Indications emerged Saturday that fuel queues have resurfaced in petrol stations across Abuja, the nation’s capital city, with many motorists scrambling to get petroleum products. The recent development is coming days after Nigeria’s presidential and National Assembly elections. Last Saturday, Nigerians elected a new leader to assume the office of the president on 29 May. Bola Tinubu, the candidate of the ruling All Progressives Congress (APC), was declared the winner of the presidential election. In recent months, Nigerian motorists and household users have had a tough time getting petroleum products at filling stations across the country. The scarcity persisted despite the government’s repeated claims it had enough petroleum products in stock. But amid complaints from many Nigerians, the fuel supply situation improved in Abuja and some major Nigerian cities. However, a PREMIUM TIMES correspondent who visited petrol stations around the metropolis Saturday evening found that queues have yet again resurfaced in the city. Queues Across the nation’s capital city, some filling stations were shut to buyers while others along Lugbe airport road, Wuse and Gwagwalada were besieged by end-users queuing to buy petrol. The same trend was witnessed around Kubwa Road, Wuye, Bwari, Jabi and Utako areas of the city. At one of the NNPC outlets in the Central Business District along Wuse Road, there was a huge crowd Saturday evening as motorists struggled to buy the product. READ ALSO: Petrol Queues: No need for panic buying — NNPC A car owner, Kelvin Ode, told PREMIUM TIMES that the return of fuel queues in Abuja was likely as a result of the just concluded election. “I don’t know if you noticed that there were no petroleum queues during the election period and I’m not sure this particular queue is a serious one, I just think this is because of the just-concluded election. But people are already panic buying,” Mr Ode said. A long queue was also seen at the Mobil filling station in Utako. “I’m surprised at this recent queue. I just hope we are not going into the era of scarcity again,” Ogunmoroti Adiza, a taxi driver who was at the station, said. NNPC speaks on scarcity The NNPCL on Saturday reassured Nigerians of the robust supply of petrol in the country and advised against panic-buying. The oil firm said this in a statement by its Chief Corporate Communications Officer, Garba Deen Muhammad. ⓘ The NNPCL explained that its latest updates released on Saturday showed a total of 2.1 billion litres of Premium Motor Spirit (PMS) stock, representing 0.9 billion litres in all the land depots nationwide and 1.2 billion litres on marine vessels, which is equivalent to 35 days sufficiency as of 4th March 2023. “We plan to close the month of March 2023 with about 2.8 billion litres, which is equivalent to 47 days of sufficiency,” it said. It noted that the appearance of pockets of queues in Abuja and some parts of the country, is largely due to restrictions in businesses and movement, to allow for the conduct of the Presidential and NASS elections and enable Nigerians to exercise their civic right. The NNPCL said operations have now resumed at the depots and trucks are being dispatched to various parts of the country. “We expect normalcy to be restored in the next few days. “NNPC Ltd and all its partners and stakeholders will continue to work together to ensure seamless distribution of petroleum products around the Gubernatorial and State Assembly elections. “We, therefore, enjoin Nigerians not to engage in panic buying,” it said. |

CICERO/Issues The last may not have been heard about the threat by the Supreme Court to sanction members of the public, who are in the habit of criticising its judgments, as more persons continue to question its decision, writes Wale IgbintadeThe criticisms that trailed the judgment of the Supreme Court affirming the Senate President, Dr. Ahmad Lawan as the authentic senatorial candidate of the All Progressives Congress (APC) in Yobe North in yesterday’s National Assembly elections have refused to die down. Following the attacks, the apex court had reacted in anger, warning that its silence must not be mistaken for weakness or cowardice. The apex court, in a statement by its Director of Press and Information, Dr. Festus Akande, accused the critics of serving some vested political interests, and warned that its judges “are not politicians and should not, by any stroke of imagination, be cast in that mold either”.It said over 600 cases had so far gone to court from just party primaries which were conducted by political parties without any encumbrance or interference from any external bodies. It added that if political parties failed to organise themselves well by managing their internal wrangling maturely and chose to bring themselves to the court, it was duty-bound to adjudicate in accordance with the provisions of the law and not the dictates of any individual or deity. The statement read: “It is so disheartening to learn that some individuals