The Term “Next Of Kin” Simpliciter, Does Not Confer The Right Of Inheritnce On The Person So Named: Of What Use is the term?*
INTRODUCTION:
The meaning and the legal implication of the term “next of kin” have been constantly misunderstood by the ordinary public. It appears, though erroneously, that many people think that once you are appointed the next of kin of a person, it automatically gives you the right to inherit the person’s estate upon his demise. In fact, many people think that, a next of kin gives an exclusive right over a person’s property.
The above erroneous believe and understanding of the term next of Kin has made many people to shy away from the need to make a Will. This is because, they think appointing a Next of Kin, is a way of naming your beneficiary. However, the above assumption is not in conformity with the law. It must be noted that, ignorance of the law is not an excuse.
WHAT THEN IS THE MEANING OF THE TERM “NEXT OF KIN”?
The term, next of Kin has been described as the nearest blood relative of a person. See JOSEPH v FAJEMILEHIN O.O & Anor (2012) LPELR-9849(CA). The term can also refer to a person who can be contacted or notified in cases of emergencies or eventualities. For instance, one of the forms that is usually filled while on transit, requires the information of next of kin. This is needed in case of any accident. In other words, where there is an accident involving that person, his next of kin shall be notified or informed.
Also, the term is constantly put into use by hospitals. In this case, next of kin means a person who can make medical decisions for a person who is incapacitated or unable to do so, during emergencies.
The term is also frequently used in financial documents by banks and other financial institutions. In this instance, next of kin means a person who can ensure that the proper steps are taken towards the recovery of the money held at the bank, at the demise of the owner. In other words, being a next of kin of a person, as regards his money in the bank, does not give a right to inherit such money, either partly or as a whole.
WHAT IS THE LEGAL IMPLICATION OF THE TERM NEXT OF KIN AS IT RELATES TO THE LAW OF SUCCESSION?
It must be noted that appointment of a next of Kin is not a substitute to the making of a valid WILL. The reason is because, when a person dies testate (that is, the person made a valid Will), the matter of next of kin is of no relevance. The estate of a deceased person who dies testate is distributed strictly according to the Will. Thus, his next of kin will only be entitled to his estate, if the WILL says so.
On the other hand, in a situation where the deceased died intestate (that is, without making a valid Will), the question of the distribution of his estate is governed by the law. The customary law/Islamic law or the Administration of Estate Law will apply depending on the kind of marriage contracted by the deceased. In other words, if the deceased contracted a statutory marriage (popularly known as court marriage), the distribution of his estate shall be governed by either the English Law or the Administration of Estate Law. See OBUZEZ V OBUZEZ (2007) 10 NWLR (Pt.1043) 430. It must be noted that the Administration of Estate Law provides for the order of inheritance which must be complied with strictly and a next of kin, is not among the categories of those entitled to inheritance in this instance.
In other words, Succession is regulated by law. It is only those entitled by law to inherit a deceased person’s estate that can do so. A next of Kin is not one of such persons. However, this is without prejudice to his right to inherit on a personal ground. Thus, if the person so named as a next of kin is the son of the deceased, he is entitled to inherit, not as a next of kin, but because he is the legitimate son of the deceased. Also, if the person so named as a next of kin, is also named in a valid Will made by the deceased, he is entitled to an inheritance not because he is a next of kin, rather, because, he is named in the WILL.
CONCLUSION
A next of kin, who is usually a blood relative, though not always, has no legal right of inheritance by virtue of his status as a next of kin simpliciter. However, it must be noted that the appointment of a next of kin is not a means or method of naming an heir. A next of Kin is not recognized as an heir under the Nigerian law of succession.
Therefore, next of kin, stricto sensu, does not by any stretch of imagination, entitle the person so named an automatic right of inheritance. If the person so named as a next of kin is not entitled either by the WILL or by other laws of inheritance, to inherit, he cannot be conferred with the right of inheritance by the mere fact that he is named as a next of kin.
It is hereby submitted that when it comes to the law of succession, the term next of kin has no legal implication. It therefore does not confer the right of inheritance. Thus, it is erroneous and unlawful for anyone to claim any inheritance on the singularly reason that he is named as a next of kin. Such claims have no legal bases and are unfounded.

Awon wife materials with submissive skills, wrapped in a virtue of longsuffering, helping patriarchy to thrive. The ones brainwashed into believing that marriage is what makes a woman complete on earth so they do everything within their power to secure the ring.

Regardless of the filth thrown at them, they are determined to tolerate, endure the man’s BS to keep their marriage/relationship going because according to the counselling they received, a woman is supposed to be tolerant, subservient and understanding of her man.

