Politics / VAT: FIRS Seeks Shutout Of Lagos From Appeal, Court Reserves Ruling by goldenprince1(m): 2:34pm On Sep 16, 2021
The Abuja Division of the Court of Appeal has reserved ruling on a motion on notice filed by the Lagos State Government seeking to be joined in a suit filed by the Federal Inland Revenue Service (FIRS) over value added tax.

On September 3, Lagos attorney general Moyosore Onigbanjo applied to be joined as a respondent in an appeal filled by the Federal Inland Revenue Service (FIRS) against the judgement of the Rivers Division of the Federal High Court.

At the resumed hearing on Thursday, the FIRS, through its counsel Mohammed Magaji (SAN), prayed the court to discountenance the application of the Lagos State Government.

Mr Magaji argued that Lagos State application was faulty from inception.
But Mr Onigbanjo countered, arguing that Lagos could not be shut out of a matter for which the FIRS has already made allegation against the state.

“Why will they make allegation against Lagos State Government in their processes and won’t allow us to join?” Mr Onigbanjo queried. “You made allegation against us, you then said we should not be joined. Section 36 permits us to come and react.

“No court of equity should take cognisance such submission. If we go by the submission of my friends, it is inevitable that it will lead to another action. An application for joinder seeks to prevent multiplicity of action,” Mr Onigbanjo said.

Arguing further, the Lagos attorney general said the court had already recognised the place of Lagos in the matter in its ruling of September 10.

“Finally, it was in recognition of the interest of Lagos that the court on September 10 ordered even Lagos state to maintain status quo. They argued strenuously for that order to be made. It was the appellant who sought for the order,” he added.

Mr Onigbanjo then presented before the court, the judgement of the Rivers court as exhibit one and notice of appeal filed by FIRS as exhibit two.

The court in a three-member-panel led by Haruna Tsammani reserved ruling, saying it will communicate new date to parties.

On September 10, the appellate court ordered the Rivers and Lagos authorities to stop the collection of Value Added Tax (VAT) pending determination of the application filed by the FIRS.

A three-member panel led by Mr Tsammani ordered that “the status quo ante bellum be maintained.”

The FIRS had in an appeal marked CA/PH/282/2021 sought an injunction pending appeal and a stay of execution of the Rivers court judgement on VAT collection.

Peoples Gazette reported that a Rivers Division of the Federal High Court in a suit marked FHC/PH/CS/149/2020 declared the collection of VAT by the federal government of Nigeria unconstitutional and Rivers the rightful body to receive personal income tax and VAT emanating from the state.

The removal of Comrade Adams Oshiomhole as the national chairman of the All Progressives Congress (APC) by a pronouncement of the Federal High Court has thrown up a leadership challenge in the party.

The former Oyo State governor, Senator Isiaka Ajimobi, whose approval as Deputy National Chairman was announced today (Wednesday) may emerge as acting chairman.

By the provision of Article 14.2 of the APC Constitution 2010( as amended) the Deputy National Chairman, South should assume the exalted office of Chairman of the party in an acting capacity.

Article 14.2( i, ii, iii) stipulates the functions of the Deputy National Chairman, North/ South.

It reads in part: “Assist the national chairman in the discharge of his duties; Perform such functions as may be assigned to him from time to time by the National Working Committee; Shall act as the national chairman in the absence of the national chairman from his Zone.”

A statement issued by Lanre Isa-Onilu, Wednesday night, disclosed that a meeting of the national working committee held on January 14, 2020, reached a decision to ratify the immediate past Oyo State governor, senator Ajimobi as new deputy national chairman, South.

There are, however, other forces in the party who may resist the new realities.

Southwest governors insisted on Sunday that the Western Nigeria Security Network (WNSN) Operation Amotekun has come to stay.

The security outfit, launched on January 9 to give cover to the zone, was declared illegal by the Federal Government.

Reiterating the position of the governors on Sunday, Ondo State Governor Rotimi Akeredolu said they would not “capitulate to blackmail either from within or outside the region but ready to pursue the Amotekun security scheme through all permissible political and legal means.”

Akeredolu (SAN) is the Chairman of the Southwest Governors’ Forum. He made this position known through a statement by Commissioner for Information Donald Ojogo.

Senior Advocate of Nigeria Afe Babalola, said attempts by the Federal Government to scuttle the initiative would fail because it is constitutional.

His position tallies with that of other legal giants like Prof. Itse Sagay (SAN) and Olisa Agbakoba (SAN).