and groups of persons who ought to know better and even assume the revered positions of role models to a larger proportion of the citizens are now sadly, the very ones flagrantly displaying ignorance and infantilism in the course of defending the indefensible.” The Supreme Court’s position aligned with that of the President of the Nigerian Bar Association (NBA), Mr. Yakubu Maikyau (SAN), who had vowed that any lawyer criticising the court’s decisions would be sanctioned by the associationSpeaking at a valedictory court session in honour of the retired judge of the Federal High Court in Abuja, Justice Ibrahim Buba, the NBA President, reprimanded some lawyers for castigating the Supreme Court stating: “We are calling on the court to ensure that these lawyers face the consequences as the NBA will take steps in bringing the lawyers to book. Attacks by groups, political parties or individuals under any guise will not deter us, rather it will boost our resolve to do more for the country.”But reacting to the threats to sanction lawyers criticising the judgments of the apex court, the Ben Nwabueze Centre for Constitutional Studies and the Rule of Law described the statements issued by the apex court, and the President of the NBA as misguided. It specifically called on the Supreme Court not to be unduly worried by criticism of its judgments, saying it should be self-evident if such judgments pass muster. In a statement, titled: ‘Court Judgments Are Open to Criticism’, signed by its Coordinator, Chijioke Okoli (SAN), the centre said administration of justice is a social good of which the general public are the consumers. It noted that it was inconceivable to deny consumers an opinion on the product, especially one which they were forced to purchase in the circumstances.In the final analysis, the court speaks for and defends itself through its judgments, the strength or lack thereof of which intellectual and moral- is almost invariably self-evident.” It, however, cautioned those inclined to criticising the judges, adding that such should be done as fairly and constructively as possible. It added that malicious criticisms of judges are not immune from the strictures of the law of defamation. In his view, a public interest lawyer, Jiti Ogunye, noted that a careful reading of the provision of Section 133 of the Criminal Code Act and provision of Rule 33 of Rules of Professional Conduct shows clearly that what is prohibited is the misrepresentation (in speech or in writing) of proceedings of court in a manner that demeans the judge, or prejudices or interferes with the fair trial of a case and judgment thereof, while the court proceedings are pending.Is it wrong to criticise court judgments in the mediaOgunye in his article titled: ‘Is it wrong to criticise court judgments in the media’, argued that Section 133 of the Criminal Code, which deals with contempt ex-facie curiae (outside the court) and provision of Rule 133 does not apply to criticism of court’s judgments (final) by lawyers (whether or not they participated in cases wherein those judgments were delivered), and non-lawyers, after court proceedings in those cases have ended. He submitted: “In spite of all that is known about the sub-judice rule, we make bold to state that the due administration of justice is a matter of public interest, and, therefore, a fair matter for public comment. Trial proceedings, conduct and decisions of the judge are matters of public interest which may be lawfully commented upon as soon as judgment is rendered in a case.There is no provision in the Criminal Code Act and Rules of Professional Conduct that prohibit media criticism or critique of judges and judgments, after delivery of judgments, by lawyers and non-lawyers. We are aware that Rules 30 and 31(1&2) of the Rules of Professional Conduct state that lawyers are officers of the court and that they owe the courts a duty. We insist, however, that being officers in the temple of justice and owing the courts a duty do not preclude lawyers from criticizing judges and their judgments in the media”. Ogunye stated that lawyers and non-lawyers have a right to hold opinions and express such opinions publicly through the media, whether those opinions are on court judgments or not. Also, a veteran journalist and rights activist, Mr. Richard Akinnola, in an open letter to the Chief Justice of Nigeria (CJN), titled: ‘I Would Criticise the Supreme Court’, accused the CJN of unprecedented steps to gag the public in criticising and subjecting apex court’s judgments to public scrutiny. Akinnola added that what he would not subscribe to are personal, scurrilous attacks of justices. He argued that if judges could criticise themselves over a judgment, the members of the public are also entitled to do so. “My Lord, the Supreme Court has a lot to do to change the public perception about it, because justice is rooted in public confidence and this cannot be achieved by threats and gagging members of the public from criticising its judgments.

