The governor of Kaduna State, Nasir el Rufai, has said Nigeria must do away with its “corrupt” oil company, the Nigerian National Petroleum Corporation, NNPC, or stand the risk of itself being destroyed.
“If you don’t kill the NNPC, it will kill Nigeria,” Mr. el-Rufai said Monday at the 7th Wole Soyinka Centre Media Lecture Series in Abuja, where he was a guest speaker.
Mr. El-Rufai said the NNPC has become so entrenched in corruption that the only way out for Nigeria is not to attempt to salvage the corporation, but to destroy it and create a new oil company.
He said he hoped President Muhammadu Buhari will implement that proposal.
The governor said as a former director general of the Bureau of Public Enterprises, he was confident a messy organisation could be disbanded and turned into a useful one.
He said NNPC has become so corrupt and arrogant that it runs a parallel government and unilaterally decides what it remits to a nation of 170 million people, while its hundreds of employees feed fat on Nigeria’s resources.
In the last three years, Mr. el-Rufai said the NNPC retained 42 per cent of Nigeria’s money, and remitted only 58 per cent.
“About N971bn was budgeted for subsidy payments in 2014 alone (more than twice that was eventually paid). You all recall how trillions of naira were paid out as oil subsidy in 2011, when only N254bn was appropriated. No one has been successfully prosecuted for this scam. Huge deficits in gas supply have ensured that the country’s thermal plants cannot produce power at optimal levels,” he said.
“The long and short of the situation of our oil industry is best exemplified by the parallel government called the NNPC. In 2012, it sold N2.77tn of ‘domestic’ crude oil but paid only N1.66tn to the Federation Account. In 2013, it earned N2.66tn but paid N1.56tn to FAAC; in 2014, (it earned) N2.64tn, but remitted N1.44tn; while between January and May 2015, it earned N733.36bn and remitted only N473.2bn.
“That means that the NNPC only remitted about 58 per cent of the monies earned between 2012 and the first half of 2015. A company with the audacity to retain 42 per cent of a country’s money has become a veritable parallel republic!”
He said the examples he gave were only with respect to domestic crude oil sale. “Similar leakages exist in the NPDC, NAPIMS procurement and subsidiary budgets,” he said.
“The NNPC feels entitled to consume more resources than the 36 states, the FCT and the Federal Government combined. How could a country so dependent on oil revenues have been so lax about the proper governance, efficiency and security of its oil industry?” he lamented.
He identified the need to remove the undue premium on public ownership and control of every major oil asset, while checking the impact of corruption and distortion of oil subsidy on the country’s economy, and restructuring of the NNPC in the national interest.
To realise the potentials of the oil industry, he said the government must not only define exactly what the country wants the oil industry to be and to achieve, but also the structure that would best deliver it.
“An efficient and productive oil sector, able to create jobs, spur industrialization and earn more revenues requires that we tackle the monster that the NNPC has become,” he said. “We should replace the NNPC with brand new organizations that are fit for purpose – a commercialized and corporatized national oil company and new industry regulators.
He said the new national oil company should be capitalized once and for all, and then freed to fend for itself like other national oil companies, by seeking its financing independently from the financial markets and paying due taxes and royalties.
“An efficient and productive oil sector, able to create jobs, spur industrialisation and earn more revenues, requires that we tackle the monster that the NNPC has become. This country can no longer afford to maintain an NNPC that arrogantly, unlawfully and unconstitutionally spends an unhealthy proportion of national oil earnings on itself,” he said.
“We should replace the NNPC with brand new organisations that are fit for purpose, among others, a commercialised and corporatised national oil company, and new industry regulators. This new national oil company should be capitalised once and for all, and then freed to fend for itself like other national oil companies do, seeking its financing independently from the financial markets and paying due taxes and royalties.
He said no one qualified more to appreciate the rot in the NNPC, and to deal with the menace, than President Buhari who was the pioneer head of the NNPC in 1977.
“No one can appreciate the gap between the vision of the NNPC’s founding fathers, the beautiful baby of 1977 and the 38 year-old monster it has become better than President Buhari. The NNPC of today must make Chief Sunday Awoniyi of blessed memory squirm in his grave. Something fundamentally decisive must be done to tame this monster,” Mr. el-Rufai said.
Mr. el-Rufai lamented the irony of about 70 million, or 40% of Nigeria’s total population, currently living below the poverty line, despite the country’s earning of at least $1trillion from oil in the last 50 years.
“For our vast masses, oil is no fortune,” Mr. El Rufai said. “It is more of a mirage, but a more insidious kind, because the fortune is visible in the lifestyles of a few thousands of the privileged elite, but is stubbornly inaccessible to tens of millions of ordinary people.
“Our rich enjoy the lifestyles of the richest in the world, while our poor are truly the wretched of the earth. This inequality is most unfortunate.”
To avoid sinking deeper into poverty, Mr. El-Rufai said the country must resolve to spend wiser, and do more with less by changing its big appetite to consume rather than save; import, rather than produce domestically, or neglect to prioritize capital investments.
The major responsibility of a democratic government, he said, was to ensure that people were moved away from pain of extreme poverty, by managing the country’s resources in a way that would sustain building the people, through diligent revenue collection and cost-effective and resulted –oriented application.

Even though the matter of whether Nigeria’s military chiefs must by screened and approved by the National Assembly had long been settled by the courts, the President of the Senate, Bukola Saraki, on Monday claimed that the Service chiefs appointed by President Muhammadu Buhari do not need any clearance by the upper legislative chamber.

Mr. Buhari had told the new Service Chiefs shortly after their appointments Monday that their nominations would be sent to the National Assembly for confirmation.