Akeredolu explained that Amotekun was initiated to complement the efforts of conventional security agencies that appear to have been hampered by the absence of local intelligence gathering.

According to the statement, Amotekun will, when fully operational, serve the purposes of local information and intelligence gathering for the Police, Army and other conventional security agencies.

The statement said: “The concerns expressed by individuals, agencies of government and several stakeholders are noted without bias. Where possible, the inexorable efforts of the Southwest governors will be deepened through relentless interface.

“As such interface and engagements continue, Governor Akeredolu finds it pertinent to say that the on-going discourse on the issue of Amotekun must not be misguidedly used as a platform to ventilate personal or group views aimed at oiling primordial sentiments and grievances. Ethicizing the current situation is even more unhelpful. There should be no reason for such.

“This is more so that the Amotekun scheme is not targeted at any non-Southwest ethnic group just as its benefits are to be reaped by all Nigerians irrespective of ethnic or religious placements.

“ Under circumstances of the nature of Amotekun, the choices are numerous. They range from prevarication and pretence; partisanship and sycophancy as well as moderate and complimentary steps not inimical to the corporate existence of our nation, Nigeria.

“ The Southwest governors have chosen the later. In unequivocal terms too, each of the choices has a consequence, if not consequences.

”Unfortunately, the steps of Southwest governors have unwittingly had to contend with forces of conspiratorial silence and unpretentious moves of sabotage. Each has a right to choices; but certainly, no one individual can circumvent the consequences of whatever choices he or she makes in life.”

It added: “Fears and apprehensions have been expressed in many quarters that his (Akeredolu’s) role in the formation of Amotekun could mar his second term chances. This is far from the truth because Akeredolu is on the path of national cohesion through collaborative internal security.

“The decision taken in respect of Amotekun was in the interest of the entire nation. The political insinuations and blackmail are the required ingredients needed to make it credible. But such will not discourage the governor in any manner.”

Babalola, an elder statesman and founder of Afe Babalola university, said those kicking against Amotekun were ignorant of the provisions of the 1999 Constitution and the previous ones.

Babalola faulted Malami, saying sections 24, 40, 45of the 1999 Constitution impose clear responsibility on citizens to ensure security of their lives and property.

The SAN said it was unfortunate that Malami relied on Article 45 second schedule of the Constitution (amended), that gives to the Federal Government the exclusive power to manage the police.

Babalola defended the Southwest governors, saying they only responded to the yearnings of the people of the geopolitical zone for improved security since the central police system had failed to safeguard them and their property.

He pointed out that kidnapping, armed robbery, herdsmen/farmers clashes and other security challenges prompted the formation of Amotekun as a regional response to stem the developments.

The legal giant argued further that the governors had the right to protect their people because that was the ultimate responsibility of responsive governments.

He said: “Amotekun is a protective and supportive outfit established by the governors of the Southwest. It has its roots in the 1999 Constitution and the constitutions before it – 1960 and 1963.

”Section 24 of the constitution provides that ‘it shall be the duty of every citizen to make positive and useful contribution to the advancement, progress and well-being of the community where he resides’. Well-being means security of life and property, etcetera. How many Nigerians realise that they have a duty to assist and to protect the interest of their community and themselves.

”And Section 40 goes further that ‘every person shall be entitled to assemble freely and associate with other persons, and in particular, he may form or belong to any political party, trade union or any other association for the protection of his interests’.

”When you put these two together, it shows that all of us have the duty to associate whether as Yoruba or as state people to ensure that lives and properties are safe. The Amotekun outfit has its roots in the Constitution. It is constitutional, it is legal and proper.”

He added: “If this outfit had been established about 10 years ago, we would not have these issue of kidnapping, killing and other security challenges. We won’t have those who go to the farms to kill people because they would be fished out. That is why the Constitution says that such outfit should report to the police.

”What I have just said is that it is to support the police and support the government in their duty to ensure that there is peace, safety of property and lives. It is a good idea. It is belated but it is lawful and constitutional.

”All that the AGF said is that Article 45 of the Constitution, second schedule gives to the Federal Government the exclusive power to manage the police, he did not say that sections 20, 40 and 45 are abrogated. They cannot abrogate it.

”The sections I have quoted are superior to the schedule he is talking about and in any event, the governors have not set up a parallel police outfit. What they have done is to set up a supportive and protective organ to assist the police and in their communiqué, they said it would report to the police.

”The law says you can join together in association to assist the police. How can the police or any government be angry about this.