They are also the peace givers in the home. They were born with peace and good character manual so they don’t question any decision or action of their man so that the man will have peace of mind.

They are also the deaconesses in the church encouraging girls to be of very good behaviour so that man will marry them.

These category of women dislike feminists a lot. They think a feminist is ugly for being one and joyless. Nature usually bless this kind of women with serial philanderer/community preeq as horsebands.

She is known for her caustic tongue with words that are like bullets/arrows/missiles shot at the man with the intention to pierce his heart and make him bleed.

They make their own money but rarely spend a dime from it. To them, it is always the responsibility of the man to take care of his family/home financially.

She is the type of woman Solomon spoke about in proverbs 21 verse 9: ”better to dwell in a corner of a rooftop, than in a house shared with a contentious woman”, and

21 verse 19: ” better to dwell in the wilderness, than with a contentious and angry woman”

They never pick up bills as their own responsibility is to cook food and born shedren for their husband.. They depend on their husband for everything.

They are of two kinds: feminist-lite and the real feminists…

Pseudo-lite feminists are situationship kind of feminists that is feminist on sosha media. These category of women are usually the unfortunate ones in life as they’ve been often misconstrued by what they stand for.

Sometimes society misconceptions is that they are broken and damaged women who cannot keep a home, relationship, loveless, joyless and are sluts.. The society feels they are incapable of loving a man and or being loved. The society feels they are sad, sorrowful and a misandrist/hater of men.. But a lot of real feminists are the ones enjoying love and being loved.

They encourage women to date anyhow, capable of loving a guy 20 years their junior and not feel ashamed about it.

Feminists are hated by all.

Some women are slay queens by default… And they are of different categories..

The rich slay queens and the wanna-be/broke slay queens.

The real slay-queens just want to live the baby-girl life without any sweats or rigour… They want to shop, travel, vacay and dine at exquisite 5ive star hotels..

They are all about the bougie lifestyle and chutzpah. Rich, independent that can afford life luxuries. Their kind of men knows and respect them. They come with a certain level of intelligence that can sway men away.

They are leading in business, innovations, creativity, the vanguard of women in fashion, taste, class and finesse.. If anything is a stress trigger in their cute life, they abort mission.
Unlike the broke/wanna-be slay queens who depend on men for their existence and their money fund the air they breathe.

Side-chics: awon unfortunate girls with stomach infrastructure as their primary problem. They live to satisfy the needs and many sexual fantasies of potbellied zaddies.. They have no plan or dreams or directions… Whatever money they have is to spend on making themselves feel good.

Give a helping hand around the house. Give her a kitchen holiday for some days, do all the cooking or hire somebody to do it for you. Let her just sit, eat and rest, this may be all she needs.

On Saturday, 25th of May 2019 , Creative Hands Initiative, an NGO based in Benin City, Edo State, held her Fourth Clean up exercise, tagged “Keep Nigeria Clean, Edo State Phase IV”. The NGO led by former SUG Vice President, University of Benin, charged Nigerians on the need to maintain a Clean and healthy Environment. She also used the medium to call on well meaning Nigerians to support the project. 
The sanitation exercise is to be held monthly and to be replicated in the 36 states of Nigeria, hence her call for support from well meaning Nigerians.
The Exercise was Approved by the Edo State Ministry of Environment

Corpers serving in Taraba state has continued to lament over the state of insecurity in the state, as they are caught in between the crisis in the State. The community where she is serving has been deserted as indigenes flee for their lives, leaving the Corpers behind.

9jatrendingnews, also gathered from the Facebook page of one of the Corpers, how insecured they are and calls for relocation,

According to her statement on her Facebook post

“I came to Taraba with the heart to serve, now what i feel is fear. Deaths and rumours of death,Conflicts and fightings amongst tribes. I can’t sleep because of fear, i can’t walk freely without looking behind me… Out of fear.

My area is isolated. The indigenes are running away leaving corp members to themselves. Are we supposed to keep quiet? The only neighbor i have that gives me hope is leaving tomorrow for Abuja and not coming back. We are not part of this fight but we are in the middle of this.

If the Nigerian government or NYSC cares about us, please relocate us out of this place and lets serve our country with all our heart. We came here in one piece and that’s how we want to leave.

I need you all to share this until it gets to NYSC…Our lives matter”

This is part of the reason she has been identified by the European Union as a leader who has both been active in governance issues to date and has the potential of playing a greater role to help raising women’s voices.