“Legally, you are in acting capacity until the National Assembly accepts you,” the President said.
“It is only then that you will take the oath of office. Thereafter, we will sit down and talk in more detail.”
Ostensibly based on the President’s comment, and perhaps based on the fact that the last set of Service chiefs were screened and approved by the Senate, a citizen, Chinedu Peters, tweeted at Mr. Saraki at 5:25 p.m. on Monday urging him and his colleagues to immediately call off their recess to clear the new military chiefs.

“I hope @bukolasaraki and the Senate will as promised come out of their break to confirm the appointment of the new service chiefs immediately,” Mr. Peters tweeted at Mr. Saraki, using the handle @chinair.

But responding to the tweet at 7:08 p.m. same day, Mr. Saraki said the appointment of service chiefs was a prerogative of the President, and that the Senate had no role to play in the process.

“@chinair Appointment of service chiefs is an exclusive function of Mr President. Senate can only approve Ministerial, parastatals etc,” the Senate President said, using his handle @bukolasaraki.

PREMIUM TIMES checks indicate Mr. Saraki is wrong, and Mr. Buhari right.

A Federal High Court, sitting in Abuja, had on July 1, 2013 ruled that any appointment of Service chiefs by the president without approval of the National Assembly is unconstitutional and illegal.

Justice Adamu Bello declared the appointments of the service chiefs without National Assembly’s approval as null and void because they did not conform to Section 18 (1) and (2) of the Armed Forces Act, Cap. A20, Laws of the Federation.
The case, instituted by Lagos lawyer, Festus Keyamo, had challenged the practice of appointing military chiefs by the President without seeking the approval of the National Assembly.

Mr. Keyamo had argued in court that the appointments of service chiefs, which are political appointments, could not be different from other political appointments that require the confirmation of the National Assembly such as the Chief Justice of Nigeria, Justices of the Supreme Court and Court of Appeal, Chairman of Economic and Financial Crimes Commission, EFCC; ministers, and so on.
Based on that judgment, which has not been appealed till date, former President Goodluck Jonathan sought and got the approval of the National Assembly in January 2014 when he appointed Alex Badeh as Chief of Defence Staff, Kenneth Minimah as Chief of Army Staff, Usman Jibrin as Chief of Naval Staff and Adesola Nunayon Amosu as Chief of Air Staff.

Mr. Saraki was already a Senator during the period, and it is unclear why he is now claiming that the National Assembly has no role to play in the appointment of the new Service chiefs.

The Senate President could not be reached to comment for this story. He is said to be away in Saudi Arabia for lesser hajj.

His spokesperson, Yusuph Olaniyonu, is yet to return calls made to him Monday morning.

The governor of Edo State, Adams Oshiomhole, has said his administration is ready to subject the local government accounts for investigation by the Economic and Financial Crimes Commission, EFCC.
Mr. Oshiomhole said this in response to a call by the state Chairman of the Peoples Democratic Party, Dan Orbih, for the EFCC to probe the state’s local government accounts.
The PDP chairman had blamed the financial crisis in local government areas in the state on Mr. Oshiomhole.
“We have more than enough materials to nail the corrupt practices of the political leaders in Edo State starting with the governor,” Mr. Orbih had said.
He said the council chairmen earn between N1.2million and N1.7 million each every month as security votes, while the legislative arm of the councils earn about N1 million each as security votes.
He, however, noted that what the council chairmen collected was nowhere close to the over N500 million Mr. Oshiomhole draws monthly in security votes.
“Here is a governor asking council chairmen to forfeit N1.2 million per month but who cannot forfeit N500 million. The total security vote of the councils in a year is about what Oshiomhole collects every month.
“He brought this hardship upon the people and he is now trying to absolve himself. He impressed upon the council chairmen not to cry out but one good thing is that the Edo people already know the truth. Edo people must sit up and reflect on the deception of Oshiomhole and his party and make the right choice next year,” he stated.
But speaking through his Special Adviser, Media and Public Affairs, Kassim Afegbua, the governor said probe should start from 1999 when the PDP ruled the state until November 2008 when he took over.
“As a government driven by prudence in its management of resources, we are proud to say that our achievements in the last six years far supersede that of the PDP’s ten years of presiding over the state.
“We are pleased to state without fear or favour that we welcome the suggestion raised by Dan Orbih inviting the EFCC to look into the books and accounts of Local Government Administration in the last six years but that such investigation should also cover the period between 1999 and 2008.
“Such investigation should also look into the allocations and expenditures of the Local Government, their procurement procedures, who did the procurements, at what costs and the total accruals into the coffers of local government accounts across the state within that period of 1999 to 2008.
“From such investigative effort, the public would be able to know who siphoned Local Government funds between the Government of Comrade Oshiomhole and that presided over by the PDP for ten years. This should be the real challenge in the light of on-going effort to sanitize the inherited rotten system from the PDP,” he said.
Mr. Oshiomhole also called on the PDP to publish all accruals to local government councils in the state between 1999 and 2008 and how the over N300 billion released to the Federal Ministry of Works under the former Minister, Tony Anenih, was spent.

NNPC (Nigeria National Petroleum Corporation) must die!” were the stern words of the Governor of Kaduna State, Mallam Nasir El-Rufai, on Monday in Abuja.

A visibly angry El-Rufai, while speaking on Monday at the 7th Wole Soyinka Centre Media Lecture Series, lambasted the national oil firm, stressing that he was hopeful that the current administration of President Muhammadu Buhari would kill the corporation.

The Kaduna State governor called for the setting up of another national oil firm as he argued that the present NNPC would kill Nigeria if it is allowed to continue running as the country’s oil firm.

“If you don’t kill NNPC, it kill Nigeria,” El-Rufai said.
