The Lagos State Government Thursday filed an application seeking to present Mr. (SAN) as a witness in its trial of the suspected billionaire kidnap kingpin, Chukwudumeme Onwuamadike alias Evans at an Igbosere High Court, Lagos.

Prosecution counsel Mr Y. G Oshoala told Justice Adedayo Akintoye that Evans made a claim concerning Falana while testifying in a trial within trial which required clarification by the lawyer-activist.

A trial -within-trial is a mini trial conducted to find out, among others, if a defendant in a criminal matter made his confessional statement voluntarily or otherwise.

Oshoala’s application followed the resumption of proceedings in the fourth and fifth in a series of kidnap, murder and attempted murder charges brought against him by the Lagos State Government.

But only two charges are before Justice Akintoye. Three others are before Justices Hakeem Oshodi and Oluwatoyin Taiwo of the Ikeja High Court.

In the first charge before Justice Taiwo, Evans and three others – Joseph Emeka, Ugochukwu Nwachukwu and Victor Aduba – pleaded not guilty to a five-count charge of conspiracy to kidnap, kidnapping and attempted murder.

In the second charge, Evans is being tried alongside Joseph Emeka, Linus Okpara and Victor Aduba.

Oshoala made the application during trial on the second charge.

He told Justice Akintoye that during the trial within trial on January 16, Evans claimed that after his arrest in 2017, the police obtained a confessional statement from him under duress.

He said Evans alleged that Falana visited the police station where he was being tortured, but a Chief Superintendent (CSP) hid him in a toilet until the lawyer left.

The prosecutor noted that he needed to call the SAN as a witness “in the interest of justice.”

But Evans’ counsel Mr. R. B. Ekeh said he had yet to respond to the application, adding that other defendants’ counsel said they were not served with the application.

Countering him, Oshoala explained that “the issue came up during trial within trial of the first defendant (Evans), it therefore does not concern the other defendants”.

But Justice Akintoye upheld Ekeh’s argument and ordered that all the defendants be served, “those concerned will reply”.

Following this, the third defendant’s counsel, Mr S. E. Okeke, holding the brief of Mr J. C. Jiakponna, told the court that he had a bail application.

The third defendant is Mr Linus Opara.

Okeke informed the court that he had served the Medical Director of Kirikiri Maximum Security Prison, an order requiring the director to issue a medical report on Opara’s state of health.

Justice Akintoye made the order made on May 23 after Opara claimed that he had a failed operation in prison which might require treatment outside the prison.

The prisons “have not reacted to it (the order). We will move our bail application after the prisons have reacted to the court’s order,” Okeke said.

Justice Akintoye adjourned further proceedings till September 18.

Residents of Olunlade Area in Ilorin on Thursday lamented the havoc wrecked by flood on their property as buildings, cars and shops were destroyed after a heavy rainfall.

The News Agency of Nigeria (NAN) reports that the area experienced downpour around 4 p.m. on Wednesday and lasted for about three hours.

Some of the victims, who spoke separately with NAN expressed sadness over the terrible occurrence and damage done to their property.

One of the victims, Mr Femi Olaoye, whose house was taken over by flood, said he was helpless as the water entered his siting room and kitchen.

“I was bitter and sad as there is nothing I could do to stop the flood from entering my house. It was only me and my two children at home. I wept bitterly to witness such terrible occurrence.

“All my electronics were damaged beyond repair. Even the bedroom has turned to swimming pool. I am confused,” he said.

Another resident, Mr Yusuf Taiwo said the flood came as a nightmare to him as his furniture, bookshelf and electronics were destroyed by the flood.

“Even some vital documents that I placed on the floor in my room have been destroyed by the flood.

“I don’t know what to do because am confused at the moment. I never expect the extent of the damage done by the flood. It was a shock,” he said.

A shop owner in the area, Mrs Ronke Idowu also told NAN that almost all the provisions in her shop were damaged.

“It is a total loss for me as there is nothing left for sale. All the cartons of biscuit, noodles, sweet and soaps were damaged by the flood.

“Some were on the bare floor in my shop that made it easy for them to be destroyed beyond retrieval,” she said.

Mr Timilehin Olubiyo said he had to abandon the building with his family since the incident occurred because he could not continue to live in the house.

“I immediately move my family to a friend’s house. Even I cannot take ordinary clothes along as all my clothes were damaged.

“It is very unfortunate. I am not happy at all. We want government’s intervention on time,” he said.

Kayode Jimoh, a taxi driver said his car was a major concern as the car was also submerged in the flood.

“I don’t know what to do. I parked it in front of my house and because of the downpour, before I realized it, it was water filled. I can’t move it now because it’s not starting when I try to start it.

“My concern now is how to make a living since I rely on the car for my livelihood. It is only God that can help me so that I won’t to shame,” he said.

