House turned our Privileges Committee into a hunting machine of fellow members.

“Do not be surprised that as soon as we brief you, we may be earmarked to face that committee over one allegation or the other. But, let me tell you, we will rather die than to lose our courage to speak the word of truth to those who trample on the indignity and becoming very ruthless in the face of truth. “I believe democracy had been trampled upon and I can assure you that many members have been castrated. They can no longer air their views, but we shall break that spell today by this decision to call a spade a spade and to take this struggle to the next level.

“We were glad that the EFCC has sent the report of the N2.3 billion car scam to their legal department, although we quarrel with the delay. We realise that they concluded that investigation a year ago. We crave the leadership of the EFCC to quicken action on it. Because Nigerians are waiting for justice, we knew it long time ago that although the leadership was indicted, but for many reasons, the EFCC was sleeping on duty. But now that they have woken up, we were to welcome them.

“We have set the machinery in motion to ask for an order of mandamus to compel them to do a public duty because it is no use fighting the war on corruption on the pages of newspapers. There can be no better place of corruption than what happened in the N2.3 billion scam. If I may ask, what did Etteh do? “She tried to get anticipatory approval to make an expenditure which was quarrelled with, and described as “anti-morality” and we forced her to throw in the towel,” he concluded.

House spokesman, Eyiboh had in his statementwarned the public not to be deceived as most of these persons lost out of the recent committee reshuffling or were turned down on their blackmail to get ‘juicy’ committees from the leadership were behind the call on the Speaker to resign. “Those ‘progressives’ should vacate their theatre or be absolved and come join other discernible members to complement the current legislative engagements for executive action.

“The call for the resignation of the House leadership is part of the orchestrated plot by these ‘progressives’ to make the House ungovernable as threatened by the arrowhead of the group. “Once more, I wish to alert the relevant security agencies to this destabilisation plot of an arm of the government of the Federal Republic of Nigeria.

“We want to state that the various allegations being parroted are false with some of them based on forgery of government documents. This is another area we believe the security agencies should investigate in the interest of the nation,” the Chairman, House Committee on Media and Publicity said.

2011:PDP Presents 5 Guber Aspirants
Lagos State chapter of Peoples Democratic Party [PDP], has announced that five governorship aspirants has signified their interest to contest the governorship election in 2011.
The aspirants, who held a closed door meeting with the executive members of the party at the party sceretariat GRA, Ikeja, Lagos, include Dr. Adedeji Aganga-Williams; Dr. Ade Dosunmu; Chief Tunde Etti; Mr. Owolabi Salis and Mr. Babatunde Gbadamosi.
The party executives also held a meeting with 24 aspirants vying for the state House of Assembly seats; 14 others for the House of Representatives and one aspirant for Senate, in the 2011 election.

Speaking shortly after the meeting, the governorship aspirants expressed their desire to work for the overall success of the party in the 2011 election, irrespective of who emerges as the party’s candidate.
According to Aganga-Williams, the party is concerned about what he termed ‘economic enslavement’ of the people of Lagos State, adding that it was time to rescue the situation before it degenerates further.
“It can lead to security imbalance, that is why we are offering ourselves to bail out the people of the state,” he said.
Gbadamosi who said that the party was growing in Lagos , also noted that as agents of change, all the aspirants have agreed to support whoever emerges as the party's flag bearer.

Another aspirant, Owolabi, alleged that the resources of the state had been mismanaged, adding that the party was poised to bridge the gap between the poor and the rich when elected into power.
He said that the leadership of the state's PDP called the meeting to find out their level of preparedness for the party’s primaries.

Ibrahim who made the appeal in Abuja when he received the Commander of United States Naval Force in Africa Admiral Mark P. Fitzgerald in his office noted that American supports in the region have tremendously helped to reduce criminality in the gulf of Guinea.

“Your supports have encouraged us a lot and we have brought the ugly situation in gulf of Guinea under normal control”, adding that the presence of US ship had also impacted positively on the training of Nigerian Naval officers who on their own are now capable to trace ships that engaged in oil bunkering in recent time.