”In my opinion, the act has been done. Amotekun has been launched, let them go on. What the state governors have done is legal, so why should they bother? Let them (Federal Government) try to go to court. They will meet the governors there. All what they would have to do is to show them sections 24, 40, 45 of the 1999 Constitution.

”It is a case that must fail if they go to court. They have not set up a parallel police outfit. No. the Constitution says it is your duty to protect the interest of yourself and others and join together in doing so. So simple. The case will be so easy to win.”

Yoruba youth groups under the umbrella of Yoruba World Congress (YWC) are planning a support rally for Amotekun in the capital cities of the six Southwest on Tuesday.

A renowned historian and YWC convener, Prof. Banji Akintoye, who made this known, also said the rally would take place in Ilorin, Kwara State.

”We the Yoruba nation, we are going to speak up. By Tuesday (tomorrow), there will be masses of people in the streets in the seven capital towns of Yoruba people, “ he told officials of the Development Agenda for Western Nigeria (DAWN) Commission when he visited their office in Ibadan at the weekend.

The DAWN commission, a body in charge of championing the development of the Southwest geopolitical zone, coordinates Amotekun.

He explained that Ilorin was added because Kwara is a largely a Yoruba state.

Akintoye said there was need for the Yoruba to rally round the six governors since Amotekun was a good initiative by them.

He urged the DAWN commission, being the body in charge of championing the development of the region, to coordinate the implementation of the security network.

His words: You are the coordinating agency for Amotekun; don’t leave the governors for those people that have personal agendas to tear at them. Our governors are doing a good job now; we owe them the duty of standing up for them.”

The Director-General of DAWN Commission, Seye Oyeleye, said Amotekun was not meant to protect Nigeria but ”the people living here(Southwest), whether you are Ibibio or Efik or Igala.”

Rotimi Ojomoyela Ado Ekiti — A legal luminary, Chief Afe Babalola (SAN), has advised the Attorney General and Minister of Justice, Abubakar Malami to take the six southwest governors to court over the creation of the joint security network codenamed ‘operation Amotekun’, rather than constituting himself to a Court dishing out judgement.

The Founder of Afe Babalola University, Ado-Ekiti, (ABUAD), said it would be gross abuse of court process for the FG to expect the southwest governors to file an action against the FG on operation Amotekun.


Babalola, who spoke in Ado Ekiti on Sunday on the Southwest security initiative, which is currently eliciting reaction across the Country, said, the FG should be the one to approach the court to seek redress, since it waited until after the formation of Amotekun before making its position known.

According to the legal Icon, “In my opinion, the act has been done, Amotekun had been launched, let them go on. Anybody that feels what they have done is wrong can go to court. They will meet the governors there. All the govs would have to do is to show them the law, the constitution, sections 24, 40, 45. That is it.

“What the state governors have done is legal, so why should they bother? Let the FG try to go to court. It is a case that must fail if they go to court. They have not set up a parallel police outfit. No. the constitution says it is your duty to protect the interest of yourself and others and join together in doing so. So simple. The case will be so easy to win.

Don't rush to the bank yet without first of all making a report at the police station. It's very dangerous and might land you in prison if you go with reporting first at the station ...because the banks are already looking for you.

The know you will come around if you can't access you account.


This very issue happened to somebody I know in August this year and God helped him out.


This same issue happened to a boy working for my friend but he was lucky not to have gone to the bank directly.

What happened was that a boy illegally transferred money (N10,000) from his father's corporate account to this boy's account which he withdrew for this boy a day after.

Unknown to the man, the owner of the account, that his son was behind the evil act. He went report the matter to his bank and his bank traced the funds to my friend's boy account and his account was restricted.

This boy called the customer care, he was told to visit the nearest branch of bank that his account is being investigated for some transactions done on it.

We advised him NOT to go to the bank because he would be arrested and tagged an accomplice in the crime.

He listened to other people urging to go to bank first. He went to the branch close to his place of abode.

On getting to the bank he was told to wait while they work to rectify the issue with his account( a ploy to delay him and get him arrested).

Sensing danger and luckily for him, the banker handling his issue went upstairs to get some documents. Before he returned this boy ran quickly out of the bank and disappeared into the crowd of people in the market.

On getting home, he narrated how he almost got arrested and how he miraculously escaped.

It was then he did what we had advised him to do first, which is going to a nearest police station to make a formal complaint.

He went to the Police to make a statement.
The DPO told him that he was very lucky to have escaped because it was a fraud case and that banks don't joke with such.