Some suspected bandits have shot the wife of Bunza Local Council Chairman, a policeman and a member of the local vigilante at Zogirma community in Kebbi State after a botched kidnap attempt.

The News Agency of Nigeria (NAN) reports that the victims are at the intensive care unit of the Federal Medical Centre (FMC), Birnin Kebbi.

Aliyu Usman, a resident of Zogirma community, told reporters that when the bandits came into the community, they shot sporadically and abducted the woman from her home.

“They went to the chairman’s house, but couldn’t initially gain entrance. They shot at the door several times and when they entered, they took his wife,” Usman said.

He said a policeman and a member of the vigilante group went after the bandits in an attempt to rescue the woman.

“They started shooting and they shot the woman, the policeman and a member of the vigilante group in the process,’’ he said.

When NAN correspondent visited the FMC, the Chief Medical Director, Dr Hamzat Balarabe, said the centre operated on the vigilante group member for him to survive.

“We are planning to move quickly on the woman too as she has multiple fractures and a wound at the lower part of her chest,’’ he said.

The council Chairman, Alhaji Bello Zogirma, who confirmed the incident, said the suspected armed bandits invaded the community at about 1:40am on Sunday and shot sporadically to scare away residents.

“The bandits in their numbers had kidnapped my wife and a father in the family but no lives were lost during the attack.

“The kidnapped persons have regained their freedom after an exchange of fire between the bandits and the police with support from the vigilante group in the area,’’ Zogirma said.

He said: “I have learnt that immediately after the attack, a combined operation of the Army, Police and other security operatives was launched around the bush.

“And it paid off as one of the suspects that sustained gunshot injuries was arrested in one of the hospitals in Kamba where he was taken for treatment by the bandits.’’

The council chairman commended Governor Atiku Bagudu and security operatives for their quick response to the attack.

“Governor Bagudu was at the hospital early to see the three people that were injured in the attack,’’ he said.

A 55-year-old father, Eze Chukwuma, was on Monday arraigned before the Lagos State Special Offences Court for allegedly molesting his two daughters.

He was arraigned on two counts bordering on defilement contrary to Section 137 of the Criminal Law CH. C17. Vol 3, Law of Lagos of State, 2015.

It was gathered that the father molested his daughters, aged 16 and 17, between 2008 and 2017, at No 2 Agbeke Close, Iyana-Era, Coker bus stop, Ijanikin, Lagos.

PUNCH Metro learnt that Chukwuma allegedly started molesting his daughters after the death of his wife in February 2008.

According to the 16-year-old daughter, the suspect, who allegedly deflowered her in 2008, takes turns with the sisters every night.

She added that one of her elder sisters absconded from home after she could no longer endure the incessant sexual harassment.

She said in her statement to the police, “The whole thing started when my mother died in February 2008. My father brought us back from the village in Ebonyi State to Lagos and started harassing my elder sister sexually; two of my elder sisters were already staying with him then. When we got to the house, we couldn’t find one of my sisters.

“So, I asked my eldest sister and she said that she ran away from the house when she could no longer bear daddy’s sexual harassment.

“My eldest sister stayed and endured everything, because she would soon finish secondary school. My eldest sister later gained admission to the university and since then has not come home, neither has she spoken with my father.

“At a point, I was left at home with my two other sisters and at night, my father would ask us to separate ourselves so that he could sleep with one person first before going for the other. Sometimes, he would threaten to stab us if we refused to allow him to have his way.”

The presiding judge, Justice Abiola Sholadoye, ordered that the defendant be remanded in the Kirikiri Medium Prison and adjourned the case till October 28 for trial.

Meanwhile, a 43-year-old Muslim cleric, Abdulsalam Salaudeen, has also been arraigned before the court for allegedly molesting a five-year-old pupil in the mosque.

Salaudeen was arraigned on one count of defilement.

It was gathered that the cleric, who was engaged to teach the victim Islamic studies, on December 22, 2018, at the Olorungbebe Mosque, Iyana Ile-Oba in the Igando area of Lagos, allegedly lured her to a secluded place in the mosque and molested her.

Our correspondent learnt that a neighbour, who recorded the act, allegedly took the footage to the Lagos State Police Command.

According to the prosecutor, Momoh Ayokanmi, the then Commissioner of Police, Edgal Imohimi, directed undercover operatives attached to the State Criminal Investigation and Intelligence Bureau to arrest the suspects and hand him over to the Gender Section of the command for detailed investigation.

Salaudeen, who had earlier been arraigned before the Ikeja Chief Magistrates’ Court, was re-arraigned before the Special Offences Court. He pleaded not guilty to the charge.

Justice Soladoye ordered that the cleric be remanded in the Kirikiri Prison till October 14, when the case will come up again.
