That is not objective, there is nobody at the top that allegation wont be levelled against but if they remain unproven, then they are unfounded. Celebrities › Re: Cynthia Morgan Lied Against Her Record Label? (Contract) by GEEBITE: 10:06pm On May 26, 2020 |
I'm not sure dude knows much about contract law. nextstep: We are circulating around the same thing:
- he claims he owes 100% of the videos while he doesnt He owns 100% of the videos she did while in the label. Section 9 assigns performances (live, recorded, etc) 100% to him. Even if he paid only 50% of the cost, the contract assigns all of the video to him.
- he claims she owes him 100% of video production cost, while she doesnt He paid 100% of the cost, she owes him her share (50%). I don't see a claim she owes 100% of the cost. Please point me to anywhere that claim is made.
- he hijacked her vevo (and possibly royalties) while the contract says only a Lagos court can decide that. If she feels there's a dispute, she is free to take him to court. However, section 15. (NON-CIRMUMVENTION) says essentially that "Artists shall not detrimentally interfere with the efforts of Company to distribute..." Since the music video belongs to the Label (section 9), and not to Cynthia, the label essentially owns how and when the video is played, including YouTube, Vevo, radio stations, etc. and can take steps to protect its property, including taking ownership of the page for the brand "Cynthia Morgan". She assigned that right in section 10 (LICENSE FOR USE OF NAME AND IMAGE).
- the minute she stepped out of the contract and they accepted that she could leave, then the record label had NO MORE CLAIM over these songs.... apart from the 50% royalties to offset the debts.
Contracts end, but the ownership of the songs remains with the Label. They own the rights (section 9), they own the copyright if assigned (section 12), and have sole, exclusive and perpetual ownership to the songs (section 14) (i.e. forever).
Former employees don't come back to claim any rights to the work they did for a former employer (unless it was stimulated in contract)... I don't see how she can still own the songs (and all performances, including music videos) she assigned to somebody.
Are we reading the same contract? |

Laughable, even Nas can not utter that. The best rap album till date still remains Notorious sophomore album life after death. Nas's best album in performance is illmatic yet did not beat biggie's debut ready to die. This is not my assessment but from RIA the American Music Industry Standard for album certification in the rap music category. Also this is in reference to the time of album(vinyl) sales not streaming and downloading we have now. Please can you tell us what the ideal sharing formula should be between a label and an artist. Please research what Wizkid got from EME,something like 25% or next to zero after expenses. jrusky: Going through this contract I noticed something is not right, I noticed *greed contract clause* or I called *career slavery contract* by seen sharing profit 50/50 for upcoming artist that clause is a complete dream killing contract clause.
I don't know Cynthia infact I'm hearing of her for the first time 2 days ago and Jude himself I only know he existed when Paul and Peter career began and lately about the marital fracas between his 2 siblings that was all.
Whatever happened let both put all behind and move on. MayD also dropped his unhapoiness with same Jude so let us not be too emotion as per things if few people speak ill of someone pls check that person life well possibly something not right somewhere. |

You are very knowledgeable of the industry of brand marketing. Those supporting her are just being emotional and sentimental. nextstep: Granted, this contract favors the company more than the artist, but that's what people mean by "pay your dues". She needs to hustle and really blow before she can start seeing real money. Second or third contract is always sweeter, with experience and more leverage. It's the same in any part of the world, whether movies, music, engineering, etc. Most entrepreneurs who seek venture capital barely break even on their first deal. There's a small profit on the second, then a larger payout on the third, and soon they are the ones calling the shots.
As lawyer mentioned yesterday - all the upfront costs are being borne by the Company. 100%. She's basically taking a loan on 50% of the costs of production and promotion, and needs to pay those back before she starts seeing royalties. And I've seen her video sets, they are expensive, albeit very creative and imaginative.
She's not the first, and could have asked for advice from others who have walked this same path. She assumed she could really blow quick, perhaps leverage some feuds to boost her, but reality has hit her hard. |

Where is the other 50% coming from then.50-50 is a fair deal.Put your money where your mouth is,she was signed as an established artist not an upcoming one.Dame way Don Jazzy signed Tiwa Savage. sketcherJ: Guys the title is not even the case. I took my time to read the content of this contract. I was kinda supporting Jude before but when I saw this contract. I just know that there is no way an artist would become rich in this record label. How much will the artist make to pay production fee 50% and still share 50% with the company? Read guys!! |

It is almost a hopeless situation,I have given up.Can you imagine how N40M was twisted to$40m and most of them fell for it without listening to Jude's interview. I knew Jude to be a very shrewd business man,my younger sis was his account officer in ETB then.He is not this monster they are portraying him to be . I was around squareville in 2013,it was a beehive of activities with lots of hangers on. Jude Engees is actually welcoming but Paul is the serious introvert. Talking about the silly boy MAYD claiming to be sleeping on TV carton in the BQ.he should have told his gullible audience about the gold encrusted beds his bosses were sleeping on in the main house. Most people will find it hard to believe that when PSQUARE shot their first popular video, they were living in a tenement building in rough part of Ilupeju and did not have a TV to watch their own video. They had to go to Howie T's(their manager then) house to see it. Now that Abuja is the capital of Nigeria and the FCT ministers are appointed over Abuja, I observed that most of the FCT ministers are often from the north except the first FCT minister. You can clarify this however my main question is when Lagos was the capital of Nigeria, was there a role for Lagos minister in a role similar to the position of FCT minister either in the military or civilian governments and if yes there was such a role , was it predominantly for southerners same way FCT minister is predominantly for northerners ?