The DPO said he was sure that he would be declare wanted soon but thank God he has come make a police report. That even he was eventually arrested that he would say that he had made a police report regarding the matter and that would help him greatly in the case.

So, the Police asked if he knew where the guy who transferred the money to his account stay and said yes.

He took the police there and he was arrested. It was after he was arrested that his father got know that it's his son who has been illegally transferring money from his account.

The police told the man that in order for them to release his son, he should write to his bank telling them that he now know who was behind all the illegal transfers from his accounts so the bank will unfreeze the innocent boy's account. That his son is responsible.

The wrote his account officer his detailing all that happened....

He son was released on bail and the boy's account was unfreezed 4 weeks after.

OP, you should be able to produce the person who sent the money to your account when the police ask you so as to help them in their investigation.

This is latest crime in town now and it's sending innocent people to jail for crime they knew nothing about.

The Oyo State Governor, Abiola Ajimobi has said it will now pardon Yinka Ayefele because of his appeal and not because he is physically challenged.

According to the governor, being physically challenged doesn’t give anyone the right to break the law.

He said this while reacting to the backlash he got for demolishing Ayefele’s Music House worth N800m.

In an interview with BBC, he said: “Ayefele didn’t obey the law. People are saying he should be pardoned because he is physically challenged.

“So, does being physically challenged give one the right to break the law? They said he employed people, but even thieves employ people. Should we say a thief should continue stealing because he employed people?

“And we warned him (Ayefele) about the building. Now that he has appealed, we will pardon him, but we must always obey the law.”

No jokes. I have watched very successful people, who started from the scratch, move through these four stages –

It’s the path to ANY significant path in life.


Here they are:


Stage 1: Survival.
==============
This is the stage you are in when you are just starting out. You are dead broke. No money in the account. And to eat you will need to FIGHT.

To move from this stage to the next, you will have to get a high level skill. A skill you charge high for. Or you need to sell a ton-load of stuff.


Stage 2: Security:
=============
This is the stage where you no longer worry about going hungry. You have a house. A car. And you are able to provide for people you love.

This is the stage where you start taking the money from stage one and start investing them. Putting them into real estate, or a business that brings in money consistently.


Stage 3: Success.
==============
This is where you get to that point you have been after. Fame. Wealth. Whatever you call success, this is the stage where it happens. You become financially free and you do not have to worry about money whether or not you work. Your investment portfolio becomes full and overflowing.


Stage 4: Significance.
================
This is the top 1% of the best. This is where when you sneeze and a whole nation or a whole continent or the whole world will catch code.

The Deputy Governor of Kano State, Hafeez Abubakar, has defected from the ruling All Progressives Congress (APC) to the People Democratic Party (PDP).

Sources close to the Deputy Governor confirmed the report of the defection to Channels Television.

The PDP in a tweet on its official handle @OfficialPDPNig has since welcomed Abubakar for returning to the party.

A child will go to school by 7am and close by 5pm for five days out of the seven days in a week.

During weekends that child comes home with many assignments in all the subjects he or she is offering in school. So there won't be time to rest and play through out the weekend.

The child does that for almost four months hoping to enjoy the holidays only for schools to come up with a scam in the name of holidays lesson.

What exactly do you want to teach that child?

Dear Nigerian parents, summer holiday is a period you allow a child to experience other things in life apart from formal education.

Allow them to travel for the vacation and if you don't have money for vacation, take them to a place where they will learn new skills.

Let them go and learn how to draw, computer coding, how to play football, martial art, learn business, catering, tie and die, learn foreign languages etc

Allow this children to explore life.

Everytime Book book book that is why most of our youths are unemployed because they can't do any other thing apart from white collar job.

And here is an NYSC Batch B certificate signed by Brig-Gen. Maharazu Ismaila Tsiga who succeeded the ex-DG Bomoi in January 2009.

He assumed duties on Monday 26th January, 2009 in Abuja as the new chief executive of the scheme.

A friend of mine shared his 2009 NYSC Batch B certificate with me a while ago, and there's a clear difference between the signature therein and the one Mrs Kemi Adeosun has.

My friend was a 2009 Batch B Corps Member who served between 26th August 2008 to 25th August,2009.

He said when he passed out in August 2009, when Brig-Gen. Maharazu Ismaila Tsiga came into office as the 14th NYSC DG.

He assumed duties on Monday 26th January, 2009 in Abuja to succeed Brigadier General Yusuf Bomoi (Rtd)(who allegedly signed Hon. Minister of Finance NYSC certificate)


NYSC needs to come out and clear the air once and for all.
