CrimeFive Arrested By Customs For Stealing Seized Tramadol by GistMore9(op): 8:12am On Aug 08, 2019
Five men have been arrested by the Nigeria Customs Service Onne Area Command, for stealing tramadol and other drugs from a sealed 40-foot seized container which they loaded in two vehicles.

Area Controller of the command Aliyu Saidu, revealed that the five suspects are being investigated and have been detained alongside the vehicles. The seized drugs include 14 cartons of Time tablets, five cartons of Really Extra analgesic and two cartons of tramadol.

“It is regrettable to note that while the Nigeria Customs Service is working round the clock to free this country of illicit goods, some recalcitrant and unpatriotic citizens are not relenting in their desperate urge to sabotage our efforts by spreading harmful drugs,” Aliyu said.

The suspects who will be charged to court allegedly tried bribing a Customs officer with N1m for an easy escape with the drugs.

PoliticsDiezani Poll Cash: EFCC To Arraign Ex-inec Chair Iwu Over N1.2b Scam by GistMore9(op): 10:24pm On Aug 07, 2019
A former Chairman of the Independent National Electoral Commission (INEC) Prof. Maurice Iwu is to face trial for alleged laundering of N1.2billion.

Iwu, who has been interrogated by the EFCC, was said to have been involved in the N23.29billion poll bribery scandal which characterized the 2015 poll.

Although charges have been filed against Iwu, it was unclear last night when the ex-INEC chairman will be formally arraigned.

A source said: “The Economic and Financial Crimes Commission (EFCC) is set to arraign a former Chairman of the Independent National Electoral Commission, INEC, Prof. Maurice Iwu.

“Iwu will be arraigned at a Federal High Court, sitting in Lagos on a four-count charge bordering on money laundering.

“Iwu is alleged to have between December 2014 and March 2015, aided the concealment of the sum of N1, 203,000,000 (One Billion, Two Hundred and Three Million Naira)

“The said sum was in the bank account of Bioresources Institute of Nigeria Limited domiciled in the United Bank for Africa, UBA Plc.

A reliable source, who gave insights into the investigation of Iwu, said: “The cash in question was about the poll bribery scandal in 2015.

“Iwu has been implicated in the N23.29billion poll bribery scam perpetrated by a former Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke.

“He was accused of allegedly using an NGO, West African Network of Electoral Observers, in the facilitation of bribery to top officials of the electoral commission. We have been on this case since 2016.

“We gave Iwu enough time to appear before us for interrogation. After series of quizzing and thorough perusal of relevant documents, we are set for his trial.”

The Acting Head of Media and Publicity of EFCC, Mr. Tony Orilade, said: “We will soon arraign the ex-INEC chairman.”

But Orilade was not forthcoming on the details.

The EFCC has been investigating the bribery scandal which was allegedly facilitated by a former Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke.

About four oil firms, some directors of some oil companies, two banks and some politicians more than 283 staff of INEC are under probe.

Also, about 205 staff of the Independent National Electoral Commission (INEC) are on trial in connection with the biggest electoral fraud in the country.

Many of the indicted INEC staff and politicians have owned up and refunded huge sums of money to the EFCC.

More than N3.4billion in cash has been recovered apart from choice assets seized by the anti-graft agency.

Some choice assets belonging to the affected staff have been placed under Interim Asset Forfeiture until the determination of cases against them.

Apart from the EFCC’s findings, INEC’s panel, headed by a National Commissioner, Baba Arfo Shettima made shocking discoveries as follows:

• An NGO, West African Network of Electoral Observers, was used to share the bribe to INEC

• A former chairman of INEC (names withheld) coordinated the large-scale bribery scandal.

• Many former Resident Electoral Commissioners (RECs) and retired Administrative Secretaries were used to penetrate INEC in all the 36 states for the bribery to alter poll results

• Some serving RECs and directors benefitted from the bribery scandal as confirmed by EFCC’s investigations

• A REC collected between N107million and N140million bribe

• While some RECs and INEC staff collected as much as over N100m, others were given as low as N150, 000 to compromise the electoral system.

PoliticsLawyers Disagree Over Sowore’s Arrest, #revolutionnow Protests by GistMore9(op): 7:19pm On Aug 05, 2019
Senior lawyers on Monday expressed divergent views on the arrest of former presidential aspirant Omoyele Sowore over the #RevolutionNow protests.

A Senior Advocate of Nigeria (SAN) Jibrin Okutepa said the 1999 Constitution does not recognise revolution in any form. But, another SAN, Seyi Sowemimo, said everyone has the right to a peaceful protest.

A senior lawyer, Jiti Ogunye, described the crackdown on protesters as a knee-jerk reaction by the government.

He said no government can be overthrown by mere words, adding that Sowore’s arrest was uncalled for except there is evidence to the contrary.

This is as the Centre for Anti-Corruption and Open Leadership (CACOL) called for Sowore’s release.

Okutepa said Section 1 (2) of the Constitution does not recognise any revolution other than through democratic process permitted by law.

“I have read some comments from prominent Nigerians who have expressed the views that calling for revolutionary change of government other than through democratic means comes within the purview of fundamental rights.

“Nothing can be further from the truth than these s fallacious, self-destructive and defeating arguments

”First, while I concede that demonstration is part of the constitutional rights of expression, calling for revolution for change of government in democratic set up is not part of the freedom guaranteed by the constitution. That is why Section 1(2) of the Constitution does not support that position,” the SAN said.

Okutepa warned gullible citizens from being misled into believing that calling for revolutionary change of government is part of the fundamental rights.