Admiral Ibrahim said that the vast nature of the country’s coastal line has made it difficult to police. He said the predicament of the country is not helped by the fact that things that happen in the gulf of Guinea easily become international issues. The chief of Naval Staff assured the visitor that American investments in Nigeria would not be threatened with enhanced Nigerian Navy capability.

Expressing his courtesy, Admiral Mark Fitzgerald who also doubled as the Commander US Naval Forces in Europe said the US will continue to assist Nigeria and African Countries to find solution to their pressing needs. Nigeria as a leading country in Africa would be assisted in her quest to find an African solution in the gulf of Guinea, he added.

He assured Nigerians that by working and training its naval force together they would develop the capacity to operate more effectively in the sea and protect the country interest and its vast resources. It is important that Nigerian people realized the importance of the sea and the fact that her vast resources are protected, he said.

Nigeria suffers from a multiple but system wide disorders that I suspect it will take a committed president 2 terms of concentrating on a few issues to get us moving. The good thing is many of these problems are interwoven and taking care of somewill substantially improve others well in advance of direct action. For example-stable electricity, good roads, portable water will have such a multiplier effect that we will see progress even before we start to tackle health and education issues

Nigeria's problem is not policy, It is IMPLEMENTATION and CONSISTENCY. It is high time Nigeria administators start adopting the principle of continuity. It is continuity that makes any establishment or organization stands. If every leader that comes into position comes up with their policies and put aside the the one in place before their tenure, Nigeria will NEVER grow because every 4,4 years , we'll be having different policy, that will never be fully implemented in the tenure if onle becuase of DUE PROCESS. I think the National Assembly should find a way of including a clause in the constitution that will facilitate continuity of some national policy made towards growth. Continuity and Consistency in policy is what we need.

President Goodluck Jonathan is not the expected ‘Messiah’ who will lead Nigeria out of the woods and into the prophetic land that flows with milk and honey.

Rather, he is like the biblical John the Baptist sent to prepare the way for the much awaited true leader of the nation.
Also, the enemies of the country who had slowed her progress through corruption and crises are in for rough times as they will be literally consumed by the wrath of God before this year’s end.
A Port Harcourt-based clergyman, Prophet Jason Oviekute made the prophesy in an interview with Daily Sun during which he also predicted a woeful failure of former military President, Ibrahim Babangida in the 2011 elections.

Prophet Oviekute pointedly said that President Jonathan was chosen to lay the necessary foundation before the coming of the much-desired leader who will emerge after next year’s elections.

“Goodluck Jonathan is not the expected ‘Messiah’ of this country. He is the John the Baptist that is to prepare the way for the coming elected Messiah. All these things have happened spiritually. God has arranged everything and anything God has done must manifest.
“The ‘Messiah’ we need will come after the 2011 elections. President Jonathan is the messenger God has sent to come and put things right and make way for the leader who is to come.

“My advice is that Jonathan should restrict himself to the special assignment he has in his hands. He is a spiritual man and I believe that God must have revealed this to him too. He knows what to do and when to do it”, the clergyman said.

Stressing that God is no respecter of persons and political parties, Prophet Oviekute said the expected leader with messianic qualities would contest with General Babangida and humiliate the former Head of State at the polls.

“The ‘Messiah’ will contest with IBB but he will defeat Babangida because God backs him. Who can contest with God? Babangida must lose. It is a must no matter how much money he has to throw about. I tell you that 2011 is the year God will give this country its long awaited leader. Who is that person that can resist God’s anointed? The political party is secondary. God will produce the party”, he said.

Prophet Oviekute who said he saw a vision of a rainbow recently, described the rainbow as “a sign of a new covenant of God with Nigerians” to usher in a new dawn of peace and genuine progress in the nation.
“I want Nigerians to know that God is set to raise His Kingdom out of the bad rulership of the past. This Kingdom shall not be left to any other people except God’s people. No mountain can withstand the kingdom. A new dawn of God-inspired government has taken off in Nigeria”, he said.
He warned that beginning from the fourth week of November, this year, certain persons and parts of the country controlled by enemies of the people would face God’s punishment.

“I want to let Nigerians know that God wants to punish the enemies of his people. Let he that has ears hear. The wrath must come. It is another holocaust”, Prophet Oviekute said.