Presidential Candidate of the ruling All Progressives Congress APC, Asiwaju Bola Tinubu has constituted his legal team to take on his opponents, Alhaji Atiku Abubakar of the People’s Democratic Party PDP and Mr Peter Obi of the Labour Party, both of who had vowed to challenge his victory in court. This was as Tinubu said he would also file a cross-petition against Mr Obi who polled over 6.1 million votes in the election, saying the LP candidate invented the political rigging machine which gave him such a figure. Minister of State, Labour and Employment, and chief spokesperson of the Tinubu-Shettima Presidential Campaign Council PCC, Mr Festus Keyamo SAN disclosed this at a news conference Friday in Abuja. “We have constituted our legal team and I am part of it. We have volunteers who are SANs. We are going to file a cross-petition to cancel the votes of LP in virtually all the South East states. We are going to court too. If you look at results from the South East, there was one incident where the results from a whole ward were filled using one handwriting. What it means is that they accredited people and asked them to go home and then thumb printed for them. He imported his rigging machine into Lagos State. Go and look at the results from Festac”, he stated. On the decision of some states to challenge Tinubu’s victory at the Supreme Court, Keyamo called for sanctions against the Attorneys General of such states, saying they ought to have begun the process from a lower court.I think without commenting on the merits of the cases, as someone who has sworn to protect the image of the bar, I think we should begin to take some serious look at the conduct of some lawyers. Any lawyer who goes to the Supreme Court instead of going first to the tribunal, I think we should begin to take a critical look at such lawyers. The Supreme Court is not the court of first instance”, he explained. Addressing journalists, Special Adviser on Media and Communications of the APC PCC Mr Dele Alake, thanked both Atiku and Obi ‘for finally opting for the rule of law as against the initial belligerent posture as they continue their baseless journey of chasing after a mirage” He said the initial knee-jerk and hothead call for anarchy by their proxies was ill-advised and would in no way serve any noble cause. “It is good to know that reason has prevailed”. “Let us say, unequivocally, that we welcome the decision of both the PDP and LP and also the NNPP candidates to test their claims, as ridiculous as they are, in the court of law as provided for by our constitution. This is without prejudice to the conciliatory efforts of the President-elect, Asiwaju Bola Ahmed Tinubu. He has reiterated in his post declaration speeches the need for all Nigerians, irrespective of whom we all voted for, to rally quickly together for the good of our country. As we all can see, these two otherwise experienced politicians are pinpointing the lack of adherence to the guidelines as basis for discrediting the votes lawfully cast by Nigerians. We shall examine the so-called process that was purportedly breached by the electoral body and how it, in their wild imagination, undermined the credibility of the election. The claim that INEC did not use the BVAS is false. Those who voted across Nigeria, including Atiku and Obi, were accredited by BVAS. Save for bad losers that these two people have proven to be, we should rather be celebrating the tremendous improvement the use of BVAS has brought to our electoral process. “The complaint over the electronic transmission of the result is not supported by law. “Section 38 of the Electoral Acct 2022 referred to by the PDP and LP has nothing to do with the transmission of election results. Section 60, subsection 2 of the Act deals with the transmission of results and it is at the discretion of INEC. The Act does not contain any mandatory provision regarding the transmission of results. “In any case, the process of transmitting results from polling units, whether real-time, two days later or at any time, cannot in any way change the results that have been announced right after the counting in the presence of the parties’ agents and to the hearing of the voters. It is, therefore, nonsensical to insinuate that time variation in uploading results would cause a change in the figures. “The 2023 Presidential election is a watershed as it produced unprecedented outcomes and defied conventions. The deployment and use of BVAS is the only reason the elections produced these strange outcomes and upsets in many cases. The loss of Katsina and Lagos to PDP and LP respectively were contrary to expectations. BVAS brought the intended credibility to voters’ accreditation such that many governors and well-established politicians lost elections in what should be safe bet areas.The era of ghost-voting and stuffing of ballot boxes is gone. As the experience in the last governorship election in Osun State has shown, over-voting would automatically lead to outright cancellation of the results of the polling units based on the provision of the new Electoral Act. The same PDP that is trying to pull the wool across the face of Nigerians was the culprit in the Osun State governorship election. Did they try to do it this time and it failed? Or did they do it in the areas they unexpectedly won? Did they have a grand plan to hack the INEC server if results were uploaded in real-time? Nigerians will soon find out. “The PDP also found itself in No.3 in Kano, with a former member, Kwankwaso running away with over 900,000 votes. How far could the PDP have gone with what was left of it? Not so far as the results of the elections have shown. The members of G5 were key leaders of the party who had substantial political influence. They also went away with their own pound of flesh, leaving a crippled PDP to scavenge for crumbs of votes.” “For Obi, he would go down as Nigeria’s most dangerous and divisive politician. He elevated his well-known clannish mentality to a most unfortunate height by openly anchoring his campaign on religion and ethnicity. He presented himself as a poster boy for and a champion of our country’s fault lines. He took advantage of our youths whose expectations are fast-paced, who are uninterested in excuses, and who were in search of a hero. He pumped up their sentiments and rode on their emotions while grandstanding as a saviour. It was a false pretence. Obi’s credentials are eternally stained as a former governor with no remarkable legacy”, said Alake.
