The Minister of Power, Works and Housing Mr Babatunde Fashola SAN has written to Socio-Economic Rights and Accountability Project (SERAP) promising “to refer the request for details of alleged contractors and companies that collected money for electricity projects and failed to executive any projects to the Ministry’s agencies for necessary action and appropriate response.”


Mr Fashola’s latest response followed his letter to SERAP last month in which he said: “We have searched the Ministry’s record and the information you applied for is not held by the Federal Ministry of Power, Works and Housing (Power Sector).”

However, SERAP disagreed with the response, saying: “The public expectation is that government information, when in the hands of any public institutions and agencies, should be available to the public, as prescribed by the FOI Act. The FOI Act should always be used as an authority for disclosing information rather than withholding it.”

In his response to SERAP’s reaction, Mr Fashola said: “The Ministry’s letter to your organization was not an attempt to deny the request for information. The Ministry is committed to compliance with the Laws of Nigeria including the Freedom of Information Act, 2011. The Ministry will refer your request to its agencies for necessary action and appropriate response.”

Mr Fashola’s letter dated 4th March, 2019 and signed on his behalf by Louis O.N. Edozien, Permanent Secretary (Power) read in part: I write to acknowledge the receipt of your letter dated 8th February 2019 which is in response to the Ministry’s letter dated January 2019.”

“There may be instances of part-payment against certification of commensurate value for materials and services in achieved contract milestone even though the entire contract is not 100% performed.”

“But the Ministry does not have a record of any contractors that collected 100% payment and failed to execute a contract. The Ministry’s procurement and contract administration processes are strictly guided by relevant regulations that require the Ministry to ensure Advanced Payment is limited to 15% of the contract sum and is backed by an Advanced Payment Bank Guarantee (APG).”

“Our regulations also require the Ministry to release any APG only after recovery of commensurate value of contracted materials and services from the contractors who provided the APG. We make payments only upon certification of receipt of commensurate value for materials and services from the contractor.”

SERAP deputy director Kolawole Oluwadare said: “We welcome Mr Fashola’s latest response, and look forward to the Ministry’s agencies getting to the root of the matter by publishing without further delay details of alleged corrupt contractors and companies, as contained in our FOI request.”

It would be recalled that Mr Fashola had earlier said in response to SERAP’s FOI request that: “the Ministry has searched for the requested information on details of alleged contractors and companies that collected money for electricity projects and failed to executive any projects, but we could not find it from our records.”

Mr Fashola’s initial response followed SERAP’s FOI request and suit number FHC/L/CS/105/19 filed last month at the Federal High Court, Ikoyi, Lagos. The suit is seeking “an order for leave to apply for judicial review and an order of mandamus directing and/or compelling Mr Fashola to provide specific details on the names and whereabouts of the contractors who collected public funds meant for electricity projects but disappeared with the money without executing any projects.”

SERAP’s reaction to which Mr Fashola has now responded read in part: “Indiscriminate attempts to limit disclosure of information of public interest such as the details of the names of alleged corrupt contractors and companies that SERAP is seeking, will undermine the government’s expressed commitment to transparency and accountability.”

“We believe that the predisposition by all public institutions and agencies including the Ministry of Power, Works and Housing should be to grant access to public information and not to implicitly deny it. Indeed, disclosure, not secrecy, is the dominant objective of the FOI Act. This objective would be defeated if there is public perception that public institutions and agencies attempt to shield information of public interest from disclosure or abdicate statutory responsibilities.”

“Although we have filed a case in court for remedial action and seeking an order to compel you and your Ministry to release the information requested, we urge you to take proactive steps to obtain the information from any other public institution or agency that may be holding the requested information, and to send to us the information without further delay. Your Ministry should not wait until the court makes it decision to compel you to disclose the requested information.”

“SERAP believes that it should be the practice of your Ministry and indeed other public institutions and agencies to hold and keep records of public information including on names of alleged corrupt contractors and companies with the expectation to release any such information when requested.”

“SERAP believes that even assuming that your Ministry has faithfully searched for the information requested and that the information is not held by your Ministry as claimed, your Ministry should still have taken steps to approach and request from other public institution or institutions that may be holding the requested information, in line with the provisions of the FOI Act.”

“SERAP believes that your response implicitly amounts to a refusal by your Ministry to provide the information requested, as allowed under the FOI Act.”

“We note that your Ministry has a responsibility under Sections 1(1)(2), 2(2)(3)(4), 5 and 9 of the FOI Act to record and keep information about all its activities, operations and businesses, including on the specific names and details of alleged corrupt contractors and companies in order to facilitate public access to any such information.”

Mr Soji Adagunodo, the Osun Chairman of the Peoples Democratic Party (PDP), has decried the low turnout in Saturday’s House of Assembly election in the state.


Adagunodo , who spoke with newsmen in his home town in Ilowa, Obokun Local Government Area of the state, said the voters’ apathy might due to the fact that there was no governorship election in the state.

He said that the turnout of voters was not impressive when compared to the massive turn out during the Presidential and National Assembly elections two weeks ago.

Adagunodo said that the turnout of voters was not impressive when compared to the National and Presidential election in the state.

“The turnout of voters is very low. Although it is normal since there is no governorship election in the state.

“But all the same, the turnout of voters is still reasonable,’’Adagunodo said.

The PDP chairman, however, commended the electorate for their peaceful conduct.

Adagunodo said notwithstanding the low turnout of voters, the party would win majority seats in the assembly.

Also speaking, Mr Diran Odeyemi, the PDP National Publicity Secretary said the turnout of voters was not impressive.