Besides, he noted that there are no rights without limitations.

“Some Nigerians seems to be encouraging all manners of subversive and destructive freedoms out of partisan political bitterness and hatred. Nigerians do not need revolution in the form of bloodletting.

“Those who encourage street revolution are far removed from those who will pay the Supreme prices for the so-called revolution to overwhelm government.

“While life is tough in Nigeria, we cannot make it tougher by calling for revolution through illegitimate means of changing government.

“I support any programme that will educate Nigerians to freely change bad government. No doubt we have bad government but the methods to change the government must not be through violence change of power.

“We must be careful with what we support for purely primordial partisan interest,” Okutepa said

Sowemimo said everyone has a right to peaceful protest, adding that merely calling for a revolution may not be enough ground for the security agencies to arrest Sowore or anyone else.

Sowore had called for nationwide protests beginning yesterday against what he described as bad governance.
But the senior lawyer urged the security agencies including the Department of State Service (DSS) to charge arrested #RevolutionNow protesters to court.
Sowemimo said: “People are entitled to engage in peaceful protest, one that is not violent and not calling for a forcible takeover of government.
“I don’t think simply calling for a revolution is enough ground to arrest anyone….If they feel that the chap (Sowore) has committed an offence they should charge him to court.”
For Ogunye, the government owes Sowore an apology after releasing him.

He recalled that President Muhammadu Buhari, before he won election, once called for revolution and led protests.

According to him, Buhari refused to attend Council of State meeting during the Olusegun Obasanjo administration because he was angry with the system.

“There is too much authoritarian intolerance and arrogance going on in this country. Someone calling for revolution is not a criminal offence. Musicians have been calling for revolution – from Bob Marley to Majek Fashek to Mandators. Was that an offence?

“It has been shown that this President was calling for revolution in this country. Who arrested and prosecuted him? He was vexed. He has participated in protests before.

“Protests are legitimate. There are statutory, constitutional and case law decisions that back protests. Breaking protests is not right. How could the IGP call someone a terrorist?” Ogunye said.

To him, a citizen can only be arrested where there is strong intelligence that he the intention and has wherewithal to overthrow a government, not by mere words.

Ogunye said the government’s crackdown on protests could even lead people into more desperate measures and further cast the government in further bad light.

“So, by their action, they will be driving people to adopt desperate solutions, including a revolution.

“I join the call for the release of Sowore. Not only that, they should tender unreserved apology to him for arresting him and violating his fundamental right to freedom of expression,” the SAN added.

Asked if Sowore’s choice of words was not inciting, Ogunye said: “Oratorical violence, carelessness and even recklessness may have consequences, but they will not bring about a collapse of government.

“If words of mouth are what coup plotters in the past, including those who are in government now, used to upstage government, then government will be falling like packs of cards.

“Those who bring down government use guns. Where are the guns in the hands of these ‘revolutionaries’? What he says is not what is important as whether he has formed an intention that is verifiable to overthrow a government. That is what you call treasonable felony.”

CACOL, in a statement by its Media and Publications Coordinator Adegboyega Otunuga, said while it does not support violent take-over of government, especially under a democratic arrangement, the right to protest peacefully must be respected.

“Whoever that calls for a revolution alone, whether ethical, agrarian, industrial or even social, does not and cannot constitute treasonable felony acts on their own, except there are other unimpeachable evidences of arms insurrection, concrete proofs of inciting or consultations on arms struggle,” CACOL said.

The group noted that it was not aware whether security agencies have such intelligence in its possession.

“That in itself may now also be debatable as social movements and prevailing conditions may remain veritable instruments of juxtaposition in resolving how mutiny and treason should be treated in a civil entity. However, nothing even points to these possibilities in this circumstance.

“We, therefore, advise that Sowore be granted an unconditional and immediate release to defray an unnecessary tension and heating up of the polity which his continued detention is only capable of fostering,” CACOL added.

CrimePolice Arrest 32 Suspected Cultists, Recover Arms In Lagos by GistMore9(op): 9:24pm On Aug 04, 2019
The Police Command in Lagos State has arrested 32 suspected cultists and recovered firearms in the last one week.

Spokesman for the command, DSP Bala Elkana, confirmed the arrest in a statement on Sunday.

He said that a 32-year-old man (names withheld), a member of Aiye Confraternity, was arrested on Saturday.

Elkana said the suspect, arrested by the Cultism Squad, while on patrol at Mosafejo Amukoko Street, Ajegunle, was found in possession of one locally made pistol.

He stressed that the suspect confessed his gang was responsible for series of violent crimes in Ajegunle.

“Investigation is ongoing and efforts are in place to apprehend other members of his gang. The suspect will be charged to court,” he said.

Elkana said, on the same day operatives of the Operation Crush from 8 Division in Area H Command, Ogudu raided a cultists’ hideout at Bariga.

The raid, he said, paid off as a 39-year-old suspected cult leader, a resident of Kajora Street, Bariga, was arrested with 22 members of his gang.

“They all confessed to being members of a deadly gang and a cult group responsible for various killings and violent crimes in Bariga.

“Investigation is ongoing, and suspects will be charged to court,” he said.

He noted that a follow-up operation, carried out by officers of the Bariga Police Station on Wednesday, at Oyenaya Street, Bariga, led to the arrest of 20-year-old suspect and five other members of his gang.

Elkana said two other suspected cultists were arrested on July 24 at Itabale Igbolomu area of Owutu, Ikorodu, while engaging each other in a battle for supremacy.

He said one locally made pistol was recovered from them, stressing that all the suspects would be charged to court soon.