Odeyemi, who spoke to newsmen at his Unit 2, Ward 1 in Ibokun town, said the turn out of voters was not impressive.

He said due to the poor turn of voters, the election atmosphere was dull.

Odeyemi, who noted that the low turnout might be due to the fact there was no governorship election in the state, said the party was sure of victory.

Newsmen report that many of the women came out early to join the queue for accreditation and voting at polling centres in Tudun Wazirchi, Dandago, Sharada, Gandun Albasa and Kofar Kudu.

Hajiya Amina Jibril told Newsmen that governorship election was very important to her because it directly affected her more than the Presidential election.

“This is like a sacrifice to us to secure a good future for generations to come because we need a credible leader,” she said.

Batula Adamu, a housewife, also said she came out to vote as her nephew who was contesting for the State House of Assembly.

A civil servant, Malama Amina Mu’azu, said she would endure every hardship to vote for a candidate of her choice.

“My outing today is a sacrifice to my state because no matter the choice we make at the federal level, we must ensure credibility at the state level,” she said.

Meanwhile, voters in Ungogo Local Government Area of the state have commended the Independent National Electoral Commission (INEC) for the proper functioning of card readers used for the Governorship and State House of Assembly elections.

They gave the commendation in separate interviews with Newsmen in Rimini Gata, Ungogo Local Government area of Kano on Saturday.

Alhaji Abubakar Salisu said he was satisfied with the INEC arrangements for the election process, in a conducive atmosphere.

“The card readers made the voting process quick and fast, I am really impressed,“ he said.

He prayed that the election would be conducted peacefully.

Another voter, Mrs Sadiya Nura, said the voting process was laudable and praised the matured manner voters were casting their votes at Rimin Gata primary school polling unit 014 and 015.

Yusuf Umar described the voting process as orderly and peaceful.

Newsmen report that adequate security personnel were deployed to the polling units were well organised.

State Assembly Poll: Low turnout as voting commences in Amarata, Opolo in Bayelsa

In Yenagoa, Bayelsa, accreditation and voting in the state House Assembly commenced simultaneously across many polling centres in the state capital but with amid low turnout of voters.

This development was noticed in Amarata, Opolo polling units but Nigeria Police and Nigeria Security and Civil Defence Corp (NSCDC), Army personnel were at various polling units and strategic locations in the areas to ensure peace.

Officials of the Independent Electoral Commission (INEC) arrived on time with the necessary voting materials at the polling units visited.

At Opolo Ward 5, Unit 4, 6, 5 and 10 in Yenagoa city, few voters were seen sitting while some on the queue as at 10.00 am.

At Amarata, ward 6 Unit 12, 13, 14, 15, 17, 18 and Onopa ward 7, the officials of the INEC arrived at 8.37 a.m.

Mr Happy Peter, a Presiding Officer in Opolo, ward 5 unit 6 said that the electoral commission had provided enough voting materials to accommodate all registered voters.

“We have all the materials available, the card reader machines are working fine but the voters’ turnout is low for now,” he said.

Amon Friday, the Domestic Observer, decried the low turnout of voters but expressed the hope that the voting might pick up.

“I commend INEC for providing materials and I believe the voters will still come out to cast their votes,” Friday said.

One of the voters, who spoke on the condition of anonymity, said the low turnout could be fear of being hurt by thugs.

In Keffi, a local government area in Nasarawa state, there was a low turnout of voters.

Emir Palace polling unit, prison service polling unit, Tudun polling unit, all in Tudun Kofar ward in Keffi Local Government Area of the state among others showed voter apathy

Malam Abubakar Sani, a voter in Emir Palace polling unit, Tudun Kofar ward of Keffi Local Government Area expressed concern over political, apathy in the area.

“If you compare this election with the Presidential and National Assembly elections, you will notice that there is a low turnout of voters in this election.

“The reasons may be due to lack of performance by some politicians or based on voter personal reason,” he said.

He, however, expressed happiness with the conduct of the election.

Mrs Veronica Audu, a voter at ECWA polling unit, Angwan Rimi ward of Keffi Local Government Area of the state also decried the low turnout of voters.

She said that no matter the situation in the country, the electorate are supposed to come out to exercise their rights by voting the candidate of their choice. (NAN)

PRESIDENT Muhammadu Buhari on Saturday said that he anticipated that the main opposition Peoples Democratic Party, PDP, and its presidential candidate at the February 23 election, Alhaji Atiku Abubakar would go to court to challenge the result of the election.

He said it was part of the democratic process.

Recall that the PDP’s Presidential candidate, Alhaji Atiku Abubakar has approached the court to challenge the result of the election in which the All Progressives Congress, APC, Presidential candidate, President Buhari was declared the winner.

President Buhari who alongside his wife, Dr Aisha Buhari voted at the Kofar Baru 003 polling unit, Daura, Katsina State, for the governorship and state assembly elections.

The President who fielded questions from journalists after casting his votes said that security agencies especially the Police were taking care of the flashpoints in the country to make sure that they counter it for a smooth-free election.

Asked to react to the decision by the PDP and its presidential candidate, Atiku Abubakar, to challenge the outcome of the February 23 presidential election at the election tribunal, he simply said, “I expect that to happen.”

On what would be his advice on the flashpoints and reported cases of violence across the country, this week, President Buhari said, “I will leave it to the law enforcement agencies especially the police because they have been meeting virtually on a 48-hour basis to make sure that they have identified the flashpoints, as you mentioned, wherever they are and make arrangements to counter it.”
